Local Business Report. The Economic Development Department will be introducing Troy Kingsley and /or Mike Swirczynski with Dueling Chefs. 5A. Approve the minutes for the November 3, 2004, special City Council meeting and the November 8, 2004, special City Council meeting_ The minutes were included in your packet. Contact Lori Farwell with questions on this item. 7A. ZA04 -073, Site Plan for Lot 2R, Block 5, Cornerstone Business Park. This property is located on the east side of South Nolen Drive, across from the intersection of South Nolen Drive and Silicon Drive. A concept plan and S -P -2 zoning with limited I -1, 0-1 and C -2 uses for the complex were approved in June. This is the first site plan for construction of a 26,400 square feet office /warehouse building within a five building office /warehouse complex that totals approximately 126,000 square feet of floor area. The applicant has met all applicable site plan requirements. Planning and Zoning Commission members had concerns about internal maneuvering of trucks into the loading dock areas. Their recommendation for approval was (6- 0) subject to review; requiring signage that directs trucks in such a manner as to facilitate truck traffic while promoting safety. Contact Ken Baker or Dennis Killough with questions on this item. 8A. Ordinance No. 480- 421A,(ZA04 -089), 1` Reading, Zoning Change and Development Plan for Estes Park, Phase I Addition. The primary purpose of this request is to amend the rear -yard setback requirements to match that of Estes Park Phase IL The proposal is to change the minimum rear -yard setback of 40 feet to 30 feet, with the exception of two lots abutting residents that have requested minimum rear yard setbacks of 60 feet and two lots containing 20 -feet wide "No Disturbance /Tree Preservation" areas along the rear property lines. The Honorable Mayor and Members of City Council Agenda Item Comments City Council meeting November 16, 2004 Page 2 of 5 applicant has indicated the reduction is to allow builders more flexibility in shaping and placing homes on the lots to save certain trees. Further clarification on fencing requirements has also been provided. The Planning and Zoning Commission recommended approval (6 -0) as presented, subject to development plan review summary No. 1, dated October 29, making the following changes to the document that was distributed, titled Residential Planned Unit Development District For Estes Park Phase One : 1. Under Rear Yard - amend to read: The rear yard shall not be less than 30 feet except on Lots 13 and 14, Block 1, as shown on the attached development plan which shall have a rear yard of not less than 60 feet; 2. Lots 14 and 15, Block 1, as shown on the attached development plan, shall have a "no disturbance /tree preservation area" along the rear property line of not less than 20 feet in width; 3. Under Perimeter Fencing - amend to read: All fencing surrounding the project and internally, if built in the residential PUD, shall be six foot wrought iron fencing except Lots 1, 2, and 3, Block 3, as shown on the attached development plan, which shall be eight foot brick or wrought iron or a combination of both. Furthermore, the developer has also committed to build a wrought iron fence on the rear of Lots 15 through 20, Block 1 and along the west side of Lot 14, Block 1, as shown on the attached development plan, as a part of the subdivision construction rather than the individual home construction. Resolution No. 04 -071, Amending City of Southlake Personnel Policies to adopt a Workplace Conduct Policy, incorporating and superseding the current Sexual Harassment Policy and EEO Discrimination Complaint Procedure. The current City Personnel Policies include an EEO Discrimination Complaint Procedure, adopted in 1990, and a Sexual Harassment Policy, adopted in 1997. While these policies have served us effectively, it is desirable to include broader terms of harassment and discrimination into the written policy, as well as to address Honorable Mayor and Members of City Council Agenda Item Comments City Council meeting November 16, 2004 Page 3 of 5 contemporary issues such as workplace violence. The proposed Workplace Conduct Policy was developed to accomplish this goal and to also eliminate duplication and potential conflict between policies related to equal employment protection. The proposed policy defines and prohibits all forms of harassment based on race, color, national origin, religion, sex, disability or age; prohibits workplace violence; and provides a means for the reporting, investigation, and appeal of alleged violations of the policy. Consider excusing members of the City Council and of the Planning and Zoning Commission for absences from meetings No absences to report this period. 1013. Consider SPO4 -267, Variance to the Sign Ordinance 704 -B for Gobs Of Gifts located at 1110 East State Highway 114. The tenant is located in the Carroll Oaks shopping center at the southwest corner of the intersection of Carroll Avenue and eastbound access road of SH 114. This is a variance for letter height, sign area and sign width. With regard to the sign width, the sign must be within the middle 75% of the lease space and if the facade is articulated, must be within the middle 75% of the articulated facade wall. The lease space is 21 feet in width and the sign must fit within the middle 16 feet of the lease space width. However, the lease space spans 21 feet of a 25 feet articulated facade wall. The remaining 4 feet of the facade wall is part of the adjoining lease space. The sign is placed within the middle 84% of the articulated facade wall, but encroaches approximately 2 feet into the adjoining lease space. The applicant has received permission from the building owner and the adjacent tenant for the encroachment. Consider SPO4 -268, Variance to the Sign Ordinance 704 -B for Shogun Restaurant located at 2970 East Southlake Boulevard. This site is located at 2970 East Southlake Boulevard in Gateway Plaza Phase L This is a request to amend the approved conditional sign permit with respect to the permitted sign location along Southlake Boulevard. The current conditional sign permit restricts the sign to be within the center area of the wider wall plane of the building facade. This proposal would allow a vertical sign as an alternative sign area in one of the pilasters of the facade. This request appeared before the City Council in July and was denied. The sign was erected without a permit and the applicant was not present to represent the variance request. Contact Ken Baker or Dennis Killough with questions on this item. lOD. Authorize the Mayor to enter into TIF development and 380 agreements and the associated parking agreement with SLTS Grand Avenue District, L.P., for the development of the Grand Avenue District. As directed by Council, staff has notified the developer that all proposed revisions to the agreements must be received no later than 8:00 a.m. on Friday.
