The property address is 1800 E. S.H. 114, Suite 102. REQUEST: The applicant, on behalf of Velocity Sports Performance, is requesting a variance from the letter /logo height and number of signs standard of Sign Ordinance No. 704 -13. STAFF COMMENTS: The sign criteria, building elevations, site plan and applications are attached to this report. The following variances to the Sign Ordinance No. 704 -B are requested: • Ord. 704 -13, Section 16.A.2 MINIMUM/MAXIMUM LETTER/LOGO HEIGHT The minimum height allowed for letters or logos shall be six (6) inches. The maximum permitted letter height is 12 inches for a sign less than 100 feet from the right -of -way. The store front is approximately 55 feet fi°om the street right -of -way. The maximum letter /logo size permitted is 12 inches. The applicant is requesting a letter /logo height of approximately 20 inches. The applicant is also requesting a minimum letter height of 3 � inches. • Ord. 704 -13, Section 16. A.4. NUMBER OF SIGNS Only one attached sign per lease space shall be allowed along each street frontage on any site. A secondary sign may be permitted at a public entrance, provided the entrance is on another side of the building, but shall be limited to 25% of the primary or permitted sign ..... No more than two (2) attached signs shall be allowed per lease space. The applicant is permitted only one (1) sign facing S.H. 114, but is requesting three (3) attached signs on the same portion of the building fa(ade facing S.H 114. The City Council may authorize variances in accordance with the following provision of the Sign Ordinance No. 704 -13, Section 14, Variances: The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. In granting any variance, the City Council shall determine that a literal enforcement of the sign regulations will create an unnecessary hardship or a practical difficulty on the applicant, that the situation causing the unnecessary hardship or practical difficulty is unique to the affected property Case No. SPO4 -229 Attachment A Page 2 and is not self - imposed, that the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties, and that the granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. A person may request a variance from the Sign Ordinance by filing the request with the Building Official. Any request for variance shall be accompanied by a completed application and a non- refundable filing fee in the amount specified in the current fee schedule adopted by City Council. A ground sign has no visibility as it is below grade of Hwy 114 and therefore would have no visual impact for traffic and the client that is seeking our business for the first time. The main sign and 2 secondary readers are requested to get the message to the target market what our facility contains. We couldn't design a single sign unit because of the limitations of the facia (where sign installs) is only three feet in height.The 3 signs combined fall well within the allocation as specified by the City of Southlake codes. Another hardship to consider is the letter size, based on city code, no letter shall be greater than 12" for signs less the 100' from ROW (Velocity falls into this category), our request for approval has one letter (the "V" with swish /logo) that exceeds the 12" and it is 20 ". 2. The practical difficulty is unique to our cause because the building itself has limited surfaces for our signage needs, as an existing building, it has been difficult to create a situation that conforms totally to the City of Southlake sign codes. The logo is predicated by a franchise agreement and can not be altered. In order to get the letters large enough for readership (visibility) and stay in with the franchise agreement, the "V" is a larger letter /logo then our setback ROW allows by B ". There are "no" immediately adjacent properties (vacant lots on each side) that would be injured or affected by this request. Piano Gallery located one block east of Kimball on the service road of Hwy. 114 obviously sought and received a variance (photo attached) that exceeds the Southlake code and is far greater in dimension then our request. 4. The variance is a request for minor adjustments in letter size (one letter) and the number of signs as the the building has limited sign space for Velocity to get its identity to the public. We believe the harmony and spirit of the sign ordinance of Southlake remains intact if this variance request is granted and that the purpose of this variance submittal is to allow Velocity the best possible signage given the circumstances and visibility hard ships. It would be most appreciated if The City of Southlake grants this variance and realizes the improvement the Velocity facilty and the signage will bring to the Hwy. 114 corridor.
