2011-03-28 Meeting Report (Assisted Living Facilities) SPIN MEETING REPORT CASE NO. Ordinance No. 480-GGGG PROJECT NAME: Revisions to Zoning Ordinance No. 480 regarding Assisted Living Facilities. SPIN DISTRICT: Citywide MEETING DATE: March 28, 2011; 6 PM MEETING LOCATION: 1400 Main Street, Southlake, TX Training Rooms 3A 3B TOTAL ATTENDANCE: Six (6) SPIN REPRESENTATIVE(S) PRESENT: APPLICANT(S) PRESENTING: City Staff Clayton Comstock, Planner II OTHER STAFF PRESENT: Jennifer Crosby, Planner II STAFF CONTACT: Clayton Comstock, Planner II, (817)748-8269; ccomstock@ci.southlake.tx.us EXECUTIVE SUMMARY amendment that addresses certain aspects of Assisted Living Facilities, previously referred to as Personal Care Facilities. To that end, staff has proposed an ordinance that requires more amenities than previously required, such as a library, computer/internet access, basic housing services, etc. Development regulations are also being addressed with this amendment. QUESTIONS / CONCERNS Is there any reason to limit the ancillary uses to only those that are listed/proposed? The list proposed to be provided in the ordinance is not all- Î language that leaves it open-ended. If there are other examples that should be included on the list, staff is open to recommendations. If the square footages of the rooms are within industry standards, why are they being increased? Before any research on the topic of room sizes had been completed, the Î question was asked of staff to look into the size of the rooms. This is something that may not be changed in the proposed ordinance. Where might these facilities be located? They can go in any non- Î looking at the Specific Use Permit (SUP) section as minimum standards/guide. With memory care, safety is an issue. The necessarily have to be close to shopping. Do you have age demographics specific to Southlake? Not for this presentation. Î Changing demographics in Southlake will make this a more needed type of facility. Do we have transit offered for seniors? -A- Î vehicle for use, but there are no city buses. Regulations proposed for Mother-in-Law Suites? Will existing suites have to change? Will new suites be required different standards? No revised regulations for those types of dwellings at this time. Î They will probably be more popular in the future with the aging of the community. Has Southlake been approving Mother-In-Law Suites? Approval of a Mother-In-Law suite on a residential property is currently Î processed as a Special Exception Use Permit (SEU) through the Zoning Board of Adjustment (ZBA). They have approved some in the past few years. Is there a way to allow more flexibility for Mother-in-Law Suites? Other communities allow these types of units as a permitted accessory use, just Î like any other accessory building on a residential lot. A change like this, however, would likely require a separate discussion. Is there a minimum/maximum size requirement for Mother-In-Law Suites? Servants or family quarters Î for domestic servants employed on the premises or family members of the owner of the premises shall not be rented or otherwise used as a separate domicile provided the gross inhabitable square footage of the floor area shall not exceed two thousand (2,000) square feet except that the gross inhabitable floor area in SF-30 zoning shall not exceed one thousand (1,000) square feet. Such quarters may be housed within the principal residential dwelling, above a residential garage, or be part of an accessory building on the same premises, and shall comply with minimum standards for light, health, safety and occupancy in conformance with other applicable City Codes and Ordinances. If the quarters exist as a separate accessory building to the principal dwelling, such quarters must be located at a distance of at least thirty (30) feet behind the principal dwelling, or not be visible from the street; in addition, such quarters must share a common street access with the principal dwelling. All utilities must be on the same meter as the principal dwelling. A separate septic system from the principal dwelling is required if the quarters are housed other than in the principal dwelling. We will see an increased need for ambulance services as the community ages. One assisted living facility was proposed close to Town Square and was highly contested. The location requirements listed in the SUP section are very confusing. There are no sites in Southlake that meet all location requirements. Has staff toured any memory care units? at Southlake, Watermere at Mansfield, and The Carlyle at Î Stonebridge Park in Southlake. smaller yards. There is a huge gap between the existing single-family residential homes in Southlake and Assisted Living that is not being addressed. Impervious coverage is disliked, but these facilities need reasonable parking. The ones provided. These facilities typically have resident parking segregated from visitor parking. Often gh parking overall but not enough for visitors. Southlake needs to do a better job educating residents on the demographics.
