REQUEST: Variance to the Sign Ordinance No. 704 -B requirements for letter /logo height, sign
area, and sign width. The tenant is located in the Carroll Oaks shopping center at the
southwest corner of the intersection of Carroll Avenue and eastbound access road of
S.H.114. This is a variance for letter height, sign area and sign width. With regard
to the sign width, the sign must be within the middle 75% of the lease space and if
the facade is articulated, must be within the middle 75% of the articulated facade
wall. The lease space is 21 feet in width and the sign must fit within the middle 16
feet of the lease space width. However, lease space spans 21 feet of a 25 feet
articulated facade wall. The remaining 4 feet of the facade wall is part of the
adjoining lease space. The sign is placed within the middle 84% of the articulated
facade wall, but encroaches approximately 2 feet into the adjoining lease space. The
applicant has received permission of the building owner and the adjacent tenant for
the encroachment. The specific variances requested are as follows:

BACKGROUND INFORMATION
OWNER/APPLICANT: Gobs of Gifts
PROPERTY SITUATION: The owner's business, Gobs of Gifts, is located in the Carroll Oaks shopping
center at the southwest intersection of S.H 114 and Carroll Avenue. The
property address is 1101 E. S.H. 114, Suite 114.
REQUEST: The applicant, on behalf of Slender Lady, is requesting a variance from the
letter height and logo height standard of Sign Ordinance No. 704 -B.
STAFF COMMENTS: The sign criteria, building elevations, site plan and applications are attached
to this report. The following variances to the Sign Ordinance No. 704 -B are
requested:
• Ord. 704 -13, Section 16.A.2 MAXIMUM LETTER /LOGO HEIGHT The
maximum permitted letter height is 12 inches for a sign less than 100 feet
from the right -of -way.
The store front is approximately 60 feet from the street right -of -way. The
maximum letter and logo size permitted is 12 inches. The applicant is
requesting a letter height of approximately 24 inches.
• Ord. 704 -13, Section 16.A.3 MAXIMUM AREA The maximum
permitted area is 0.75 square feet for every one foot of width of building
or lease space not to exceed 400 square feet.
The store front is approximately 21 feet wide. The maximum sign area
permitted is 16 square feet. The applicant is requesting a sign area of
approximately 51 square feet.
• Ord. 704 -13, Section 16.A.5 SIGN WIDTH Attached signs shall be
limited in width to the middle seventy five percent (75 %) of the width of
any building or lease space.
The maximum width of the sign permitted is 16 feet. The width of the
sign is approximately 21 feet. The sign also encroaches into the store
front area of the adjacent tenant to the north (Nicole Day Spa). The
applicant is requesting the sign be centered between the two brick
columns of the fa(ade.
The City Council may authorize variances in accordance with the following
provision of the Sign Ordinance No. 704 -13, Section 14, Variances:
The City Council may authorize variances to any restriction set forth in this
ordinance, including but not limited to the number, type, area, height, or

setback of signs, or any other aspect involved in the sign permitting process.
In granting any variance, the City Council shall determine that a literal
enforcement of the sign regulations will create an unnecessary hardship or a
practical difficulty on the applicant, that the situation causing the
unnecessary hardship or practical difficulty is unique to the affected property
and is not self - imposed, that the variance will not injure and will be wholly
compatible with the use and permitted development of adjacent properties,
and that the granting of the variance will be in harmony with the spirit and
purpose of this sign ordinance. A person may request a variance from the
Sign Ordinance by filing the request with the Building Official. Any request
for variance shall be accompanied by a completed application and a non-
refundable filing fee in the amount specified in the current fee schedule
adopted by City Council.

To Whom It May Concern:
I have discussed the 24" Letter Sign for Gobs of Gifts, as well as the intent to center it
between the two building columns. I understand that this placement of the sign will
overlap a portion of my front window. I agree with Gobs of Gifts' owners that the
overall appearance of the sign on the building is more appropriate if it is centered
between the two building columns. I give them my approval to overlap the small portion
of my front window.

Sign Variance Application
Demonstration
Please demonstrate that the following conditions are applicable to the requested sign
variance;
1. That a literal enforcement of the sign regulation will create an unnecessary
hardship or practical difficulty on the applicant.
• We are moving our existing new business to Southlake from Hurst. We
have lived in Southlake for almost 6 years and we believe this move will
grow our business. Since we spent more than $6000 dollars less than one
year ago to purchase our existing sign, spending thousands more would be
nearly impossible at this time of transition.
2. That the situation causing the unnecessary hardship or practical difficulty is
unique to the affected property and is not self imposed.
Our business is currently in Hurst in the same type of location as the one
that we are moving to in Southlake. We believe that our sign will fit well
since this shopping center is very similar. We also believe that our sign
will fit well since it is very similar to the signs in and around our new
location. In agreement with this assessment, the property management
company (Graham Investments) has already approved utilizing our
existing sign. Also, due to the landscape around the street and the
proximity to Hwy 114, we believe that our existing sign will allow people
to see it well through any obstructions.
3. That the variance will not injure and will be wholly compatible with the use of
permitted development of adjacent properties.
• Although our sign is larger than the criteria allowed for in the sign
ordinance, all of the other signs in the shopping center are as well.
Allowing use of our current sign will keep uniformity among within the
shopping center and will not hinder any other complexes built.
4. That the variance will be in harmony with the spirit and purpose of the sign
ordinance.
• We have discussed our current sign with our neighboring tenants as well
as with the management company and they agree that it fits well with the
existing signs. Based on the curb appeal of our sign at our current
location, we believe that it supports the spirit and purpose of the
ordinance.
