Item 6D13 S0UTHLA1<,.,E CITY OF Department of Planning & Development Services STAFF REPORT December 22, 2010 CASE NO: GAS10 -004 (RESOLUTION NO. 10 -057) PROJECT: Specific Use Permit (SUP) for Gas and Oil Drilling and Production — JGJ Unit EXECUTIVE SUMMARY: On behalf of JGJ Enterprises Inc., XTO Energy Inc. is requesting a Specific Use Permit for Gas and Oil Drilling and Production on property located at 651 & 655 E. Highland Street and described as a portion of Lots 1 R1 & 2, Block A, Milner Addition. SPIN Neighborhood #7. REQUEST DETAILS: The applicant is proposing to construct a 2.75 acre gas well pad site approximately 380 feet south of Highland Street on the Milner Ranch property. This pad site is located on two (2) parcels totaling approximately 52 acres. The applicant is proposing up to eighteen (18) well heads be permitted on the pad site. The Specific Use Permit section of the Zoning Ordinance requires that at least one (1) well permit and a pipeline permit as defined by Article IV, Chapter 9.5, of the City Code be provided in conjunction with the SUP request. These permits have been provided with this Specific Use Permit application. An addendum was submitted November 10, 2010, regarding the proposed alignment of the associated pipeline (Segment #3); please refer to your meeting packet materials and Attachment G. The applicant is proposing to access the site via SH 114, Highland Street and White Chapel Boulevard as indicated by the transportation route plan. The proposed permanent production site will be reduced to approximately 1.5 acres. Variance Requests (Agenda Items 6E, 6F, and 6G) It shall be unlawful to drill a well, or to re- drill, deepen, re- enter, activate or convert any abandoned well, the center of which, at the surface of the ground, is located within 1,000 feet from any habitable structure, or from the property line of any occupied public or private school or hospital. (Sec. 9.5 -242 (a)) (VARIANCE REQUEST SUBMITTED FOR SETBACK REQUIREMENT. NOTARIZED WAIVER FORMS SUBMITTED BY ALL PROTECTED RESIDENTIAL OWNERS PER SEC. 9.5 -223 (6)). Agenda item 6E a. Please note that the City Council will have to grant a variance for all future well heads that do not meet the setback requirements as part of this SUP. 2. A masonry perimeter wall of a minimum of eight feet in height shall be required to enclose and visually screen the well and all associated equipment during post - drilling operations. Such a wall must be completed within 60 days of completion of drilling of the first well on the site. The masonry perimeter wall shall have an architectural metal gate that shall remain locked when the operator or operator's employees are notwithin Case No. GAS10 -004 the enclosure. In addition to the foregoing, the operator shall also be required to comply with the screening requirements set forth in the zoning ordinance. (Sec. 9.5 -242 (h)) (VARIANCE REQUEST SUBMITTED FOR MASONRY WALL REQUIREMENT) Agenda item 6E 3. Gas emission or burning restrictions. No person shall allow, cause or permit gases to be vented into the atmosphere or to be burned by open flame. No open flaring is permitted. (Sec. 9.5 -242 (gg)) (VARIANCE REQUEST SUBMITTED FOR VENTING RESTRICTION) Agenda item 6E 4. Three -pipe system. The three -pipe system to extract oil and gas shall be utilized. Water storage tanks shall not be permitted on the pad site except for oil and gas separators used during drilling and fresh water tanks used during fracturing. (Sec. 9.5 -242 (aaa)) (VARIANCE REQUEST SUBMITTED FOR THREE -PIPE SYSTEM REQUIREMENT) Agenda item 6E 5. Access Drive. The operator shall construct all facilities used for parking, loading, unloading, driveways, and other vehicular access areas of concrete, unless an alternative material is approved by the city council as a condition of a specific use permit or an approved variance. The operator shall maintain the surface for such facilities and drive approach in good condition and repair and meet the minimum requirements set forth in the fire code approved by the city council, as amended. The pad site is not required to be constructed of concrete or asphalt. (Sec. 9.5 -242 (f)) (VARIANCE REQUEST MADE VERBALLY AT P &Z MEETING 11- 18 -10) Agenda item 6E 6. Pipeline. All new or relocated unregulated pipelines within private residential areas shall be located within existing pipeline corridors within the city, unless the pipeline operator of the unregulated pipeline is able to demonstrate to the City Council that such alignment is feasible. (Sec. 9.5 -293 (b)) (VARIANCE REQUEST SUBMITTED FOR ALIGNMENT REQUIREMENT) Agenda item 6F 7. Pipeline. Operating any heavy equipment, machinery or apparatus used in any exterior or outdoor construction, repair, remodeling, demolition, drilling, excavation, grading, earth moving, paving, cement laying or pouring, or other work of any nature during the nighttime or anytime on Sunday within 1,000 feet of any residential property. LAND USE CATEGORY: The subject parcels are designated Mixed Use, Medium Density Residential, and 100 -Year Flood Plain. The proposed location of the pad site is within the Mixed Use designation area. CURRENT ZONING: AG — Agricultural District CITIZEN INPUT/ BOARD REVIEW: Citywide Southlake Program for the Involvement of Neighborhoods (SPIN) meetings were held June 21, 2010 and June 28, 2010. Refer to the Consolidated Land Use Plan for Southlake 2025 - Resolution No. 07 -056, a policy on Natural Resource Extraction Activities; Ordinance No. 480 - RRR, which addresses the Specific Use Permit portion of the Consolidated Zoning Ordinance No. 480; and, Article IV of the City Code — Gas and Oil Well Drilling and Production for complete regulations. These documents have been previously distributed. STRATEGIC LINK: Quality Development TRANSPORTATION ASSESSMENT: A proposed Transportation Route has been submitted as Exhibit X. Truck traffic will utilize the SH114 Frontage Road to access E. Highland Street. Also White Chapel Boulevard between SH 114 and Highland Street is indicated as an alternate transportation route. The SH 114 turn -a- rounds at White Chapel Blvd. and N. Carroll Ave. intersections have also been identified as access routes to be used. Case No. Attachment A GAS10 -004 Page 1 WATER & SEWER: There are no permanent infrastructure plans proposed with this development. A licensed contractor will be maintaining sanitary waste removal from onsite toilet facilities; please refer to Exhibit O — Waste Management Plan. A water source plan has been submitted as Exhibit Q. The applicant proposes to purchase and truck in water from a nearby municipality as their primary source. Alternative sources shown on Exhibit Q are a 3" fastline from Milner's water well, as well as, a 3" fastline from the nearest City of Southlake fire hydrant. These alternative sources are proposed in the event that they become available /viable sources in the future. TREE PRESERVATION: A Tree Protection Plan has been submitted as Exhibit I. The plan states that thirty -five (35) protected trees six inches or greater in caliper were located within the proposed well pad (including a 6 -foot construction buffer) and access road construction area. All thirty -five (35) protected trees located within the site are to be removed. Commissioner Hudson amended his previous motion to include a time limit for providing violation information requested to the last ten (10) years; subject to the Specific Use Permit / Site Plan Review Summary dated November 12, Case No. Attachment A GAS10 -004 Page 2 2010; and approving variances 1 -5 as requested. There was no second to this motion — discussion commenced regarding taking action on the variance requests. Commissioner Hudson amended his motion to remove the approval of requested variances. There was no second to this motion. The Commission went into Executive Session... Chairman Faglie announced that with no second to the motion, the motion dies and asked if anyone had an additional motion. Commissioner Hudson made a motion to approve GAS10 -004 as previously stated. Chairman Faglie seconded the motion. Commissioner McCown voted yes but objected to the approval of the variance to the 1,000 foot setback. The question was raised at the P &Z meeting regarding their intended driveway material and the response given byXTO was crushed rock. The applicant made a verbal variance request regarding this Case No. Attachment A GAS10 -004 Page 3 requirement. Staff received a modified site plan December 21, 2010 which alters the distance from the closest well bore to the nearest residential structure to the south. The site plan in your packet identifies the distance as 332' which was originally measured to the detached garage. The modified plan identifies the actual distance to the habitable structure as 396'. The operator shall, within 120 days of its completion date, equip each well with a cathodic protection system to protect the production casing from external corrosion, unless the inspector approves an alternative method of protecting the production casing from external corrosion. The operator of a well shall provide the inspector with a "pre- drilling" and "post- drilling" water analysis and flow rate from any existing fresh water well within 2,000 feet of the well. (2) Well samples shall be analyzed prior to any drilling activity to document baseline water quality data of the well. A post - drilling sample shall be analyzed within three months after the drilling begins (Sec. 9.5 -242 (ff (2)). Be prepared to discuss well testing methodology for any applicable pre - drilling analyses. * Clarify water source proposed for on -site potable water needs. * Be prepared to discuss the proposed security system for this site to include the requirements set forth in Sec. 9.5 -242 (yy). * Be prepared to show horizontal renderings with heights, profiles, and colors of components proposed at the JGJ Unit Site specifically. * Be prepared to address type of grading to be performed and display 360 renderings of the JGJ Unit Site from street access points that display cut and fill impacts. * All development must comply with the Drainage Ordinance No. 605 and the Erosion and Sediment Control Ordinance No. 946, as amended. * With approval of a Gas Drilling Specific Use Permit / Oil and Gas Permit, one (1) well head is allowed. Each additional well head will require a separate Oil and Gas Permit (approved administratively) and a fee collected for $8500. The current application indicates eighteen (18) well heads; two (2) well heads are considered as fees collected with the SUP application submitted May 14, 2010. * A specific use permit shall automatically expire if a building permit is not issued and construction begun within six (6) months of the granting of the specific use permit or if the use shall cease for a period of six (6) months. * In reference to Exhibit "T ", the City of Southlake has not contracted with a gas inspector. Comments designated with a number may be incorporated into the formal review to be considered by either the Planning and Zoning Commission or City Council. Other items will not be addressed by either the P &Z or City Council. It is the applicant's responsibility to contact the department representative shown above and make modifications as required by the comment. TREE CONSERVATION COMMENTS: The applicant is proposing to remove two (2) 16" Hackberry trees for the construction of the drilling facility. Since the property that the well site is located is currently zoned AG- Agriculture, a total of seven (7) trees may be removed per calendar year upon the issuance of a Tree Permit by the City. The proposed removal of the two (2) Hackberry trees is compliant with The Tree Preservation Ordinance 585 -D, Section8.1c. Limited Tree Alteration on "AG" Zoned Property: The Administrative Official shall, upon request of the owner of property zoned Agricultural "AG" and being actively used for agricultural purposes, issue a tree permit for the alteration of not more than seven (7) protected trees per calendar year on such property. If the Administrative Official issues such a permit, the protected trees covered by the permit shall be exempt from the tree replacement and tree protection requirements. However, protected trees altered in excess of seven (7) per calendar year are not exempted from the tree replacement and tree protection requirements. An owner wishing to remove more than seven protected trees in any calendar year shall apply for and obtain a tree permit or Multiple Tree Clearing permit and comply with this Ordinance. Please be aware that all existing trees shown to be preserved on the City Council approved Tree Conservation Plan must be preserved and protected during all phases and construction of the development. Alteration or removal of any of the existing trees shown to be preserved on the approved Tree Conservation Plan is a violation of the Tree Preservation Ordinance and the zoning as approved by the Southlake City Council. Please ensure that the layout of all structures, easements, utilities, structures grading, and any other structure proposed to be constructed do not conflict with existing trees intended to be preserved. LANDSCAPING: The proposed landscaping submitted with the Gas Drilling and Production SUP Application conforms to the current Consolidated Land Use Plan recommendations for landscaping surrounding the perimeter of natural resource extraction utilities. See attached Figure 1. The submitted Variance Request for JGJ Drillsite, proposes to install only 12' Leland Cypress trees around the perimeter of the facility. This is not compliant with the Consolidated Land Use Plan recommendations for landscaping surrounding the perimeter of natural resource extraction utilities. Please ensure that the proposed landscaping complies with the Consolidated Land Use Plan recommendations. INFORMATIONAL COMMENTS: Southlake's peak water usage is between May 1 — October 15. The City of Southlake fully utilizes its water during the peak usage timeframe and does not have the opportunity to provide water for drilling or fracing purposes without diminishing its ability to provide service to our own citizens. Consider keeping traffic of any kind to a minimum during high - traffic hours. Consider not moving large equipment in or out of the site during these hours. Consider using a quiet rig; especially consider taking all steps necessary to reduce noise to the maximum extent practicable. TREE CONSERVATION COMMENTS: The approval and construction of the proposed natural resource extraction pipeline is regulated by the Tree Preservation Ordinance 585 -D. Since the pipeline is not a public Utility that serves the public, The pipeline is not a Utility Service Line, and the company constructing the pipeline is not a Utility Provider, the alteration of protected trees within the right -of -way and /or easement where the pipeline is located and any other trees altered due to the proposed pipeline construction are not exempt from the regulations of the Ordinance 585 -D and are required to be mitigated. UTILITY The service or product provided by a utility provider, including but not limited to, the provision of gas, electric, water, waste water, drainage, storm water, telecommunications, cable, or telephone service for users within the City. UTILITY SERVICE LINE A conduit, channel, ditch, tube, duct, hose, wire, box, pipe, or similar conveyance device through which a utility is transported, provided, or conveyed to a single lot or tract, to the extent that the conveyance device is located on that lot or tract. UTILITY PROVIDER A company or entity, or agent for a company or entity, including a municipality that provides a utility service within the City. A Tree Conservation Plan must be submitted that provides the following information. A.) All individually protected trees identified by species and trunk diameter, measured from the outer edge of any improvements, construction areas, development, equipment, materials, temporary roads, access easements and /or built structures, extending 25 feet, without regard to intervening structures or objects. B.) Clear delineation for each protected tree of whether the tree will be preserved after the proposed pipeline is constructed, altered due to proposed improvements, or could be potentially saved based upon site specific conditions. Detailed site plan of all proposed improvements /location of pipeline, bore entries, trenching/boring, and construction buffers. D.) All trees altered in order to construct and use the proposed pipeline are required to be mitigated in compliance with the regulations of the Tree Preservation Ordinance 585 -D. The tree replacement requirements are as follows: SIZE AND NUMBER: A sufficient number of trees shall be planted to equal or exceed, measured in DBH, the diameter of each tree altered. Each replacement tree shall be a minimum of three inch (Y) caliper at 6 inches above ground level, and seven feet in height when planted. LOCATION: Each replacement tree should be planted on the same lot or tract as the tree which was altered. However, if the replacement tree cannot be planted on the same lot or tract in accordance with universally accepted arboricultural standards, the Administrative Official may require any or a combination of the following: a. Replacement on other private property within the City of Southlake, with the approval of the owners of both the property on which the protected tree was altered and the property on which the replacement tree is to be planted. In such an instance, the owner of the property on which the replacement tree is to be planted shall agree, in writing, to maintain the replacement tree to the standards established in this Ordinance, b. Replacement on public property, or c. Payment to the Reforestation Fund. The Tree Conservation Plan is a portion of the Pipeline Permit request for the construction of the natural resource extraction pipeline and associated structures. The Planning and Zoning Commission will make a recommendation on the proposed Tree Conservation Plan to the City Council.
