BACKGROUND INFORMATION
OWNER: Kevin Bower
PURPOSE: The purpose of this request is to plat 3.772 acres for construction of a single
family residence.
PROPERTY SITUATION: The property is located at 4700 N. White Chapel.
HISTORY: There is no previous development history on the property.
LEGAL DESCRIPTION: Tract 32, situated in the I.G. Belcher Survey, Abstract No. 30
LAND USE CATEGORY: Low Density Residential
CURRENT ZONING: "SF -IA" Single Family Residential District
STAFF COMMENTS: This plat has been approved subject to the conditions specified in the attached
Plat Review Summary No. 1, dated 03/24/03. The following variance is
requested and needs City Council action:
• Every lot shall abut on a public street or a private street. (Private
residential streets are permitted only under the conditions of Ord, 483,
Sections 5.04 and S. 05.)
If the Council allows the requested variance, the applicant must meet the
requirements of the building and fire departments for emergency access and
fire protection to acquire a building permit.

We would like to request a variance from the Southlake City Council from the
requirement "that every lot in Southlake shall abut on a public street or a private street."
We feel this is justified because our future lot is already an existing tract of land that is
currently accessed by a common access easement. Also, we do not intend to change any
borders. We need this variance to begin construction of our home and intend to guild an
all- weather road to this pre - existing lot. We believe this will eventually satisfy the
requirement by the time construction is completed, but we need the variance to get started
on construction and to complete the platting process.

OFFER THE FOLLOWING STIPULATIONS. THESE STIPULATIONS ARE HEREBY MADE CONDITIONS OF PLAT

2. Place the City case number "ZA 03 -016" in the lower right -hand corner of the plat.
3. Revise the title of the plat to read "Lot 1, I.G. Belcher No. 30 Addition ".
4. Revise the approval block to read "Approved by the City of Southlake ".
5. The following changes are needed with regard to the legal description:
a. Provide the deed record volume and page for the current owner(s) in the preamble.
b. Label the southeast property corner as to type and size of monument and whether found or
set.
6. The following changes are needed in the owner's dedication and notary:
a. Provide a signature block for the owner to sign and date.
b. Add a lienholder statement and signature block with notary to the plat. If there is /are no
lienholder(s) then add a statement to this effect. The standard language for these statements
is attached.
7. The following changes are needed regarding notes:
a. Show and label the 572' elevation contour line on the plat. Provide the flowage easement
note per Appendix 5.

b. Remove the "Avigation Easement and Release" As this property does not fall within the
easement limits.
8. The following changes are needed with regard to easements:
a. Provide a minimum 15' sanitary sewer easement along the north and west property lines.
b. Provide a 5' U.E. along the east property line.
9. The following changes are needed regarding the proposed lotting:
a. Provide the minimum finish floor elevation for this lot.
b. Show and label a 40' front building line along the east property boundary.
10. Percolation tests and a septic system feasibility analysis must be submitted prior to filing of this plat,
unless waived by the City Engineer. Contact the City Engineer, Charlie Thomas, at (817) 481 -2175.
INFORMATIONAL COMMENTS
* Where public water and fire hydrants are to be installed, a 10' U.E. centered over the equipment must
be dedicated to the City.
* A "Certificate of Taxes Paid" indicating that there are no delinquent taxes owed on the subject
property from each taxing authority must be provided to the City prior to filing this plat in the County
records. A copy of this information may be obtained from the Tarrant county Tax
Assessor /Collector's Office located at 100 E. Weatherford St. in Ft. Worth (across from the old red
courthouse). There is a service charge of $10 per account for this certificate. For more information
contact the Assessor /Collector's office at (817) 884 -1103.
Please submit a revised blueline "check print" prior to submitting blackline mylars with original
signatures.
* Because this property is in Denton County the following is required: one (1) 24" x 36" and one (1)
18" x 24" blackline mylar, and three (3) 18" x 24" blueprint reproductions of the completely
corrected plat with original signatures and seals of the owner(s), notary, and surveyor on all mylars
and blueprint copies. Seals should be ink - stamped. Mylars and prints will not be accepted if any
erasures or original ink, other than signatures or seals, appear on the plat.
* A Developers Agreement is required prior to construction of any public infrastructure. The
Developer's Agreement for this addition should consider streets, drainage, park dedication
requirements and fees, off -site sewer extensions, off -site drainage and utility easements and impact
fees.
