EXECUTIVE
SUMMARY: Performance Bicycle is requesting approval of a specific use permit for the use
of a tent for the purposes of promoting retail sales at their retail location in
Gateway Plaza located at 3001 E. State Highway 114. SPIN # 8
REQUEST
DETAILS: Performance Bicycle is requesting approval of a specific use permit to Section
45.1(41) of the Zoning Ordinance for the use of a tent for the purposes of
promoting retail sales within a parking lot on the north side of Gateway Plaza.
Some of the details of the event are listed below:
• April 28 — May 1, 2011;
• One (1) Tent (under Attachment C)
• Occupies 6 parking spaces
• Tent sale hours: 10am -7pm Thursday, Friday & Saturday; 11 am- 6pm

HISTORY: This will be the first year this event is being held for this business.
PLANNING & ZONING
COMMISSION: April 7, 2011; Approved (7 -0) subject to the details outlined in the staff
report and as presented this evening.
STAFF COMMENTS: The applicant will comply with the requirements of Section 45 of the
Zoning Ordinance consisting of the following requirements unless
otherwise noted in this report:
• Tents for the purpose of promoting retail sales for a period not
exceeding twenty -three (23) days;
• Tents shall be constructed in accordance with the provisions of the
Uniform Fire Code, Article 32, as amended;
• A permit may be issued for a tent only as an accessory use;
• The activity shall also meet the development regulations of the
zoning district in which it is located;
• No more than two specific use permits for tents for a lot may be
issued in any one year period, with a sixty (60) day separation
between events;
• The location of the tent shall not reduce the minimum parking
requirements or effectiveness of landscaped areas within the site

report.
Due to the limited nature of the request, no review summary has been
prepared for this request. The applicant however will need to comply
with the details outlined in this report.

To Whom It May Concern,
Performance Bicycle is seeking a specific use permit from the city of Southlake, TX. We
would like to erect a canopy tent outside of our Performance Bicycle store located at
Gateway Plaza, 2915 East State Highway 114. The purpose of the tent will be for a retail
store tent sale, which will be held 4/28- 5/1. We are holding the tent sale to celebrate the
Grand Opening of our newest retail location in Southlake, TX. We will be holding tent sales
at our three other store locations throughout the Dallas /Ft. Worth area.
Performance Bicycle has received approval to erect a tent at 2915 East State Highway 114
by the property owner representative, Tim Stinneford. The tent we will be using for the
tent sale is a 20'x 10' blue canopy tent. It will beset up in the parking lot adjacent to the
retail store location.

RESOLUTION NO. 11 -020
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT
FOR A TENT FOR THE PURPOSE OF PROMOTING RETAIL
SALES ON PROPERTY WITHIN THE CITY OF SOUTHLAKE,
TEXAS, LOCATED AT 3001 E. STATE HIGHWAY 114, BEING
DESCRIBED AS LOT 3, BLOCK 1, GATEWAY PLAZA
ADDITION, MORE FULLY AND COMPLETELY DESCRIBED IN
EXHIBIT "A ", AND AS DEPICTED ON THE APPROVED SITE
EXHIBIT ATTACHED HERETO AND INCORPORATED HEREIN
AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, a Specific Use Permit for a tent for the purpose of promoting retail sales
has been requested by a person or corporation having a proprietary interest in the property
zoned as "S -P -2" Generalized Site Plan District; and,
WHEREAS, in accordance with the requirements of Section 45.1 (41) of the City's
Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City
Council have given the requisite notices by publication and otherwise, and have afforded the
persons interested and situated in the affected area and in the vicinity thereof; and,
WHEREAS, the City Council does hereby find and determine that the granting of such
Specific Use Permit is in the best interest of the public health, safety, morals and general
welfare of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION 1.
A Specific Use Permit is hereby granted for a tent for the purpose of promoting retail
sales on the property located at 3001 E. State Highway 114, being described as a Lot 3,
Block 1, Gateway Plaza Addition, an addition to the City of Southlake, Tarrant County, Texas,
according to the plat recorded in Cabinet `A', Slide 5366, Plat Records, Tarrant County,
Texas, more fully and completely described in Exhibit "A ", and as depicted on the approved

Site Exhibit attached hereto and incorporated herein as Exhibit "B" and providing an effective
date, subject to the provisions contained in the comprehensive zoning ordinance and the
restrictions set forth herein. The following specific requirements and special conditions shall
be applicable to the granting of this Specific Use Permit:

SECTION 2.
This resolution shall become effective on the date of approval by the City Council.
