Chivers No. 350 Addition REQUEST: Martin Schelling is requesting a variance to the Subdivision Ordinance No. 483, Section 3.03.D.22, as amended, requiring dedication of general utility easements along the perimeter boundary of subdivision plats. White Chapel Boulevard, approximately 300' south of sweet street. PURPOSE: The applicant is planning to build a new home on the property and is required to plat prior to issuance of a building permit. The Subdivision Ordinance requires dedication of general utility easements along the perimeter boundary where a 10' easement on the adjacent property has no already been dedicated. LEGAL DESCRIPTION: Tracts 1G1 and 1E2, J.W. Chivers Abstract No. 350 LAND USE CATEGORY: Low Density Residential CURRENT ZONING: "AG" Agricultural District PROPOSED ZONING: "AG" Agricultural District HISTORY: There is no development history on the property. STAFF COMMENTS: The single lot Plat Showing was approved by the City Staff subject to the conditions of the attached Plat Review Summary No. 1 Dated January 6, 2003. There are no significant issues on the Plat Review and the applicant has agreed to comply with all conditions of that review with the exception of Comment No. 10b requiring dedication of utility easements along the perimeter boundary of the property. The City has no specific need for Utility Easements through this property and since this is to remain a single tract, there are no new lots requiring the extension of utility services. If other adjoining tracts are further subdivided, the required utility easements can be provided as part of their subdivision plat. The applicant has contacted the applicable franchise utility companies and has addressed service needs to his property. Provide a vicinity /location map. 3. Revise the title block as follows: a) Correct the title to read: `Lot 3, Joel W. Chivers No. 350 Addition'. b) Provide the courthouse filing note as follows and place near the title block: "Filed in Cabinet , Slide , Date " 4. Provide the standard approval block on the plat per appendix 9. 5. Correct the discrepancies between the legal description and the label for call #1 and #5. The distances for both calls do not match. 6. Add a lienholder statement and signature block with notary to the plat. If there is /are no lienholder(s) then add a statement to this effect. The standard language for these statements is attached. 7. Provide the "Avigation Easement and Release" per Appendix 3 on the face of the plat. This must be executed by all owners prior to filing this plat in the County records. 8. Label the lot number and the net acreage on the proposed lot. 9. The following changes are needed regarding property within 200' a) Clearly show and label the property lines, lot & block numbers, existing easements, and subdivision name and plat /deed record for all properties within 200 feet of this property. The label for SweetAddition is missing. Show the property boundaries for the WoodallAddition. Case No. Attachment D ZA02 -122 Page 1 Show the property boundary for the other Schelling tract. Show Kirwood Hollow subdivision (north of Stanford Place) within 200'. b) Show and label the existing R.O.W. with dimensions for N. White Chapel. Dimension the right -of -way from property corners to the centerline and across the full width of N. White Chapel. 10. The following changes are needed with regard to easements: a) Provide dimensional ties along lot lines to all easements. Provide centerline dimensions and bearings on any easements crossing areas if deflections occur. The TP&L easement must be tied down. b) Provide utility easements along the perimeter boundary of the property as follows: Where adjacent property is unplatted or platted showing a 5' U.E., provide a 5' U.E. along the property line; Where adjacent property is platted and no utility easement has been dedicated, provide a minimum 10' UE. (Ord No. 483, Section 3.03.D.22, Variance Requested) INFORMATIONAL COMMENTS * The thoroughfare plan indicates a 70' R.O.W. for the section of N. White Chapel Blvd to which the property fronts. * It appears this property lies within the 65 LDN D/FW Regional Airport Overlay Zone, requiring construction standards in compliance with the Airport Compatible Land Use Zoning Ordinance No. 479. * The applicant should be aware that approval of a single -lot plat showing is conditional to the stipulations of this Plat Review. No further submittals are required prior to those to be recorded. * Please submit a revised blueline "check print" prior to submitting blackline mylars with original signatures. * A "Certificate of Taxes Paid" indicating that there are no delinquent taxes owed on the subject property from each taxing authority must be provided to the City prior to filing this plat in the County records. A copy of this information may be obtained from the Tarrant county Tax Assessor /Collector's Office located at 100 E. Weatherford St. in Ft. Worth (across from the old red courthouse). There is a service charge of $10 per account for this certificate.
