Keller and Southlake agreed to upgrade their facilities at the two existing Fort Worth meter stations as well as the respective meters in each the cities of Keller and Southlake as a condition of the interlocal agreement with Fort Worth. These upgrades would allow Fort Worth to bill Keller and Southlake separately. Today, Fort Worth bills Southlake for the water usage and then Southlake bills Keller for their portion. 12 Background Information • Contract awarded to Legacy Contracting, LP for meter station upgrades Keller and Southlake funded cost of upgrades at their respective water meter stations • Cities split cost of the upgrades at Fort Worth meter stations �4 In 2008, the council awarded the construction contract for the meter upgrades to Legacy Contracting, LP. Keller and Southlake funded the cost of the upgrades at their respective meter stations and split the cost of the upgrades of their facilities at the Fort Worth meter stations. 5 Proposed Change Order No. 5 • Bid documents did not include final plans • Contractor bid was based on outdated construction plans • Delays /Costs associated with outdated set of plans • Equipment rental • Re- mobilization of crews • Loss of revenue • Financial burden determined to be $21,720 The proposed change order No. 5 is associated with the delays and costs associated with the outdated set of plans included in the bid documents at the beginning of the project. Change Orders 1 and 2 were presented to council in September and November of 2009 and included the work associated with the correct set of plans for both Civil and electrical changes. This work was required regardless in order to meet the conditions of the interlocal agreement with Fort Worth. Freeses and Nichols acknowledged that they indavertantly included the wrong set of plans and met with the cities of Keller and Southlake to discuss an equitable contribution to be split between the two cities. The contractor incurred equipment rental cost and loss of revenue that would be used to pay for expenses during the negotiation of the change orders. In addition, the contractor had to demobilize their crews since work was halted during this process.
