BACKGROUND INFORMATION

APPLICANT: Kirk & Kim Koogler
PURPOSE: The purpose of this request is to receive approval of a preliminary plat to
subdivide one property into two lots.
PROPERTY SITUATION: The property is located at 1640 and 1660 W. Continental Blvd.
LEGAL DESCRIPTION: Tracts lH & 1J, situated in the J. Thornhill Survey, Abstract No. 1505, being
approximately 6.4 acres
LAND USE CATEGORY: Medium Density Residential
CURRENT ZONING: "RE" Residential Estate District
PROPOSED ZONING: "SF -20X" Single Family Residential District
HISTORY: -The zoning was placed on this property with the approval of Zoning
Ordinance No. 480 on September 19, 1989.
-No other development history exists on this property.
WATER & SEWER: An 8" water line currently exists along the east side of S. Peytonville Avenue.
A 12" water line exists along the north side of W. Continental Boulevard. An
8" sanitary sewer line exists along a portion of the west side of S. Peytonville
Avenue before extending west into the Southlake Woods subdivision. A 6"
sanitary sewer line exists on the north side of W. Continental Boulevard.
P &Z ACTION: March 20, 2003; Approved (5 -0) subject to Preliminary Plat Review
Summary No. 2, dated March 14, 2003, specifically approving variance as
requested.
STAFF COMMENTS: Attached is Preliminary Plat Review Summary No. 2, dated March 14, 2003.
A variance is being requested for the requirement that lot lines must be
perpendicular to the right -of -way.

Variance Request

On behalf of the owners of the subject property, Billy Jon and Delia Maurine Curb, we respectfully
request a waiver of the 90 side lot line configuration normally required in subdivisions.
The reasons for this request are as follows: (1) the prospective owners of proposed Lot 2, and the present
owners desire for Lot 2 to have parallel lot lines; (2) the existing most westerly north property line where
proposed Lot 2 is located is not at 90 to the existing west line (South Peytonville Avenue); this line is
common with the rear line of existing Lot 9, in Block 1, Chimney Hill Addition, Phase 1; (3) the amount of
skew from 90 (6 degrees, 58 minutes) is not apparent to the eye, as viewed from Peytonville Avenue; and,
(4) the small variance from 90° does not create unusable areas or narrow angle areas which accumulate
trash or are difficult to mow and otherwise maintain.
We believe that orderly development will not be sacrificed by the granting of this waiver, and earnestly
solicit your recommendation for approval of this variance request.

1. All lots must comply with the regulations of the underlying zoning district. As proposed, each lot is
subject to approval of an appropriate change of zoning. (A change of zoning for proposed Lot 2 is
being processed concurrently. An appropriate change of zoning must be approved prior to
processing a final plat. )
2. Side lot lines shall be perpendicular to the right -of -way. The south line of Lot 2 (B) is not
perpendicular to the Peytonville Ave. R.O.W. (A variance has been requested.)
INFORMATIONAL COMMENTS
* A Developers Agreement is required prior to construction of any public infrastructure. The
Developer's Agreement for this addition should consider streets, drainage, park dedication
requirements and fees, off -site sewer extensions, off -site drainage and utility easements and impact
fees.
* The site must connect to City utilities (water & sewer). The water line is in the middle of the
northbound lane of Peytonville Avenue. Contact the Public Works department for all necessary
permits and information required for utility connection to Lot 2.
* All easements must be properly dimensioned and tied to lot boundaries with submission of a Final
Plat.
