Whereas, on the 28th day of July, 2010, a Notice of Lis Pendens was filed by the City of
Southlake, Texas, in the Records of the County Clerk of Tarrant County, Texas. Said Notice of Lis
Pendens gave notice that in the County Court-At -Law #2 of Tarrant County, Texas, a suit entitled
the City of Southlake, Texas v. Luther L. Hillman, under Cause No. 10- 83715 -2 had been filed for
condemnation of permanent right -of -way and temporary construction easement for the widening of
North Kimball Avenue within the City of Southlake, Texas that will serve the City of Southlake,
Tarrant County, Texas, and more specifically described as follows:
Permanent Right -Of -Way: Being 0.140 acre of land located in the S. Freeman
Survey, Abstract No. 525, Southlake, Tarrant County, Texas, and being a portion of
a tract of land conveyed to Luther L. Hillman, by the deed recorded in Volume
14264, Page 444, of the Deed Records of Tarrant County, Texas, and being more
particularly described and depicted in Exhibit "A" attached hereto; and
Permanent Right -Of -Way: Being 0.167 acre of land located in the S. Freeman
Survey, Abstract No. 525, Southlake, Tarrant County, Texas, and being a portion of
a tract of land conveyed to Luther L. Hillman, by the deed recorded in Volume
14264, Page 444, of the Deed Records of Tarrant County, Texas, and being more
particularly described and depicted in Exhibit "B" attached hereto; and
Temporary Construction Easement: Being 0.061 acre of land located in the S.
Freeman Survey, Abstract No. 525, Southlake, Tarrant County, Texas, and being a
portion of a tract of land conveyed to Luther L. Hillman, by the deed recorded in
Volume 14264, Page 444 of the Deed Records of Tarrant County, Texas, and being
more particularly described and depicted in Exhibit "C" attached hereto.
Whereas, said condemnation proceeding has been concluded.
NOW, therefore, the City of Southlake, Texas, does hereby RELEASE the Lis Pendens filed
July 28, 2010.

JUDGMENT OF COURT IN ABSENCE OF OBJECTIONS
BE IT REMEMBERED:
That on this date came on to be heard and considered the decision of the Special
Commissioners filed on the 28th day of October, 2010, in the above - entitled and number cause,
which is a condemnation proceeding in which the City of Southlake, Texas is Plaintiff and Luther
L. Hillman is Defendant.
It appears to the Court that the Plaintiff, City of Southlake, Texas, is a municipal corporation
located in Tarrant County, Texas, organized and existing under and by virtue of its charter adopted
by the electorate pursuant to Article XI, Section 5 of the Texas Constitution; that Plaintiff as a home
rule municipality is vested with the power and authority to appropriate private property for public
purposes by condemnation proceedings and to exercise all of the powers of eminent domain; that
Plaintiff seeks to condemn real property for the acquisition of permanent road right -of -way in fee
simple, and a temporary construction easement for the public purpose of the extension of Kimball
Avenue from a two -lane road to a four -lane thoroughfare that will serve the City of Southlake and
in order to preserve and protect the public health, safety and welfare within the City of Southlake,
Texas; that prior to the filing of this suit, Plaintiff contacted Defendant to engage in good faith

negotiations to reach an agreement with Defendant to acquire the permanent road right -of -way and
temporary construction easement and obtain clear title to the property; that all acts, conditions and
things required by law, and the ordinances and charter of the City of Southlake precedent to the
institution of these condemnation proceedings have been done; that on July 22, 2010, the Court
appointed John Beatty, Vic Tinsley, and Kris Summers as special commissioners to assess the value
of the permanent road right -of -way and temporary construction easement which is the subject matter
of this suit; Defendant was properly served with notice of the lawsuit and notice of the
commissioners hearing; that on October 25, 2010, the commissioners hearing was conducted, and
the special commissioners awarded the sum of Forty -Three Thousand Five Hundred and No /100
Dollars ($43,500.00.) as the total value of the permanent road right -of -way and temporary
construction easement, to be paid by the City of Southlake according to the rules of damages set
forth in Section 21.042 of the Texas Property Code; that the written award of the special
commissioners was filed with the Court on October 28, 2010; that the special commissioners
assessed all costs against Plaintiff, including the fee of each special commissioner; that on November
12, 2010, Plaintiff deposited in the registry of the Court the sum awarded by the Special
Commissioners; that on November 29, 2010, Plaintiff paid each special commissioner the fee
awarded by the Court and forwarded confirmation of payment to the Tarrant County Clerk; and no
objections to the award of the special commissioners were filed within the time required by law.
It is, therefore, ORDERED, ADJUDGED and DECREED by the Court as follows:
a) That the decision of the Special Commissioners be, and the same is hereby, made the
judgment of this Court.
b) That the Clerk of this Court record the decision of the Special Commissioners in the

minutes of this Court.
c) That by virtue of said decision of the Special Commissioners, the City of Southlake,
Texas is entitled to condemn and does hereby have judgment against the above -named Defendant
for the acquisition of permanent road right -of -way and temporary construction easement, located in
Tarrant County and more specifically described as follows:
Permanent Right -Of -Way: Being 0.140 acre of land located in the S. Freeman
Survey, Abstract No. 525, Southlake, Tarrant County, Texas, and being a portion
of a tract of land conveyed to Luther L. Hillman, by the deed recorded in Volume

Volume 14264, Page 444 of the Deed Records of Tarrant County, Texas, and

d) That the Right -Of Way and Temporary Construction Easement described
above are hereby decreed to and vested in Plaintiff, City of Southlake, Texas.
It further appears that Plaintiff paid into the registry of the Court the sum of Forty -Three
Thousand Five Hundred and No /100 Dollars ($43,500.00), the amount of damages awarded by the
Special Commissioners to the Defendant, and that Plaintiff paid to each Special Commissioner the
fee awarded by the Court; and it is therefore:
