' Grantor herein, for and in consideration of the planting of trees by Grantee the City of Southlake, Texas, a home - rule municipal corporation of the County of Tarrant, State of Texas, as described below, the receipt and sufficiency of which is hereby acknowledge and confessed, do hereby grant, sell, and convey to the City of Southlake, its successors and assigns, a temporary landscape easement of 180 days duration for the purpose of allowing Grantee to plant up to three (3) live oak trees with a minimum 6" caliper trunks along the north property line adjacent to the Carroll Independent School Property located at 2520 N. White Chapel Blvd on the land in Tarrant County, Texas, described as follows, to -wit: A temporary 15' foot Wide Landscape Easement more particularly described in Exhibit "A" attached hereto. Together with the right of ingress and egress as necessary to plant the trees described. After the initial planting of the trees by the Grantee, Grantor shall be responsible for and agrees to perform all maintenance necessary to keep the trees in a healthy and living condition. The Grantor does hereby agree to indemnify and hold harmless the City of Southlake from any and all damages, loss or liability of any kind whatsoever by reason of injury to property or third person as a result of accessing the property for the purposes of planting of the trees or from trees that have been planted.
