APPLICANT: D-H Retail Space, Inc. PROPERTY SITUATION: Drexel Heritage Furniture is a retail store desiring to locate at the old Roomstore location on the north side of East Southlake Boulevard approximately 400 feet west of North Village Center Drive. The property address is 1600 East Southlake Boulevard. PURPOSE: The proposed signs on the south façade and the east façade contain a logo and lettering with a height greater than the permitted height of 12 inches. Also, the signs are limited in width to 75 percent of the façade in which they are to be placed. The sign widths are larger than permitted. Approval of a variance is required before a sign permit can be issued. STAFF COMMENTS: The sign plan, building elevation, site plan and variance application are attached to this report. The following variances to the Sign Ordinance No. 704-A are requested: South Façade 1. Ord. 704-A, Section 16.A.2 minimum/maximum letter/logo height: The maximum height allowed for letters and logos less than 100 feet from the ROW is 12 inches. The proposed height of the logo is 68 inches. The proposed height of the lettering is 36 inches. 2. Ord. 704-A, Section 16.A.2 sign width: Attached signs shall be limited in width to the middle seventy five (75) percent of the width of any building or lease space. In the event the lease space façade is horizontally articulated, the 75 percent rule shall apply to the allowed sign to be located on any single plan façade. The façade length on which the sign is to be located is approximately 51 feet. The maximum permitted sign width is approximately 38 feet. The proposed sign is 41 feet in length. East Façade 1. Ord. 704-A, Section 16.A.2 minimum/maximum letter/logo height: The maximum height allowed for letters and logos less than 100 feet from the ROW is 12 inches. Case No. Attachment A SP 03-046Page 1 The proposed height of the logo is 38.5 inches. The proposed height of the lettering is 16 inches. 2. Ord. 704-A, Section 16.A.2 sign width: Attached signs shall be limited in width to the middle seventy five (75) percent of the width of any building or lease space. In the event the lease space façade is horizontally articulated, the 75 percent rule shall apply to the allowed sign to be located on any single plan façade. The façade length on which the sign is to be located is approximately 28 feet. The maximum permitted sign width is approximately 21 feet. The proposed sign is 23 feet – 4 inches in length. The City Council may authorize variances in accordance with the following provision of the Sign Ordinance No. 704-A, Section 14, Variances: The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. In granting any variance, the City Council shall determine that a literal enforcement of the sign regulations will create an unnecessary hardship or a practical difficulty on the applicant, that the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self-imposed, that the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties, and that the granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. A person may request a variance from the Sign Ordinance by filing the request with the Building Official. Any request for variance shall be accompanied by a completed application and a non-refundable filing fee in the amount specified in the current fee schedule adopted by City Council.
