Item 9A MemoCity of Southlake, Texas MEMORANDUM November 9, 2004 TO: Billy Campbell, City Manager FROM: Kevin Hugman, Director of Human Resources SUBJECT: Resolution No. 04 -071, Amending City of Southlake Personnel Policies to adopt a Workplace Conduct Policy, incorporating and superceding the current Sexual Harassment Policy and EEO Discrimination Complaint Procedure. Action Requested: City Council approval of Resolution No. 04 -071, amending the Personnel Policies to adopt the Workplace Conduct Policy. Background Information: The City currently has in place an Equal Employment Opportunity statement, as well as an EEO Discrimination Complaint Procedure, adopted in 1990, and a Sexual Harassment Policy adopted in 1997. While these policies have served the City well, it has become necessary to broaden the scope of these policies and to include more contemporary issues such as workplace violence. The proposed Workplace Conduct policy will: • Prohibit all forms of harassment whether it be sexual, racial, gender, disability, age, or any other basis protected by federal law; • Define types of harassment to include offensive language, taunting or gestures, or possession in the workplace of offensive materials such as posters, cartoons, etc. • Prohibit workplace violence including threats, sabotage or physical violence; • Provide a mechanism for the reporting, investigation, and appeal of findings regarding any alleged violations of the policy; and • Prohibit retaliation against any person who reports a violation of the policy or assists in an investigation. The proposed policy encompasses and protects all employees, elected officials, and volunteers of the City. Financial Considerations: Not Applicable. Citizen Input/ Board Review: Not Applicable. Legal Review: The City Attorney has reviewed the policy. Alternatives: Input as desired by Council.
