BACKGROUND INFORMATION
OWNER: Wilbow Corporation
APPLICANT: Greg Gitcho
PROPERTY SITUATION: Vermilion Addition is a 16 lot subdivision located on the north side of West
Southlake Boulevard and approximately 400 feet west of West Jellico Circle.
The property address is 2840 West Southlake Boulevard.
PURPOSE: The owner wants to place a street identification sign on the northeast corner
at the intersection of Vermilion Court and West Southlake Boulevard. This
sign type is not defined in the sign ordinance. Review of the sign has been
performed against the regulations for ground signs. Approval of a variance is
required in order to receive a building permit for this sign.
STAFF COMMENTS: The sign plan, sign elevation, plot plan and variance application are attached
to this report. The following variances to the Sign Ordinance No. 704-A are
requested:
1. Sign type not defined: Street signs are not defined in the sign
ordinance. Staff has reviewed the proposed sign under the ground sign
regulations.
Per ground sign regulations:
2. Ord. 704-A, SECTION 16.C.2 MINIMUM SETBACK: The minimum
setback shall be fifteen (15) feet from any property line.
The proposed sign will be the located adjacent to the property line.
3. Ord 704-A, SECTION 16.C.3 MAXIMUM HEIGHT: The maximum
height shall be three (3) feet.
The proposed sign has a height of 11 feet.
4. Ord 704-A, SECTION 16.C.3 MAXIMUM AREA: The maximum
area is eight (8) square feet with a maximum of four (4) square feet per sign
face.
The proposed sign has an area of 8 square feet per sign face for a total of 16
square feet.

The City Council may authorize variances in accordance with the following
provision of the Sign Ordinance No. 704-A, Section 14, Variances:
The City Council may authorize variances to any restriction set forth in
this ordinance, including but not limited to the number, type, area, height, or
setback of signs, or any other aspect involved in the sign permitting process.
In granting any variance, the City Council shall determine that a literal
enforcement of the sign regulations will create an unnecessary hardship or a
practical difficulty on the applicant, that the situation causing the unnecessary
hardship or practical difficulty is unique to the affected property and is not
self-imposed, that the variance will not injure and will be wholly compatible
with the use and permitted development of adjacent properties, and that the
granting of the variance will be in harmony with the spirit and purpose of this
sign ordinance. A person may request a variance from the Sign Ordinance by
filing the request with the Building Official. Any request for variance shall be
accompanied by a completed application and a non-refundable filing fee in the
amount specified in the current fee schedule adopted by City Council.
