Kimball Ave. at 2120 E. State Highway 114. SPIN #4 DETAILS: Conifer Real Estate is requesting site plan approval for a Chicken Express restaurant located on the north side of the west bound frontage road of State Highway 114, approximately 200 feet west of the northwest intersection of N. Kimball Avenue. The gross square footage of the building is approximately 3,046 square feet with a net usable floor area of approximately 2,480 square feet. The restaurant will have a drive -thru lane along the rear (north) and west side of the building. The pad site has access from existing driveways located on the west bound frontage road of State Highway 114 and N. Kimball Avenue. The current S- P-2 generalized site plan district zoning and concept plan (see attachment `C' page 1) approved a restaurant with drive -thru service at this pad site location under Case ZA96 -109. Under the S -P -2 generalized site plan district zoning, City Council approval of a site plan, following a recommendation of the Planning and Zoning Commission, is required prior to issuance of a building permit. Variances 1) A variance is being requested to "pitched roof" requirement of Section 43.12 of the Zoning Ordinance No. 480, as amended, for roof design standards. The applicant proposes a standing seam metal mansard roof. State Highway 114 LEGAL DESCRIPTION: Lot 6, Block 1, Mesco Addition LAND USE CATEGORY: Retail Commercial CURRENT ZONING: "S -P -2" Generalized Site Plan Zoning District HISTORY: - A Rezoning and Concept Plan ( Mesco Addition) for S -P -2 zoning was approved by City Council on October 1, 1996 under Planning Case ZA96- 109 approved "C -2" uses and restaurant pad sites with drive thru service for this site. CITIZEN INPUT SOUTHLAKE 2025 PLAN: TRANSPORTATION ASSESSMENT: WATER & SEWER: Case No. ZA10 -073 - A Final Plat was filed with Tarrant County Plat Records on July 3, 1997 which included Lot 6 of the Mesco Addition under Planning Case ZA96- 09 7. A Southlake Program for the Involvement of Neighborhoods (SPIN) meeting was held on December 6, 2010. The report for this meeting is under Attachment "C of this staff report. Consolidated Land Use Plan The Southlake 2025 comprehensive plan designates this site as Retail Commercial. The existing zoning and type of development being proposed at this location is consistent with the Land Use Plan. Pathways Master Plan The Southlake 2025 Pathways Master Plan indicates a planned 8 -foot to 10- foot paved bikeway along the north side of State Highway 114. The applicant is providing an 8 -foot bikeway as indicated on the site plan connecting to the 5 -foot sidewalk which leads into the restaurant. City staff has assessed the traffic impact regarding this proposal and has determined that no Traffic Impact Analysis is required for this building. Water There is an existing 12 -inch water line on the south side of the lot along State Highway 114 that will serve this development. Sewer There is an existing 10 -inch sanitary sewer line also along State Highway 114 that will serve this development. Attachment A Page 1 TREE PRESERVATION: The site contains a few post oaks and a cedar elm towards the front of the lot which were originally proposed to be removed. PLANNING & ZONING COMMISSION: January 6, 2011; Approved (7 -0) granting the applicant's request for a variance to the roof design standards, subject to Site Plan Review Summary No. 2, dated December 21, 2010, that the applicant take into consideration some enhancements to coloring along the linear fascia and subject to the applicant providing some variations of the landscape plan. Development Details • The applicant is requesting approval of a site plan that proposes the construction of an approximately 3,000 square foot quick -serve restaurant with a drive thru on a 40,335 square foot lot. The applicant anticipates hours of operation will be 10:30 a.m. — 10 p.m. daily and staff 20 — 25 employees. This site was originally zoned industrial; an S -P -2 zoning designation was approved with the Scooter's development to include three additional pad sites. The proposed use for this lot has been previously approved by the original concept plan. The applicant is proposing building materials that are not standard to Chicken Express with the use of Austin stone, Acme brick, and a metal mansard roof. A variance is being requested regarding the requirement for a pitched roof. The applicant stated that Chicken Express is a family- oriented business and that the corporation involves themselves in the community. Since the lot exceeds 30,000 square feet the submitted Landscape Plan must be designed by a Registered Landscape Architect and comply with the landscape plan submittal requirements of the Landscape Ordinance.
