ACTION NEEDED: Consider variance request. ATTACHMENTS: (A) Background Information (B) Vicinity Map (C) Building Elevation & Sign Detail (D) Site Plan (E) Sign Variance Application STAFF CONTACT: Dennis Killough (481 -2073) Bruce Payne (481 -2036) Case No. SP 03 -084 BACKGROUND INFORMATION OWNER: St. Ives Realty APPLICANT: Southwest Signs (Gregory Burkett) PROPERTY SITUATION: Cornerstone Plaza is a development currently under construction located on the south side of East Southlake Boulevard east of Nolen Drive between Ultimate Electronics and Snookies. The property address is 2557 East Southlake Boulevard. REQUEST: The applicant is proposing a monument sign on East Southlake Boulevard on the west side of the entry drive. They are requesting that the sign height and area exceed the maximum permitted. They are also asking that the sign text and /or logos be allowed less than 6 inches from the outer edge of the sign. Approval of variance is required in order to receive a sign permit. STAFF COMMENTS: The sign plan, building elevation, site plan and variance applications are attached to this report. The following variances to the Sign Ordinance No. 704 -A are requested: • Ord. 704 -A, Section 16.13.3 maximum height: The maximum height shall be four (4) feet, excluding the monument base and the sign structure. The sign structure shall not exceed five (5) feet. The height of the proposed sign and sign structure is 8 feet 7 inches. • Ord. 704 -A, Section 16.13.4 maximum area: The maximum area allowed shall be one hundred (100) square feet per sign with a maximum area per sign face of fifty (50) square feet. The maximum area for the sign structure shall not exceed seventy (70) square feet. The square footage of the proposed sign and sign structure is approximately 125 square feet per sign face. • Ord. 704 -A, Section 16.13.7 material requirements: All sign text and graphic elements shall be limited to a minimum of six (6) inches from the outer limits of the sign structure. The sign text and graphic material is proposed to be approximately 3 inches from the outer limits of the sign structure. The City Council may authorize variances in accordance with the following provision of the Sign Ordinance No. 704 -A, Section 14, Variances: The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or Case No. Attachment A SP 03 -084 Page 1 setback of signs, or any other aspect involved in the sign permitting process. In granting any variance, the City Council shall determine that a literal enforcement of the sign regulations will create an unnecessary hardship or a practical difficulty on the applicant, that the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self - imposed, that the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties, and that the granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. A person may request a variance from the Sign Ordinance by filing the request with the Building Official. Any request for variance shall be accompanied by a completed application and a non - refundable filing fee in the amount specified in the current fee schedule adopted by City Council. Comments to answer questions for variance application 1). Unnecessary hardship or practical difficulty on the applicant — The code allows for 1 sign per 500' -0" of frontage and 50 square feet of total signage. This severely limits the possibility to allow the tenants any street frontage signage for this particular location. The property will have a minimum of 12 individual tenants located in three separate buildings the code allowance for a total of 50 square feet will allow for a total of 4.16 square feet of signage per tenant. The code requires a text and graphic size requirement of a minimum of 6" per sign face tenant copy. This will be impossible to meet this minimum 6" tall letters per tenant with only 4.16 square feet of tenant copy space. The property has a total of 410' -0" of frontage which by code they would not meet the minimum spacing requirements for an additional monument sign for tenants. All of the maximum allowances will not allow for adequate signage this property which will have as noted a minimum of 12 tenants with approximately 29000 square feet of tenant space. 2). Uniqueness of the situation and hardship not self imposed — The property is a unique situation with three separate buildings and many individual tenants all requiring some form of advertising to the traffic on E. Southlake Blvd. If this variance is not granted only 5 tenants to be allowed signage on a monument sign. Many of these tenants are small business that rely signage advertising to reach customers. 3). Injury to adjacent properties- The request size and location of the sign will not inhibit any visibility to adjacent property or injure in any way the surrounding properties. The sign placement will be approximately 180' -0" from the property to the West and 230' -0" from the East property. This is more then enough distance to not cause any visibility issues or injury to surrounding properties. 4). Spirit of the ordinance Yes, the sign will in design still meet the intended architectural features outlined in the ordinance. The main deviation will be the height of the monument and over all square footage needed to accommodate adequate signage for the tenants. Case No. SP 03 -084 Attachment E Page 1
