Item 6A (2)13 SOUTHLAI<,,E CITY OF Department of Planning & Development Services STAFF REPORT June 1, 2011 CASE NO aWomx00 EXECUTIVE SUMMARY: REQUEST DETAILS: VARIANCE EQUEST: ZA11 -007 Zoning Change and Site Plan for Carroll Senior High School On behalf of Carroll Independent School District, Hart, Gaugler and Associates, Inc. is requesting a Zoning Change and Site Plan from "S -P -1" Detailed Site Plan District to "S -P -1" Detailed Site Plan District for improvements to the Carroll ISD Senior High School on approximately 55.03 acres located at 1501 W. Southlake Blvd. SPIN #10. The applicant originally proposed the following changes: • Provide additional parking between the existing tennis courts and the existing baseball field; • Provide a new access driveway from the new parking to the existing parking adjacent to the baseball field; • Provide for the development of a new service yard area that can be enclosed near the existing cooling tower; • Provide for additional parking east of the new service yard area; and • Revise the landscape plan to accommodate the new parking and access driveway. After receiving opposition to the proposed changes above from surrounding property owners, the applicant has revised the plans to eliminate the driveway east of the tennis courts and the parking north and south of the tennis courts and now proposes the following changes: • Provide 59 additional parking spaces west of the natatorium; • Provide 47 additional parking spaces southwest of the new art building; • Provide a driveway connection that bypasses the existing service yard area so that it can be enclosed. A variance to the required 8' multi -use trail is requested to allow a minimum width of 4.5' adjacent to an existing fire hydrant, telephone box, fence and culvert. Southlake Blvd. An eight -foot (8) multi -use trail was required along the east side of South Peytonville Avenue as part of case ZA10 -019. TREE PRESERVATION: Three (3) oak trees are shown as "to be removed" in the proposed parking area southwest of the new art building. Six (6) oak trees are shown as "marginal" in the same area. No trees will be affected by the additional parking proposed west of the natatorium or by the proposed driveway that bypasses the existing service yard area. THESE STIPULATIONS ARE HEREBY MADE CONDITIONS OF SITE PLAN APPROVAL UNLESS SPECIFICALLY AMENDED BY THE CITY COUNCIL. Please ensure that all parking lot landscape islands are at least 12' in width at the widest point, from back of curb —to- back of curb. 2. Section 5.06.0 of the Subdivision Ordinance requires that sidewalks be located no closer than two feet (2) to the curb or grade line. A variance was previously approved (ZA10 -019) to allow sidewalks located less than two feet (2') from the curb, allowing a multi -use trail of less than 8' adjacent to the existing gas meter. 3. Show any intended lighting. All lighting must comply with the Lighting Ordinance No. 693, as amended with regard to type of lighting, intensity, glare and spill -over. TREE CONSERVATION COMMENTS: 1. Three (3) oak trees are shown as "to be removed" in the proposed parking area southwest of the new art building. Six (6) oak trees are shown as "marginal" in the same area. No trees will be affected by the additional parking proposed west of the natatorium or by the proposed driveway that bypasses the existing service yard area. Please be aware that all existing trees shown to be preserved on the City Council approved Tree Conservation Plan must be preserved and protected during all phases and construction of the development. Alteration or removal of any of the existing trees shown to be preserved on the approved Tree Conservation Plan is a violation of the Tree Preservation Ordinance and the zoning as approved by the Southlake City Council. Please ensure that the layout of all structures, easements, utilities, structures grading, and any other structure proposed to be constructed do not conflict with existing trees intended to be preserved. GENERAL COMMENTS: 1. Provide all necessary easements if needed for water, sanitary sewer and drainage. Easements shall be 15' minimum and located on one lot — not centered on the property line. A minimum 20' easement is required if both storm sewer and sanitary sewer will be located within the easement. 2. All fire hydrants should be located within an easement. 3. The sewer line appears to be private and should not require and easement. Case No. Attachment D ZA11 -007 Page 1 DRAINAGE COMMENTS: 1. The majority of the site drains through a serious of inlets and pipes to the eastern side of the property and then south along the property line through a drainage easement where it 2. It does not appear that an actual easement is dedicated for the detention pond. Since the plat will have to be amended, please add an easement. * A copy of the SWPPP, if required, will need to be submitted to the Public Works department prior to a pre construction meeting being scheduled. * The discharge of post development runoff must have no adverse impact on downstream properties and meet the provisions of Ordinance # 605. INFORMATIONAL COMMENTS: * Submit 4 copies of the civil construction plans (22" X 34" full size sheets) and a completed Construction Plan Checklist as part of the first submittal for review directly to the Public Works Administration Department. My opposition is based upon the following facts: • Same proposal as 8 months ago. It is my understanding that when a proposal is denied, there must be a significant change in order for the ordinance to be reconsidered. In this case, the plan for the road and parking are identical to the proposal introduced last year. The changes involve the New Service Yard area, the added parking by the New Service Yard Area and a sidewalk on Peytonville Road. The road and proposed parking on the south side of the tennis courts is identical to last year's proposal. As a homeowner, when does no mean no. Will we as residents have to be constantly be on the lookout forthe same issues to be brought back to City Council? • Minimal space between the Tennis Courts and Stone Lakes neighborhood. Currently, there is 60 feet between the Tennis Courts and Stone Lakes homeowners. Bleachers have already been approved to be added (which have not been included in CISD's proposal). The bleachers on the west side are 11 -12 feet. An average road is 24 feet. This leaves a minimum of 25 feet with NO space between the road and the bleachers. Ken Baker, Planning and Development Services Director informed us that the road would be between 27 and 30 feet. Additional research is needed. • Lack of sufficient barrier space. Multiple trees have already been tagged to take down to install the bleachers. Additionally, mature trees that are not to be torn down to establish the parking lot will probably be lost. The root systems will be impacted by the new concrete. Additional research is needed. • Safety Concerns. Currently, many students walk to school via the homewners lots that border the proposed road. This is definitely a safety hazard for these kids. Additionally, the new bleachers will create more foot traffic in the area. It would seem that we would want to decrease traffic by the bleachers to ensure the safety of all students and spectators. • Safety Concerns. Exiting the parking lot on the proposed new road will require young drivers to go around a blind curve. Is this a situation that any of us want to put a teenage driver in and /or those walking to their cars? + Parking Concerns. The proposed parking is NOT going to result in additional parking. I understand we have parking issues at the High School, but we have not seen any long range plan to accommodate current parking issues as well as future needs as a result of growth on the North side of 1709. CISD has not developed a long term plan that is in the best interest of the CISD parents and students or tax paying homeowners. • Swing Gate Policy. I understand that the stated policy is to have the gates open only when students are arriving and departing from school. With the current budget cuts, I do not foresee this as a viable policy. Additionally, CISD has not shown that they can be counted on to follow thru with their plans. Example 1: The School promised to maintain the fences which border the school on the West side of the property. The fences are in poor shape and have not been replaced. Example 2: The detention pond on the southern part of the property was supposed to only collect water during heavy rains. It has been neglected and as a result has become silted and is a breeding ground for mosquitoes. The plants have not been cut back and the grass has not been maintained on the hillside. Example 3: The school has promised that all batting practices would end by 8pm. Currently, it continues past midnight on a regular basis. Example 4: The original agreement with CISD contained a 50 foot buffer (minutes and discussions). This has been broken on numerous occasions. As a homeowner, I do not believe the school has acted in Good Faith. • Traffic /Noise. Without a doubt at the beginning and end of the school day, we will have trouble with noise from idling cars, car doors, engine noise, stereos, student voices, etc. According to the City of Southlake, Chapter 11, Offenses and Miscellaneous provisions, the allowable noise level for residential properties during the daytime is 60dba. This refers to the immediate vicinity of the noise. Immediate Vicinity as defined in Chapter 11 is 100 feet. Currently, there have not been any additional ideas proposed to help solve the current parking issues and accommodate future growth. Home owners would like to see other options explored: parking on the NW corner, growth up instead of out (parking garage) or parking across the street on Peytonville Rd (commercial property for sale). Parking Garages can be made aesthetically appealing and the addition of a walkway over the Peytonville Rd. would ensure the safety of our students. Finally, I would like to address the decrease in Home Values as a result of the prosed project. Current homeowners will experience a minimum loss of 40k (10 %) as a result of having this project. During my time in Southlake elected officials have consistently ran on the platform of protecting home values for all residents. Using tax dollars to pay for projects which directly affect our property values definitely is in conflict to what each of you has voiced as part of your "platform ". Property values have not been affected based on current green space; however, research will support the negative impact a road at the proposed location will have on home values in Stone Lakes (Decrease would be more on a busier road such as 1709). The negative impact does not end with the properties that back up to the school property. Since comparables are used to value properties it will have a domino effect through Stone Lakes affecting up to 300 tax paying residential properties. Southlake elected officials have consistently ran on the platform of protecting home values for all residents. This project will definitely have a negative affect on our property values. Our property faces the high school to the north (pool facility) and to our west ((tennis courts). We feel that the addition of a roadway between our property and the tennis courts, combined with the additional proposed parking will greatly diminish our quiet enjoyment as well as the potential resale value of our property. Council has already approved the removal of 12 trees along the eastern edge of the tennis courts in order to accommodate bleachers. The estimated width of these bleachers is between 10 and 12 feet. This estimate is based on the width of the existing bleachers on the western edge of the tennis courts. The proposed road, which was never introduced in the 2009 Bond Package, would measure approximately 24 feet in width. If both the bleachers and road are installed, they would require a total of 34 -36 feet in width. The available width of the property is exactly 60 feet. This would mean that the eastern edge of the proposed road would come within 24 -26 feet of our property line. (maximum) This is significantly less than the 50 foot buffer negotiated in good faith 6 years ago. There would be no trees in the high school buffer since this minimal tract of 24 -26 will be utilized as drainage. The mature red -tips and various other trees on our side of the fence could be compromised as a result of all of these disturbances to their root systems. Furthermore, the current plan does nothing to address the issue of emptying the parking lot. Closing down the roadway in the service area in the morning and at dismissal will only re -route traffic to the proposed road. The additional parking between the tennis courts and baseball diamond will create even more traffic on this road. Because of poor exiting options from the school onto 1709 and Peytonville, this will create a bottle neck effect, with idling cars and their resulting exhaust and noise directly behind our home! The applicant was denied permission to proceed with this same proposal by city council 8 months ago. The Planning and Zoning Committee, at its most recent meeting unanimously voted against the road and additional parking. Instead of creating a new plan which would be appealing to both the school and the surrounding neighbors, the applicant has proposed the same plan. While we understand the importance of creating more parking for our students, we feel that this parking space could be found in other areas besides the current proposed site. There is ample room in the north west corner of the property. And, while safety and an efficient emptying of the parking lot at the end of the school day are important, we feel that there is no compelling evidence to show that the current plan would be any improvement on the current situation. With growth occurring on the north side of 1709 and the High School, the student population will continue to increase. The current recommendation is not a long term solution. Another viable option is a parking garage. These structures can be built so that they are aesthetically pleasing. In addition, CISD could work together with the city of Southlake to add extra exits onto Peytonville from the parking garage and/or current parking.
