13 SOUTHLAI<,.E CITY OF Department of Planning & Development Services STAFF REPORT May 11, 2011 CASE NO: SV11 -008 PROJECT: Variance to the Sign Ordinance for Dunkin' Donuts REQUEST: Landplan Engineering, on behalf of Dunkin' Brands Inc., is requesting variances to Sign Ordinance 704 as amended for maximum logo height, maximum letter height, maximum number of signs, maximum sign area for drive through signs, and to allow illuminated window signs for Dunkin' Donuts. Dunkin' Donuts will be located at 2255 West Southlake Blvd. in the Southlake Marketplace shopping center. The applicant is requesting signs on three sides of the building: the north elevation, east elevation, and west elevation. All three sides will have an identical DUNKIN' DONUTS" sign with a coffee cup logo that exceeds the maximum allowed logo size. The "DUNKIN' DONUTS" text exceeds the maximum allowed letter height on the east elevation only. In addition, all three sides of the building will have an awning sign that contains the letters "DD ". On the north and east elevation, the "DD" letters exceed the maximum allowed letter height. Further, the applicant is proposing a total of 12 signs and only 2 signs are allowed. The 12 signs include 5 signs on the north elevation, 3 signs on the east elevation, and 4 signs on the west elevation. The applicant is also proposing 2 illuminated window signs — 1 on the north elevation and 1 on the west elevation. With the exception of open /closed signs, illuminated window signs are not a permitted sign type. Finally, the applicant is proposing 2 attached drive through signs that exceed the maximum allowed sign area for this type of sign. Other variances approved for Southlake Marketplace October 4, 1994; Blockbuster Video was granted variances for letter height of 30 inches and sign area of 61.88 square feet for both the north and west facades. October 5, 2004; Highland Nails & Spa was granted an increase in allowable area from 15 square feet to 24 square feet. March 21, 2006; Ella Bella was granted an increase in allowable area from 12 square feet to 22 square feet. June 20, 2006; Taco House was granted an increase in allowable area from 13.37 square feet to 24.6 square feet. August 1, 2006; Wing Stop was granted an increase in allowable area from 14.25 square feet to 25.67 square feet. Case No. Attachment SV1 1-008 Page 2 Sign Variance Application That a literal enforcement of the sign regulation vviII create an unnecessary hardship or practical difficulty on the applicant. By the enforcement of the sign variance it will create an unnecessary hardship oil the proposed Dunkin' Donuts by not allowing the development to properlylabel and demonstrate the types of services available to the proposed patrons of the site. By allowing the proposed signage it will display and express to customers the type of service available at this particular location. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. Based on the subject property and the angle of the existing building, the building has three facades facing the street frontage. Therefore the situation is unique all should allow signage on the third (drive -thru facade) based on the existing site conditions. The existing site vegetation also proposes a hardship in the fact that it bufferslscreens parts of the existing building and only allows for quick visual glances of the building fagade. By providing additional signage throughout the building fapade it provides customers with the ability to view the fapade from different angles and recognize what the sites use Is as well as the services provided. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. The following proposed variance request will not harm or injure any potential customer or patron of the site. It in fact it will demonstrate beneficial services by telling the proposed fanlsupporter what they can expect at this Dunkin' Donuts location, That the variance will be in harmony with the spirit and purpose of the sign ordinance. The variances requested are to be in harmony with the spirit of the sign ordinance however the existing regulations and ordinances provide hardship for the proposed development by not allowing the development to properly demonstrate the services and uses provided at this particular location. The signs proposed along the Drive thru Facade face a street and should be allowed signage, the canopy signage is printed on the canopy and is not i'llumi'nated and fee/ it should be viewed as a canopy structure rather than an attached sign. By allowing the proposed variances the site will be able to properly demonstrate the services provided as well as function to its full potential. Case No. Attachment F SV11 -008 Page 1
