Contents include a narrative describing the results of the tree survey performed, site vicinity and local area maps, and an aerial photograph depicting trees to be saved or removed. 29 Dear Mr. Martin: This letter refers to the proposed XTO — JGJ Unit in the City of Sauthlam, Texas. XTO Energy, Inc. (XTO) is proposing to construct a well pad and associated access road. The proposed well pad site is located approximately 900 feet southwest of the intersection of State Highway 114 and East Highland Street (Attachment A, Exhibits 1 and 2). Tree Suwey A pedestrian survey of the project area was conducted by environmental scientists from Jacobs Enginesnng Group Inc. (Jacobs) on July 6, 2010 during whichprotected' trees within the limits of the proposed well pad and associated access road were idenfified and recorded (Attachment q Exhibit 3). Protected trees are defined in the Southe a Tree Preservation Ordinance and Technical Manual as any tree that has a diameter at breast height (DSH) of six Inches or greater. All protected trees within the limits of the proposed well pad (including 6-foot buffer) and assodated access roads were identified and recorded. Protected Trees Per Section 5.0'Tree Permit Required' of Ordinance 585-D, 35 protected trees six inches or greater in caliper were looted within the proposed well pad (inducing a 6-foot construction buffer) and acoss roc construction area. All 35 protected trees looted within the site are to beremoved. The applicable information for these protected trees is located in Table 1. total of 35 protected trees, measuring a combined 807 caliper inches, will be removed from a proposed well pad site. XTO has submitted an application for a specific use permit (SUP) oposing the use of a natural resource a Jmction facility on existing agriculture (AG) mned operty. The property does not qualify for agriculture exemption as defined by the ordinance ,cause the trees proposed to be removed are further than 150 feet from the principle sidential structure and the removal of these trees is not for a recognized agricultural use. )nstmction of such a site will be regulated by the mitigation requirements defined in the dinance. XTO is currently in discussions with city officials to determine an acceptable level of ligation per ordinance requirements. City of Southlake ordinances are consistent with Texas Administrative Code regarding necessary signage displayed identifying the site and emergency phone number. Signs shall be placed at the entrance gate, site fencing, and interior production well fencing. 33 This slide shows the plan submitted for erosion control. The rock check dam shown in the bottom left corner is proposed at 3 different areas on this plan. High flow silt sock areas are also displayed. 34 Ordinance 880-A, Section 9.5-234, number 19 (page 13) Exhibit Q describes the water source to be used during well fracturing, drilling and/or operations. As stated in the Engineering review comments, Southlake's peak water usage is between May 1 and October 15. The City of Southlake fully utilizes its water during the peak usage timeframe and does not have the opportunity to provide water for drilling or fracing purposes without diminishing its ability to provide service to our citizens. The applicant proposes their primary water source will be to haul water from the nearest available municipal source. The following plan shows two temporary three inch fastlines will be put in place as alternative water sources using Milner's water well and/or one of the fire hydrants shown along Highland should water become available in the future. 35 This shows the water source plan. The fire hydrant is shown as an alternative barring city water is available in the future. The red lines are the approximate locations of the temporary 3 inch fastlines. These fastlines will be removed once all drilling and fracing operations are completed. 36 Ordinance 880-A, Section 9.5-234, numbers 24 and 25 (page13) Exhibits R & S consist of the hazardous materials management plan and all material safety data sheets (MSDS's) detailing the hazardous materials that will be located, stored, transported and/or used at the drill site. These documents have been provided and reviewed by the fire marshal. At the joint work session on October 12, Councilmember Morris requested other city's application hazardous materials management plans. I made a request to neighboring cities regarding this request. Hurst, Mansfield, Arlington, and Grand Prairie all responded with a plan that was submitted by a different gas operator. All of the plans were basically identical. You have received the City of Mansfield's plan in your meeting packet. 37 Ordinance 880-A, Section 9.5-234, number 27 (page 13) Exhibit V contains the noise management plan. The plan submitted for this application was prepared by Noise Attenuation Construction, LLC (NAC). To review the complete requirements set forth by the City of Southlake, please refer to Section 9.5-243 of Ordinance 880-A which begins on page 32. 0 This slide shows the aerial location photo and identifies the nearest protected receivers. NAC recommends 20 foot high sound walls on the south perimeter and along two sides of the three generators on -site as shown in this diagram to help aid in the mitigation of noise. 39 As defined by Ordinance 880-A (page 7), the proposed pipeline / Segment #3 is classified as an unregulated pipeline. The following slides show the proposed pipeline corridor and 1000 foot buffer area from an aerial view. The turn -a -rounds at White Chapel Blvd. and N. Carroll Avenue will be utilized. The optional route proposed from SH114 is White Chapel Blvd. to East Highland Street. XTO Energy has submitted a revised letter for two variance requests. The pipeline operator, Energy Transfer has submitted two variance requests. XTO has submitted waivers for consent to conduct drilling and production operations at this site from all property owners. 52 The applicant also proposes exception to the ordinance requirements for the three - pipe system requirement. 53 Pipeline Variance Request - Section 9.5-293.b: All new or relocated unregulated pipelines within private residential areas shall be located within existing pipeline corridors within the City, unless the pipeline operator of the unregulated pipeline is able to demonstrate to City Council that such alignment is feasible. •:��116 r u.. a The proposed route for Segment 3 is currently routed as close to SH 114 as possible while taking into consideration the existing utility corridors and road crossings. The variance request is made in reference to the residentially zoned tract located east of Shady Oaks Drive and south of West Dove Road-, known as Fox Hollow. The pipeline permit currently shows 461 ft. of a 6" natural gas pipeline routed on the most eastern edge of the subdivision, directly adjacent to the existing sewer and water line corridors. As defined by Ordinance 880-A, this property does not currently have a pipeline corridor resulting in the requirement for this variance request. 54 F. L Fr 6 Energy Transfer has also submitted a variance request to the Noise Ordinance, City Code, Chapter 11, Article III, Section 11-61(c)(7) which prohibits work during night time hours or on Sunday, within 1,000 feet of a residential property (Ordinance provided in your packet). The applicant states it may be necessary to continue work during these time periods to complete the boring process without interruption.
