Item 4C13 SOUTHLAI<,,E CITY OF Department of Planning & Development Services STAFF REPORT May 11, 2011 CASE NO.: ZA08 -003 Preliminary Plat for Nolen Center ZA08 -028 Final Plat for Lot 1, Block 1 Nolen Center PROJECT: Variance to the Subdivision Ordinance No. 483, Section 4.01 I, "Expiration of Plats ", as amended, requesting to extend the validity of the Preliminary and Final Plats for Nolen Center REQUEST: On behalf of Loyalty Holdings, LP, Dusty Renfro is requesting approval of a variance to the Subdivision Ordinance No. 483, Section 4.01 I, "Expiration of Plats ", as amended, to extend to validity of the Preliminary and Final Plats for Nolen Center for a period of up to one year from the date of City Council's action on this request. The applicant was unaware that the plat had not been recorded and desires to properly record the final plat in the County Plat Records. Nolen Center is located at the southwest corner of E. Southlake Boulevard and S. Nolen Drive. A Preliminary Plat shall expire two years from the date of approval. A Preliminary Plat was approved by City Council on April 1, 2008 and expired on April 1, 2010 due to the final plat not having been recorded. A Final Plat that has not been recorded in the County Plat Records within one year of the date of approval shall expire. The Final Plat was approved by the Planning & Zoning Commission on May 8, 2008 and expired on May 8, 2009. The applicant is requesting to extend the validity of both the Preliminary Plat and Final Plat for one year from the date of City Council's action on this request. This would extend the validity of both plats until May 17, 2012. CURRENT ZONING: "S -P -1" Detailed Site Plan District & "AG" Agricultural District HISTORY: A Zoning Change and Site Plan (ZA08 -002) were approved by City Council on April 1, 2008. A Preliminary Plat (ZA08 -003) was approved by City Council on April 1, 2008. A Final Plat (ZA08 -028) was approved by Planning and Zoning Commission on May 8, 2008. STAFF COMMENTS: Attached is Plat Review Summary No. 1, dated April 25, 2008 STAFF COMMENTS: Subdivision Ordinance No. 483, Section 4.011 Expiration of Plats: 1. Preliminary Plat: A Preliminary Plat shall expire two years from the date of approval. Said expiration date shall be extended one year from the latest date of filing a Final Plat on a portion of said Preliminary Plat in the County Plat Records. 2. All other plats: A Final Plat, Plat Revision, Amended Plat or a Plat Showing which has not been recorded in the County Plat Records within one year of the date of approval shall expire. 3. Extensions: The City Council may extend the expiration date of an approved plat upon written petition for such extension by the owner prior to the expiration of the plat but not to exceed one (1) year. This extension will allow us to gather the necessary documentation and file the final plat. When the plats were origMly approved by council, we did not realize that we still needed to deliver the mylars and lax certificates to the city in order to officially file the final plat. Since then, our property has beet► sitting vacant. It has been and continues to be our desire to have the land properly platted should an opportunity arise.
