The requested action is to approve a right of way and utility easement
encroachment and joint use agreement with Carroll Independent School District on
Lot 1 R, Block 1 R, of the Carroll High School Addition and waive any and all fee
related to the encroachment agreement.

Background Information
• Carroll Senior High parking lot and chain
link fence encroaches into existing right
of way today
• Verizon and TO County utilities currently
exist within right of way
• Right of way cannot be abandoned by
City
• Encroachment and joint use agreement
requires concurrence of franchise utilities
Currently the parking lot and the chain link fence on the west side of the senior high
encroaches into the cities right of way. All franchise utilities were contacted to
inquire what facilities if any were located within this area to determine if the right of
way could be abandoned. Verizon and Tri County do have underground utilities
exiting within this proposed encroachment area and the right of way cannot be
abandoned and therefore requires and encroachment and joint use agreement
between the school district and the city.

The proposed encroachment agreement links to the city's strategy map relative to
