Item 8CCity of Southlake, Texas
MEMORANDUM
TO: Billy Campbell, City Manager
FROM: Sharen Elam, Director of Finance Ext. 1713
SUBJECT: Ordinance No. 842, 1 st Reading, finding, after reasonable notice and hearing, that
TXU Gas distribution's rates and charges within the city should be changed;
determining just and reasonable rates; adopting general service rates including
rate adjustment provisions and miscellaneous service charges to be charged for
sales and transportation of natural gas to residential, commercial and industrial
customers; providing for recovery of rate case expenses; preserving regulatory
rights of the city; providing for repeal of conflicting ordinances; providing for an
effective date
Action Requested: Approve Ordinance No. 842.
Background
Information: On March 1, 2002, TXU Gas Distribution Company filed a Statement of Intent
with 111 cities to increase the rates charged for natural gas service with an
effective date of April 5, 2002. On April 1, 2002, City Council approved
Resolution No. 02 -023 to suspend the effective date of the proposed new rates
for 90 days to evaluate the reasonableness of existing rates and the merits of
TXU' S proposed changes. The City participated with other municipalities (51
cities) in a comprehensive review of TXU Gas Distribution's application. The
consultants and counsel retained by the coalition of cities recommended denial
of the Company's application based upon a report from consultants
demonstrating that the revenue requirement of the North Texas Metroplex
Distribution System is being met under current rates. Also, the Gas Utilities
Regulatory Act provides that costs incurred by Cities in ratemaking activities
are to be reimbursed by the regulated utility. On June 18, 2002, approved
Resolution 02 -042 to formally deny TXU's application for a rate increase and
requested prompt reimbursement of all rate case expenses.
Ordinance No. 842 represents the settlement terms and conditions for
resolution of TXU Distribution Gas Rate Case (GUD No. 9313). The
consultants and counsel retained by the coalition of cities recommended for all
cities to approve the Agreement in Principle (Ordinance No. 842). The
understanding with TXU is that it is "all or nothing ", and thus, there is no risk
that a city can potentially hold out for a better deal. The following outlines the
benefits of the Agreement in Principle reached with TXU to settle the rate
case:
• The actions of the 51 cities will have saved their residents
approximately $4.0 million between July and December in comparison
to cities that settled with TXU last summer.
Billy Campbell, City Manager
March 31, 2011
Page 2
• The Agreement in Principle to settle for a $7.5 million increase spread
to the 51 cities is less than any settlement offer extended by the Cities
to TXU last summer. TXU rejected all offers below $12 million.
• The Agreement reflects 30% of TXU's request. The Metroplex Cities
that agreed to settle with TXU last summer for the equivalent of Fort
Worth rates accepted 37% of the request. Dallas accepted 35.6% of
TXU's request.
• Residential customers in the 51 cities will pay about .80 cents a month
less than the residential customers in cities that accepted TXU's
settlement offer last June.
A schedule providing percentage changes in rates for each class of customers
in each of the 51 cities is attached. The new rates will become effective on
bills rendered after February 1, 2003.
Financial
Considerations: City of Arlington paid the Cities' rate case expenses for Lone Star related
funds. TXU will reimburse Arlington for all of cities' rate case expense.
Southlake did have any out -of- pocket expenses related to the rate case.

9006 Charge for Installing and Maintaining
an Excess Flow Valve (Residential)
A customer may request the installation of an excess flow valve on a new service line or on a
service line being replaced provided that the service line will serve a single residence and operate
continuously throughout the year at a pressure of not less than 10 psig. The customer will pay the
actual cost incurred to install the excess flow valve. That cost will include the cost of the excess
flow valve, the labor cost required to install the excess flow valve, and other associated costs. The
estimated total cost to install an excess flow valve is $50.00. This cost is based on installing the
excess flow valve at the same time a service line is installed or replaced. The excess flow valve
will be installed on the service line upstream of the customer's meter and as near as practical to
the main.
A customer requiring maintenance, repair, or replacement of an excess flow valve will be required
to pay the actual cost of locating and repairing or replacing the excess flow valve. The cost to
perform this service will normally range from $200.00 to $2,000.00, depending on the amount of
work required. This cost will be determined on an individual project basis.
This tariff is being filed in accordance with the U.S. Department of Transportation rule requiring
the installation of an excess flow valve, if requested by a customer, on new or replaced service

sere a single residence. The rule further states that the customer will bear all costs of installing
and maintaining the excess flow valve.

provided for the stand -by generators will be billed at the applicable commercial rate.
