HISTORY: -A final plat for Brumlow Industrial District, Phase 1 was approved by the
City on May 1, 1979.
-A change of zoning from `I -1' to `I -2' was approved for Tract 1, Brumlow
Industrial District, Phase 1 on December 5, 1989.
-A change of zoning from `AG' to `I -1' was approved for the proposed
Mustang Business Park on April 16, 2002.

Although the subdivision ordinance requires general utility easements along the perimeter boundary of
the site where adjoining easement do not already exist, staff recommends that easement be located
only where needed for public or franchise utilities and that they be located in a manner that best
benefits tree preservation on the site.
INFORMATIONAL COMMENTS
A Developers Agreement is required prior to construction or acceptance of any public infrastructure.
The Developer's Agreement for this addition should consider streets, drainage, park dedication
requirements and fees, off -site sewer extensions, off -site drainage and utility easements and impact
fees. Any unresolved environmental issues regarding the existing roadway proposed for dedication
must be resolved prior to final plat approval.

THIS ANALYSIS IS PREPARED AT THE TIME OF REVIEW OF THE ABOVE REFERENCED
PROJECT AND IS TO PROVIDE AN ANALYSIS OF THE PLAN OR SURVEY AND THE IMPACT OF
CONSTRUCTION ON ANY PROTECTED TREES ON THE SITE. FOR ANY QUESTIONS OR

TREE PRESERVATION COMMENTS:
The required tree survey was deferred from submittal until a development Site Plan is submitted for
formal review. A Concept Plan for the Development was approved in April 2001.
2. The proposed R.O.W. of Mustang Dr. cuts through the north portion of a stand of existing trees and
the utility easements flow through what is the proposed access drives and parking lots as shown on
the Preliminary Utility Plan. There is also 110' Drainage Easement /Channel proposed along the west
property boundary. The construction of this channel would cause for the removal of any or all of the
trees within its area.
Non - residential Development: In a non - residential development, all protected trees that the
Landscape Administrator determines must be altered in order to install utility lines within public
R.O.W. or public utility or drainage easements as shown on an approved Final Plat, or to install fire
lanes, required parking areas and building pad sites as shown on an approved Site Plan, shall be
exempt from the tree protection and tree replacement requirements listed in Sections 7 and 8 of the
Tree Preservation Ordinance. Any protected trees within these areas that the Landscape
Administrator determines do not have to be altered shall be subject to the tree protection
requirements listed in Section 8 of the Tree Protection Ordinance, but not to the tree replacement
requirements listed in Section 7 of the Tree Protection Ordinance. All other areas of the development
shall be subject to both the tree replacement and the tree protection requirements, and all other
provisions of the Tree Protection Ordinance.
