Price, P.E., Director of Public Works Subject: Approve the purchase of right of way and easements for Woodland Heights Connector from the property at 2121 East Southlake Boulevard Action Requested: Background Information: Approve the purchase of right of way and easements for Woodland Heights Connector from the property at 2121 East Southlake Boulevard The City is currently acquiring right of way necessary for the construction of the Woodland Heights connector project. The property located at 2121 East Southlake Boulevard is owned by Gateway Church. The property appraisals valued the right of way and slope easement for the property. The offer to the property owner was made for the right of way and easement based upon said appraisals. The right of way and easement areas are necessary to accommodate additional travel lanes and a pedestrian sidewalk that are included in the connector project. Proposed Settlement (based on appraisal) Right of way (9,748sf @ $6.00 /sf) $58,500.00 Slope esmt. 2,150.00 Improvements* 6,700.00 Cost to cure ** 6,735.00 Net Value $74,085.00 *value of improvement, less depreciation * *reduction in value of the whole versus remainder, zoning change, septic to sewer, loss of trees The property owner has agreed to the offer of $74,085.00, which is within the previously authorized City Council variance of the appraised value for the right of way and slope easement. Financial Considerations: Funding for the right of way and easement purchase is available in the FY 2011 capital improvement program budget. Strategic Link: The Woodland Heights Connector project links to the city's strategy map relative to the focus areas of Mobility, Infrastructure, and Performance Management and Service Delivery. The specific corporate objectives that are met by this construction project include: Providing travel convenience within city and region; Providing high quality customer service; and Investing to provide and maintain high quality public assets. Citizen Input/ Board Review: N/A Legal Review: The standard right of way and easement documents have been reviewed by the City Attorney's office. Alternatives: The City Council may approve or deny this purchase.
