Ralph Evans; Councilmembers: Carolyn Morris, Keith Shankland, Greg Standerfer and Tom Stephen. CITY COUNCIL ABSENT: DeputyMayor Pro Tem Rex Potter. Agenda Item No. 1, Call to order. The meeting was called to order by Mayor Wambsganss at 5:47 p.m. Agenda Item No. 2, Executive Session. There was no Executive Session held. Agenda Item No. 3, Authorize the City Manager to enter into a contract with Philadelphia Suburban to provide retail water sales to Indian Creek and Lakewood Ridge. On August 22, 2003, the Texas Commission on Environmental Quality (TCEQ) considered a request by the Lakewood Ridge and the Indian Creek Estates residents to provide water service to those subdivisions by an emergency order under Chapter 13.041 (d)(2) of the Texas Water Code. The emergency order was considered to those subdivisions by the Commission due to lack of adequate supply of water. The Commission denied the request for an emergency order for water service by Southlake because of concern that this case may set precedence and encourage a flood of complaints from unhappy customers throughout the state of Texas. The TCEQ staff facilitated negotiations between Southlake and AquaSource during a six hour meeting until an agreement was signed on behalf of the City Manager. The agreement in short incorporates the following items: Southlake will provide temporary, retail service to Lakewood Ridge and the Indian Creek Estates subdivisions until January 31, 2004; service will be provided through AquaSource’s distribution pipe lines; Southlake will pay AquaSource a rental fee of $459 per month for use of distribution system; AquaSource will maintain the distribution system and will not bill residents; and AquaSource will pay for maximum day and maximum hour peaking charges exceeding the highest recorded amount in 2002-2003. Motion was made to approve a contract with AquaSource, Texas, to provide retail water sales to Indian Creek and Lakewood Ridge dated August 22, 2003.
