SUMMARY: On behalf of David Taunton, Mike Nantz is requesting approval of a Plat Revision
for Lot 2R, Block 3, Wingate Hill Addition, being a replat of Lot 2, Block 3, Wingate
Hill Addition, an addition to the City of Southlake, Tarrant County, Texas, being
located at 101 Welford Lane and being approximately 1.0 acres. SPIN # 1.
REQUEST DETAILS: The applicant is requesting approval of a Plat Revision for Lot 2R, Block 3, Wingate
Hill Addition, being a replat of Lot 2, Block 3, Wingate Hill Addition to abandon ten
(10) feet of the existing twenty (20) foot utility easement along the northwest
property line. An accessory building that was constructed in 2009 was placed in the
utility easement. To the best of our knowledge, there is no equipment in the portion
of the easement to be abandoned. Water for the property exists at the front of the
lot along Welford Lane and sewer exists at the rear of the lot along N. White Chapel
Blvd. The applicant is in the process of obtaining permission from all franchise
utilities to abandon ten (10) feet of the existing easement and approval of the plat
revision is subject to the franchise utilities grating their permission.

LEGAL DESCRIPTION: Lot 2, Block 3, Wingate Hill Subdivision
LAND USE CATEGORY: Low Density Residential
CURRENT ZONING: "SF -1A" — Single Family Residential District
HISTORY: - Approximately 19 acres of this site was zoned from "AG" to "S -P -2"
Generalized Site Plan District to permit a fish distribution facility in August of
1993.
-A Zoning change (ZA00 -111) request from "AG" Agricultural District and "S -P-
2" Generalized Site Plan District for tropical fish distribution and related
ancillary uses to "SF -1A" zoning was approved by the City Council on January
2, 2001.
-A Preliminary Plat (ZA00 -112) was approved by the City Council on December
5, 2000. It was Approved (7 -0) granting the requested variances to the 25'
setbacks on Lots 1 and 4, Block 3, and Lot 17, Block 1; and a single access to
the addition.
-A final plat (ZA01 -034) was approved by P &Z on May 3, 2001 and was filed on
November 6, 2001.
-A building permit was issued for the 6,794 square foot principal residence on
September 15, 2004.
-A building permit was issued for an accessory on November 5, 2009.
-The Zoning Board of Adjustment approved a Special Exception Use Permit
per Ordinance No. 480, Section 44.12 (3) for an accessory building or structure
of a size or aggregate size greater than that permitted, which in this case is
1,311 square feet, a Variance to Ordinance No. 480, Section 11.5(c), requiring
a side yard of not less than twenty (20) feet, and a Special Exception Use
Permit per Ordinance No. 480, Section 44.12 (1) for a servants or family
quarters to allow a two -story accessory building and covered patio totaling
approximately 1,500 square feet with a side yard setback of ten (10) feet to be
used as a servants or family quarters.
TRANSPORTATION
ASSESSMENT: Since the plat revision is not changing the number of lots, there will be no
change to the traffic impact.
PATHWAYS
MASTER PLAN: A sidewalk is not required with this plat revision because sidewalks are not
existing on both sides of the lot and the lot is not located within 1,500 feet of a
public or private school on the same side of the street.
WATER & SEWER: The property is served by an 8" water line along Welford Lane and a 12"
sanitary sewer line along N. white Chapel Blvd.
TREE PRESERVATION: No trees will be affected with this plat revision.

1. Place the City case number ZA 10 -072" in the lower right -hand corner of the plat.
2. Provide the standard approval block on the plat per Appendix 9 (attached). Please provide an approval
block for a plat revision, which requires the signatures of the P &Z Chairman, the P &Z Secretary, the
Mayor and the City Secretary.
3. In the owner's dedication, change Lot 2 to Lot 2R in the sentence "...being the sole owners, do hereby
adopt this plat designating the hereinabove described property as Lot 2R, Block 3, Wingate Hill
Subdivision... ".
4. Add a lienholder statement and signature block with notary to the plat. If there is /are no lienholder(s)
then add a statement to this effect. The standard language for these statements is attached in
Appendix 12.
5. The following changes are needed with regard to adjacent properties within 200' to include properties
across any adjacent R.O.W.:
a. Show and label the name of the record owner & corresponding deed record (volume &
page) for all unplatted tracts within 200 feet of this property.
b. Show and label the lot lines as dashed, lot & block numbers, street names, and existing
easements, and subdivision name and plat record (volume & page) (or cabinet & slide, or
cabinet & page) for all platted properties within 200 feet of this property.
6. Add the following notes to the face of the plat:
a. Selling a portion of any lot within this addition by metes and bounds is a violation of state law
and city ordinance and is subject to fines and withholding of utilities and building permits.
b. The owners of all corner lots shall maintain sight triangles in accordance with the City
Subdivision Ordinance.

c. The City of Southlake shall NOT be liable for any claims, damages, or losses which may occur
on account of flooding or inundation of any such lots so reclaimed, and the owner and
subsequent owners of any such lots agree to release the City from any and all such claims,
damages, and losses.
d. No lot within this addition shall be allowed driveway access onto White Chapel Blvd.
e. Flowage easement note per Appendix 5 (attached).
7. The following changes are needed with regard to easements:
Show (grayed out) and label the easement to be abandoned
b. Add Atmos Energy and One Source Communications to the signature block for
approval of the abandonment. Change Southwestern Bell to "AMT (SBC) ".
8. Show and label the existing R.O.W. with dimensions, i.e., public streets, highways, alleys, private
street /drives, railroads, etc. Also provide dimensional centerline references to existing or approved
street intersections on the perimeter of the subdivision or within 200 feet of the perimeter.
9. Dimension all street R.O.W. and centerlines with bearings.
Public Works Comments
The "Record Drawings" do not show the easement to contain any underground water, sanitary sewer,
or storm drain improvements. An on -site visual inspection of the area indicated that there is no
overhead electric in the easement. Franchise utilities will need to review this request.
Add Note: Compliance with the provisions of the city's Storm Drainage Policy does not relieve a
person of the responsibility of complying with all other applicable laws, including, but not limited to,
Section 11.086, Texas Water Code.
The following should be informational comments only
It appears this property lies within the 65 'LDN D /FW Regional Airport Overlay Zone, requiring
construction standards in compliance with the Airport Compatible Land Use Zoning Ordinance No.
479. Additionally, the Avigation Easement and Release shown in Appendix 3 of the Subdivision
Ordinance No. 483 should be executed on subsequent Plats to be filed in the County Plat Records.
A "Certificate of Taxes Paid" indicating that there are no delinquent taxes owed on the subject property
from each taxing authority must be provided to the City prior to filing this plat in the County records. A
copy of this information may be obtained from the Tarrant county Tax Assessor /Collector's Office
located at 100 E. Weatherford St. in Ft. Worth (across from the old red courthouse). There is a service
charge of $10 per account for this certificate. For more information contact the Assessor /Collector's
office at (817) 884 -1103.
Please submit a revised blueline "check print" prior to submitting blackline mylars with original
signatures.
Original signatures and seals will be required on two blackline mylars prior to filing the plat. Mylars will
not be accepted if any erasures or original ink, other than signatures or seals, appear on the plat.
