Southlake Boulevard, Suite D. Action Requested: City Council consideration of a variance to Sign Ordinance 704 -A. Background information: Angelo do Vito's Pizzeria is a retail business located at 2120 F. Southlake Boulevard, Suite D. Angelo &Vito's Pizzeria is requesting a variance to install a sign as shown on the attached plans. This would vary the following sections of Sign Ordinance No. 704 -A. • Section 16.Ai ATTACHED SION • A3. MA-XIMLJM AREA: The sign has a total area of 23.5 square feet. The maximum allowed area for an attached sign is .75 square feet for every one foot of width of building or lease space not to exceed 400 square feet. The stare front width at this location is 26 feet, therefore the maximum allowed area would be 19.5 square feet_ Staff Note: The applicant has two elements of consideration. They are approximately 400 feet from the roadway and they have only 26' of store frontage. This allows for 42" letters, but limits the area to 19.5 sq. ft. Based on the former sign ordinance, the previous tenant had a 45 square foot sign using 36" letters. In order to meet area limitations imposed by the current ordinance, the letter size must be reduced so small that is not legible at that distance from the roadway. Compliance with the letter height creates a sign with greater area than allowed. Compliance with the area limitations creates a sign with letters too small to read at the distance &am. the roadway. Applicant is therefore seeking to use 17" letters (less than half the allowable size) which allows visibility, but exceeds area limits by four square feet. The proposed sign is similar to the preceding tenant's sign and is consistent with the adjoining properties. Financial Considerations: Not Applicable Citizen input/ Board Review: No citizen input has been received. Not subject to any Board review. Legal Review: None Alternatives: The council may approve the request, deny the request, or approve it subject to whatever conditions they deem appropriate. Place the variance request on the February 12, 2002 City Council meeting agenda for disposition. kBIsv The following sections have been excerpted from the Sign Ordinance No. 704-A SEC. 14 VARIANCES I'he City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. In granting any variance, the City Council shall determine that a Iiteral enforcement of the sign regulations will create an unnecessary hardship or a practical difficulty on the applicant, that the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self - imposed, that the variance will not injure and will be wholly compatible wilh the use and permitted development of adjacent propt.-rties, and that the granting of the variance will he in harmony with the spirit and purpose of this sigm ordinance. A person may request a variance from the Sign Ordinance by filing the request with the Building Official. Any request for variance shall be accompanied by a completed application and a non - refundable fling fee in the amount specified in the current fee schedule adopted by City Council. SF•.C. 16 PER MITTED SIGN STR AND GMERAL REGULATION AI'f SIGN GENERAL.: Unless otherwise specifically provided, the regulations set forth in this subsection shall be applicable to all attached signs which are allowed under this ordinance. Signs may not he attached to light fixtures, poles, curbs, sidewalks, gutters, streets, utility poles, public buildings, fences, railings, public telephone poles, or trees. Completed sign variance request application. Completed demonstration of conditions applicable to the requested variance (see attached.) . Site plan showing the location of the sign variance request and any other signs that conform to or are exempt from the sign ordinance. The site plan shall also indicate the building, landscaped areas, parking & approaches and adjoining street R. 0. W. Scaled and dimensioned elevations of the signs for which the variance is requested. For attached signs, the elevations shall show the building, the sign for which the variance is requested, and any other signs that conform to or are exempt from the sign ordinance. Demonstration Please demonstrate that the following conditions are applicable to the requested sign variance: That a literal enforcement of the sign regulation will crate an unnecessary hardship or practical difficulty on the applicant Current code will require that the. sign be built so small that it will of little or no value from a readership stand- point. Also, when logo is sized down to City code standards, part of the lettering will be less that b" high which is also out of code. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. The distance of the property from the street makes this sign ineffective and verb difficult to read if manufactured as required by current code. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. Current adjacent businesses now have signage that exceeds the current code_ Therefore, the proposed sign will be compatiable with these adjacent properties within the shopping center. That the variance will be in harmony with the spirit and purpose ofthe sign ordinance. The proposed sign is equal to or smaller than the sign previously located at this same lease space. Also, the existing fascia is much higher making the proposed sign aesthetically pleasing and less intruslivc because it takes up proportionally less space.
