STAFF COMMENTS: The purpose of this Zoning Change and Site Plan is to add 2,020 additional
seats, revise the parking, allocate areas for portable toilets and change
previously approved hours of operation. The attached Revised Site Plan
Review Summary No. 2, dated February 28, 2003 is limited to those areas of
change only. This site shall be subject to all previous conditions of approval
unless specifically approved otherwise by the City Council.
In order to overrule a recommendation of the Planning and Zoning
Commission that a proposed change to a regulation or boundary be denied, an
affirmative vote of at least three - fourths of all the members of the City
Council shall be required.

Addendum to the original submission — Case No. ZA 03 -005
The purpose of this request is to add 2,020 temporary bleachers to the end zone and
visitor side of Dragon Stadium to accommodate crowds which have regularly exceeded
the existing seating capacity of the stadium. The bleachers are being provided by the
Dallas Burn, at no cost to Carroll ISD. The bleachers are initially to be installed for a one
year period (matching the contract term), with a potential for two additional one year
periods.
In the years the stadium has been opened, CISD has encountered challenges with respect
to parking of vehicles at the stadium. To accommodate the existing seats, as well as the
additional seats, CISD proposes the following:
• Seats on both the home side and the visitor side of the stadium have been
manifest. Tickets for the Burn Games will be sold based on the number of seats
demarked in the stadium. Sales in this manner will limit the number of attendees.
• The Dallas Burn and CISD intend to institute a parking fee to limit the number of
cars using the stadium for game days. Historically, attendees to events at Dragon
Stadium have paid no fee for parking. We believe a parking fee will encourage
fans to car pool to the games, thereby reducing the number of vehicles.
• For CISD football games, student groups (band, drill team, athletic squads, etc.)
will be bussed to the stadium further limiting the number of vehicles for a
significant number of attendees.
• For Dallas Burn games, CISD will relocate the bus fleet from the stadium location
to the old bus parking lot on Highland Avenue, with overflow busses, if any,
moved to other campus locations. The movement will occur the day prior to the
Burn game. The spacing of parking spaces in the existing bus parking area will
allow sufficient room to maneuver through the gates. We do intend to barricade
the area surrounding the fuel tank and provide additional security to make sure
that traffic in this area flows properly.
• For Dallas Burn Games as well as Varsity Football Games and Playoff Games,
Carroll Independent School District will seek to reach an agreement with adjacent
land owners to utilize their parking during off hours substantially increasing the
number of parking sites available on adjacent property.
• For Dallas Burn Games, as well as Varsity Football Games, Carroll Independent
School District will provide a shuttle bus from either the Cleburn Eubanks /George
Dawson Schools, or from the Grapevine /Colleyville Stadium Complex to Dragon
Stadium for a price below the cost of parking at the stadium. The route of the
busses will roughly equal the Parent pickup route currently used at the stadium,
We believe the actions noted herein will result in an overall reduction in the demand for
parking at Dragon Stadium and improve the parking situation at the location.
The portable toilet area will be located wholly within the confines of the stadium (not
visible from the exterior) with the facilities placed against the field house behind the
bleachers. Accordingly, no fencing will be necessary to screen the facilities from view.

Finally, we additionally request that the 11:00p.m. curfew be extended to midnight on
Friday and Saturday nights_ The prohibition against games starting after 10:00 pm will
remain in place. This request is made to accommodate the possibility that games will go
into overtime or extended periods. We do not anticipate activities extending beyond the
existing curfew with any regularity.

CITY STAFF HAS REVIEWED THE ABOVE REFERENCED PROJECT RECEIVED BY THE CITY ON 2/14/03 AND WE
OFFER THE FOLLOWING STIPULATIONS. THESE STIPULATIONS ARE HEREBY MADE CONDITIONS OF SITE PLAN
APPROVAL UNLESS SPECIFICALLY AMENDED BY THE CITY COUNCIL. IF YOU HAVE ANY QUESTIONS ORNEED

The purpose of this request is to add 2,020 seats to the existing 7,500 seats currently in the stadium;
add standard parking spaces and striping to the bus parking and storage areas; add two screened areas
for up to 11 portable toilets each, address and receive approval for remote parking provisions in lieu
of on -site parking. The total seating capacity with this proposal will be 9,520 seats. All previously
approved uses, regulations and conditions for this site will remain the same unless specifically
approved otherwise. This review is limited to the above referenced changes only.
Correct the discrepancy between the seating shown on the site plan and the Site Data/Narrative.
The Site plan shows 2,310 additional seats and the Site Data Summary and Narrative indicates
only 2,020. Unless specifically approved otherwise, it is the intent here to only authorize up to the
2,020 additional seats for a total of 9,520 seats.
2. The required parking ratio under the current zoning of the property is 1 space per 5 seats. The
proposed seating capacity (9,520) requires a minimum 1,904 parking spaces. Only 1,701 spaces are
being provided on site. This includes the 194 spaces added by the additional striping of the bus storage
and parking areas. All buses within the transportation facility would be removed during the times of
use of these spaces. The total parking provided does not include future parking shown in the
northwest corner. Those parking spaces are not intended to be constructed at this time. The remaining
balance of required parking is proposed to be provided by remote off -site parking with shuttle service.
Please note that Ordinance 480, Section 35.6(9) (h) requires I space per 3 seats or bench seating
spaces for Sports Arena, Stadium or Gymnasiums, the current zoning on this property allows a ratio
of I space per 5 seats.
The applicant request approval subject to their proposed parking plan as described in the attached
narrative dated 2114103.
3. Staff recommends providing directional signage to the stadium along major roadways.

4. The current zoning prohibits any activities requiring stadium lights or auditory speakers between
11:00 PM and 8:00 AM and also prohibits any games from starting after 10:00 PM. The
applicant has requested that these types of activities be permitted to occur until 12:00 AM on
Friday and Saturday only and that all other conditions remain the same.
Informational Comments:
It appears that the majority of this property lies within the 65 `LDN' D/FW Regional Airport Overlay
Zone with a portion of the northeast corner being within the 75 `LDN' which will require
construction standards that meet requirements of the Airport Compatible Land Use Zoning Ordinance
No. 479.
Signs shall comply with Sign Ordinance No. 704 -A. No review of proposed signs is intended with
this site plan. A separate building permit is required prior to construction of any signs.

WHEREAS, the City of Southlake, Texas is a home rule City acting under its Charter adopted by the
electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Texas Local
Government Code; and,
WHEREAS, pursuant to Chapter 211 of the Local Government Code, the City has the
authority to adopt a comprehensive zoning ordinance and map regulating the location and use of
buildings, other structures and land for business, industrial, residential and other purposes, and to
amend said ordinance and map for the purpose of promoting the public health, safety, morals and
general welfare, all in accordance with a comprehensive plan; and

WHEREAS, the hereinafter described property is currently zoned as "S -P -1" Detailed Site
Plan District with "CS" Community Service District uses including transportation facility and stadium
under the City's Comprehensive Zoning Ordinance; and
WHEREAS, a change in the zoning classification of said property was requested by a person
or corporation having a proprietary interest in said property; and
WHEREAS, the City Council of the City of Southlake, Texas, at a public hearing called by
the City Council did consider the following factors in making a determination as to whether these
changes should be granted or denied: safety of the motoring public and the pedestrians using the
facilities in the area immediately surrounding the sites; safety from fire hazards and damages; noise
producing elements and glare of the vehicular and stationary lights and effect of such lights on
established character of the neighborhood; location, lighting and types of signs and relation of signs to
traffic control and adjacent property; street size and adequacy of width for traffic reasonably expected
to be generated by the proposed use around the site and in the immediate neighborhood; adequacy of
parking as determined by requirements of this ordinance for off - street parking facilities; location of
ingress and egress points for parking and off - street loading spaces, and protection of public health by
surfacing on all parking areas to control dust; effect on the promotion of health ad the general
welfare; effect on light and air; effect on the over - crowding of the land; effect on the concentration of
population, and effect on transportation, water, sewerage, schools, parks and other public facilities;
and,
WHEREAS, the City Council of the City of Southlake, Texas, further considered among
other things the character of the districts and their peculiar suitability for particular uses and the view
to conserve the value of the buildings, and encourage the most appropriate use ofthe land throughout
this City; and,

WHEREAS, the City Council of the City of Southlake, Texas, does find that there is a public
necessity for the zoning changes, that the public demands them, that the public interest clearly
requires the amendments, and that the zoning changes do not unreasonably invade the rights of those
who bought or improved property with reference to the classification which existed at the time their
original investment was made; and,
WHEREAS, the City Council of the City of Southlake, Texas, does find that the changes in
zoning lessen the congestion in the streets, helps secure safety from fire, panic, and other dangers,
promotes the health and the general welfare, provides adequate light and air, prevents the over-
crowding of land, avoids undue concentration of population, and facilitates the adequate provision of
transportation, water, sewerage, schools, parks and other public requirements; and,
WHEREAS, the City Council of the City of Southlake, Texas, has determined that there is a
necessity and need for the changes in zoning and has also found and determined that there has been a
change in the conditions of the property surrounding and in close proximity to the tract or tracts of
land requested for a change since the tract or tracts of land were originally classified and therefore
feels that the respective changes in zoning classification for the tract or tracts of land are needed, are
called for, and are in the best interest of the public at large, the citizens of the city of Southlake,
Texas, and helps promote the general health, safety and welfare of the community.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SOUTHLAKE, TEXAS:
SECTION 1.
That Ordinance No. 480, the Comprehensive Zoning Ordinance of the City of Southlake,
Texas, passed on the 19th day of September, 1989, as originally adopted and amended, is hereby
amended so that the permitted uses in the hereinafter described areas be altered, changed and

amended as shown and described below:
Being Lot 1, Block 1, and Lot 1, Block 2, Carroll L S.D. No. 6 Addition, an addition
to the City of Southlake, Tarrant County, Texas, according to the plat recorded in
Cabinet A, Slides 6413 & 6414, Plat Records, Tarrant County, Texas, and being
approximately 41.347 acres, and more fully and completely described in Exhibit "A"
from "S -P -l" Detailed Site Plan District with "CS" Community Service District uses
including transportation facility and stadium to "S -P -l" Detailed Site Plan District
with "CS" Community Service District uses including transportation facility and
stadium as depicted on the approved Site Plan attached hereto and incorporated
herein as Exhibit `B ", and subject to the specific conditions established in the motion
of the City Council and attached hereto and incorporated herein as Exhibit "C."
SECTION 2.
That the City Manager is hereby directed to correct the Official Zoning map of the City of
Southlake, Texas, to reflect the herein changes in zoning.
SECTION 3.
That in all other respects the use of the tract or tracts of land herein above described shall be
subject to all the applicable regulations contained in said Zoning Ordinance and all other applicable
and pertinent ordinances for the City of Southlake, Texas. All existing sections, subsections,
paragraphs, sentences, words, phrases and definitions of said Zoning Ordinance are not amended
hereby, but remain intact and are hereby ratified, verified, and affirmed.
SECTION 4.
That the zoning regulations and districts as herein established have been made in accordance
with the comprehensive plan for the purpose of promoting the health, safety, morals and the general
welfare of the community. They have been designed, with respect to both present conditions and the
conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets;
to provide adequate light and air; to prevent over - crowding of land; to avoid undue concentration of
population; and to facilitate the adequate provision of transportation, water, sewerage, drainage and
surface water, parks and other commercial needs and development of the community. They have

been made after a full and complete hearing with reasonable consideration among other things of the
character of the district and its peculiar suitability for the particular uses and with a view of
conserving the value of buildings and encouraging the most appropriate use of land throughout the
community.
SECTION 5.
That this ordinance shall be cumulative of all other ordinances of the City of Southlake, Texas,
affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances
where provisions of those ordinances are in direct conflict with the provisions of this ordinance.
SECTION 6.
That the terms and provisions of this ordinance shall be deemed to be severable and that ifthe
validity of the zoning affecting any portion of the tract or tracts of land described herein shall be
declared to be invalid, the same shall not affect the validity of the zoning of the balance of said tract
or tracts of land described herein.
SECTION 7.
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply
with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more
than Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation is permitted to
exist shall constitute a separate offense.
SECTION 8.
All rights and remedies of the City of Southlake are expressly saved as to any and all
violations of the provisions of Ordinance No. 480, as amended, or any other ordinances affecting
zoning which have accrued at the time of the effective date of this ordinance; and, as to such accrued
violations and all pending litigation, both civil and criminal, whether pending in court or not, under

such ordinances, same shall not be affected by this ordinance but may be prosecuted until final
disposition by the courts.
SECTION 9.
The City Secretary of the City of Southlake is hereby directed to publish the proposed
ordinance or its caption and penalty together with a notice setting out the time and place for a public
hearing thereon at least fifteen (15) days before the second reading of this ordinance, and if this
ordinance provides for the imposition of any penalty, fine or forfeiture for any violation of any of its
provisions, then the City Secretary shall additionally publish this ordinance in the official City
newspaper one time within ten (10) days after passage of this ordinance, as required by Section 3.13
of the Charter of the City of Southlake.
SECTION 10.
This ordinance shall be in full force and effect from and after its passage and publication as
required by law, and it is so ordained.

Permitted Uses:
a. Outdoor sports stadium (includes track and field), offices, meeting rooms,

Site plan:
Actual construction and usage shall be as shown on site plan as approved by P &Z
and City Council.
Development Regulations:

be 25 feet.
3. Maximum lot coverage: Building or structure footprint not to exceed 60 %.

Addendum to the original submission — Case No. ZA 03 -005
The purpose of this request is to add 2,020 temporary bleachers to the end zone and
visitor side of Dragon Stadium to accommodate crowds which have regularly exceeded
the existing seating capacity of the stadium. The bleachers are being provided by the
Dallas Burn, at no cost to Carroll ISD. The bleachers are initially to be installed for a one
year period (matching the contract term), with a potential for two additional one year
periods.
In the years the stadium has been opened, CISD has encountered challenges with respect
to parking of vehicles at the stadium. To accommodate the existing seats, as well as the
additional seats, CISD proposes the following:
• Seats on both the home side and the visitor side of the stadium have been
manifest. Tickets for the Burn Games will be sold based on the number of seats
demarked in the stadium. Sales in this manner will limit the number of attendees.
• The Dallas Burn and CISD intend to institute a parking fee to limit the number of
cars using the stadium for game days. Historically, attendees to events at Dragon
Stadium have paid no fee for parking. We believe a parking fee will encourage
fans to car pool to the games, thereby reducing the number of vehicles.
• For CISD football games, student groups (band, drill team, athletic squads, etc.)
will be bussed to the stadium further limiting the number of vehicles for a
significant number of attendees.
• For Dallas Burn games, CISD will relocate the bus fleet from the stadium location
to the old bus parking lot on Highland Avenue, with overflow busses, if any,
moved to other campus locations. The movement will occur the day prior to the
Burn game. The spacing of parking spaces in the existing bus parking area will
allow sufficient room to maneuver through the gates. We do intend to barricade
the area surrounding the fuel tank and provide additional security to make sure
that traffic in this area flows properly.
• For Dallas Burn Games as well as Varsity Football Games and Playoff Games,
Carroll Independent School District will seek to reach an agreement with adjacent
land owners to utilize their parking during off hours substantially increasing the
number of parking sites available on adjacent property.
• For Dallas Burn Games, as well as Varsity Football Games, Carroll Independent
School District will provide a shuttle bus from either the Cleburn Eubanks /George
Dawson Schools, or from the Grapevine /Colleyville Stadium Complex to Dragon
Stadium for a price below the cost of parking at the stadium. The route of the
busses will roughly equal the Parent pickup route currently used at the stadium.
We believe the actions noted herein will result in an overall reduction in the demand for
parking at Dragon Stadium and improve the parking situation at the location.
The portable toilet area will be located wholly within the confines of the stadium (not
visible from the exterior) with the facilities placed against the field house behind the
bleachers. Accordingly, no fencing will be necessary to screen the facilities from view.

Finally, we additionally request that the 11:OOp.m. curfew be extended to midnight on
Friday and Saturday nights. The prohibition against games starting after 10:00 pm will
remain in place. This request is made to accommodate the passibility that games will go
into overtime or extended periods. We do not anticipate activities extending beyond the
existing curfew with any regularity.

Motion was made to approve ZA 99 -132 subject to Site Plan Review Summary No. 2, dated January 28,2000 and subject
to the following:
• acknowledging some of the reasons for not going with straight "CS" zoning are the residential properties to the north;
the industrial properties surrounding it; the particular needs and concerns surrounding this type of a use, a stadium; and
in addition, they have several uses that did not come in under straight "CS" zoning such as the transportation facility;
• striking the following use within the "CS" zoning district: 8.2.g: Utility buildings and structures: power sub - stations,
water tanks and reservoirs, water and sewage treatment plants;
• deleting Item #1.B.1 (height);
• deleting Item #1.B.2 (maximum lot coverage);
• amending Item #1.B.3 allowing a limit of 85% impervious coverage;
• requiring compliance with Item # 1. C.1 (residential adj acency);
• deleting Item #1.D.1 and acknowledging the applicant's willingness and effort to work with the Landscape
Administrator to landscape the best they can with native vegetation that provides some color and requires little or no
watering;
• granting a variance on Item #1.D.2 allowing the applicant to move some of the interior plantings to the outside
bufferyards with the understanding that by the time they get to City Council they will work out the numbers to see if they
are able to have some relief of some of these trees and trees in other district properties in exchange for a brick wall that
would border the northern properties;
• deleting Item #1.E.1 and accepting 1 space per 5 seats;
• noting the district's willingness to comply with Item #5.13 with their study which shows they come under the limit ofthe
decibels at the property line;
• adding Item #5.D requiring compliance with driveway stacking requirements but granting a variance to it and
recognizing that the district is going to provide gates on both ends of the area between the field house and Silicon Drive
such that the stacking depth would actually be 163%
City Attorney Debra Drayovitch said there are requirements for obtaining a variance to the Lighting Ordinance which require
submission of an alternate plan and certain evidence, and she is certain the Commission would want to have that reviewed by
the appropriate staff.
Continuation of motion:
• Requiring compliance with the Lighting Ordinance but recognizing the applicant has the lighting study and will submit it
before they go to City Council and allow staff time to review it; and
• Requiring the gates to the east of the field house to remain closed during the games and for a period of 30 minutes after
the games except for emergency access.

are not variances; they are part of this planned development Site Plan zoning. She wanted the record to reflect they are really

Revised Site Plan Review Summary No. 2, dated February 11, 2000, incorporating Planning and
Zoning Commission's recommendations with the following changes and additions:
• Recognizing the district's commitment to the north property owner for putting panels in the
chain -link fence;
• Recognizing the district's commitment to the western property owner with the chain -link
fence adding slats; northern property owners with a tilt -wall brick -look fence behind those
owners, allowing the district to eliminate two rows of landscaping medians in the parking lot
which will enable them to increase the bufferyard on the north from approximately 30' to 50'
recognizing they will bring in those exact numbers at the second reading;
• Accepting the lighting for the facility, on the field as demonstrated tonight using the internal
shields with the visors;
• Allowing the district to phase in the tree mitigation plan which they accept over the next five
(5) years, so that they can use operating funds instead of bond funds;
• Limiting events by entities other than the CISD and City of Southlake to ending at 11:00
p.m.;
• Accepting the district's commitment to not light any signs on the north side of the property;
• Accepting the district's commitment to the best of their ability to bring forward at the second
reading, a reciprocal parking agreement with adjacent property owners;
• Allowing white lights;
• Allowing the variance as requested from the school district on the lights on the field; and,
• Deferring the 8' screening.
