Item 6C13 SOUTHLAI<,.E CITY OF Department of Planning & Development Services STAFF REPORT February 8, 2011 CASE NO: SV11 -002 PROJECT: Variance to the Southlake Corners Conditional Sign Permit for Toys "R" Us/ Babies "R" Us REQUEST: Toys "R" Us /Babies "'R" Us is requesting a variance to the Southlake Corners Conditional Sign Permit for maximum letter height and maximum width for attached signs. Toys "'R" Us /Babies "R" Us is located at 250 North Kimball Avenue in the former Circuit City space. On the front elevation, the applicant is requesting a maximum letter height of 72 inches for the `R" in Toys "R" Us and Babies "R" Us sign. Under the Southlake Corners Conditional Sign Permit, the maximum allowed letter height is 60 inches. All other letters in the sign are 48.5 inches or less. On the rear elevation, the applicant is requesting a maximum sign width of approximately 36 feet. The maximum allowed sign width is 27 feet. That a literal enforcement of the sign regulation will create an unnecessary hardship or practical difficulty on the applicant. The company that is considering the use of this building has a copyright to for their building signs to read "TOYS R US BABIES R US ". 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. The subject building is located within a shopping center whose focus is N. Kimball Avenue. The subject building is situated farther from N. Kimball Avenue than any other building in the shopping center. 3. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. Granting the variance will not injure and be compatible with adjacent properties since adjacent properties are retail properties. 4. That the variance will be in harmony with the spirit and purpose of the sign ordinance. It is doubtful whether the true intent of the sign code was to prohibit signage designating a building with two names. The height of one letter (the letter "R ") is larger {72 "} than the maximum 60" height. All other letters are lower (48 ") than the maximum height. Case No. Attachment D SV11 -002 Page 1
