Pre filing of House Bills in November
H.B. 49 (Pena) Would make synthetic cannabinoids that are structurally and clinically
similar to Marihuana and their analogues and homologues subject to penalty group 2 of
the Texas Controlled Substances Act.
H.B. 108 (Brown) Would make a synthetic derivative of marihuana, 1- pentyl -3 -(1-
naphthoyl) indole, subject to Penalty Group 2 of the Texas Controlled Substances Act.
DEA used its emergency powers on November 24th to make it illegal to possess or sell the
five chemicals used to make K -2 and other "fake pot" products that mimic the effects of
Marijuana for one year. This gives the Department of Health and Human Services time to
evaluate whether the chemicals should be permanently added to the federal list of
controlled substances considered unsafe, highly abused and without medical use.
