REQUEST: On behalf of Greenway - 1709 /Eleven Partners II, L.P., Car Toys, Inc. is requesting
approval of a specific use permit to allow the sales of tires, batteries, and automobile
accessories in accordance with Corridor Overlay regulations. The applicant has

BACKGROUND INFORMATION
OWNER: Greenway- 1709/Eleven Partners II, L.P.
APPLICANT: Car Toys, Inc.
PURPOSE: The purpose of this request is to receive approval of a Specific Use Permit for
`automobile accessory sales' as required by the Corridor Overlay Zone
(Section 43.6).
PROPERTY SITUATION: The property is located at 2171 E. Southlake Boulevard
LEGAL DESCRIPTION: A portion of Lot 3, J.A. Freeman No. 529 Addition
LAND USE CATEGORY: Office Commercial
CURRENT ZONING: "S -P -1" Detailed Site Plan District Regulations with limited "C -2" Local
Retail Commercial District an limited "C -3" General Commercial District
uses.
HISTORY: - Zoning on the property was placed by the City with approval of Zoning
Ordinance No. 480 in September of 1989.
-A Plat Showing was approved by the City on November 12, 2001 for Lot 3,
J.A. Freeman No. 529 Addition.
-City Council approved "S -P -1" zoning on the property on July 16, 2002.
-A Plat Revision was approved by the City Council on June 18, 2002.
P &Z ACTION: December 19, 2002; Approved (6 -0) limiting specific use permit to Bldg. A.
for the sales and installation of mobile electronics, wireless phones, and DTV.
Also, subject to letter Attachment "C" regarding SPIN meeting summary.
STAFF COMMENTS: There are no changes proposed to approved buildings or general layout of
thee site. This site is subject to all conditions of the original zoning and site
plan approval. Therefore, no review comments have been provided. Car Toys
will occupy building W. The plan provided has been updated to show the
required "east- west" common access driveway connecting to the Gateway
Church property and the revised location for the east driveway according to
the recently approved Master Thoroughfare Plan amendment.

The following items were addressed August 14' in a meeting with Pattie Minder (Spin Group
#8) and Tommy Pigg, project developer. I am very impressed with the participation of the
neighborhood groups in Southlake and it proves that if people take part in their local
government they can impact their community in a positive way.
I hope we were able to answer all questions and concerns regarding Car Toys. I believe the
following is a summary of the issues we discussed and how Car Toys will address each issue.
• Cars will not be work on installations outside the building.
• Noise emitting from the building shall not be above the standard ambient noise of
20 W. Galer Street the surrounding area.
Seattle • Installation bay doors will be closed with the exception of ingress and egress of
vehicles.
Washington Installation bay doors will not be painted red. Doors shall conform to design

98119 standards as per the City of Southlake. Landlord has agreed to allow the
12061 443 -0980 Installation bay doors to be painted to conform to building colors.
• Storefront will not have red mullions as per City of Southlake Code.
• Storefront windows will not have painted advertisements.
• Car Toys Customers cars will not be parked overnight in the parking lot.
• Building signage, exterior windows and storefront shall conform to all city codes
and regulations.
• It is Car Toys policy to install at the point of sale. If however due to our
installation bays being at capacity, Car Toys will schedule appointments, which
eliminates stacking of vehicles waiting for installation.
It is Car Toys objective to be a good neighbor so we can provide the finest goods and services
to our customers in the Southlake area. We pride ourselves in being a leader in the
installation of high quality audio, wireless and mobile electronics. We wish to provide our
customers with the best customer service by trained professionals in a clean and comfortable
atmosphere.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR
TIRES, BATTERIES AND AUTOMOBILE ACCESSORY SALES ON
PROPERTY WITHIN THE CITY OF SOUTHLAKE, TEXAS, BEING
LEGALLY DESCRIBED AS A PORTION OF LOT 3, J. A.
FREEMAN NO. 529 ADDITION, AN ADDITION TO THE CITY OF
SOUTHLAKE, AS RECORDED IN CABINET A, SLIDE 7075, PLAT
RECORDS, TARRANT COUNTY, TEXAS, MORE FULLY AND
COMPLETELY DESCRIBED IN EXHIBIT "A ", AND AS DEPICTED
ON THE APPROVED CONCEPT PLAN ATTACHED HERETO AND
INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, a Specific Use Permit for tires, batteries, and automobile accessory sales has been
requested by a person or corporation having a proprietary interest in the property zoned as "S -P -1"
Detailed Site Plan District Regulations with "C -2" Local Retail Commercial District and limited "C -3" General
Commercial District uses; and,
WHEREAS, in accordance with the requirements of Section 43.6 of the City's Comprehensive Zoning
Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by
publication and otherwise, and have afforded the persons interested and situated in the affected area and in the
vicinity thereof, and,
WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use
Permit is in the best interest of the public health, safety, morals and general welfare of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION 1.
A Specific Use Permit is hereby granted for tires, batteries, and automobile accessory sales on the
property being legally described as a portion of Lot 3, J. A. Freeman No. 529 Addition, an addition to the City

of Southlake, as recorded in Cabinet A, Slide 7075, Plat Records, Tarrant County, Texas, more fully and
completely described in Exhibit "A ", and as depicted on the approved Concept Plan attached hereto and
incorporated herein as Exhibit `B" and providing an effective date, subject to the provisions contained in the
comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and
