PROPERTY SITUATION: The owner's business, Next Century Dental, is located approximately 900 feet east of the intersection of Shady Lane and the westbound access road of E. State Highway 114. The property address is 2680 E. State Highway 114. REQUEST: The applicant, on behalf of Next Century Dental, is requesting avariance from the letter height and logo height standard and the number of signs allowed for attached signs as found in Sign Ordinance No. 704 -B. STAFF COMMENTS: The sign criteria, building elevations, site plan and applications are attached to this report. The following variances to the Sign Ordinance No. 704 -B are requested: • Ord. 704 -13, Section 16.A.4 NUMBER OF SIGNS Only one attached sign per lease space shall be allowed along each street frontage on any site. The applicant is requesting to have a total of two (2) attached signs on the fa(ade facing E. State Highway 114. Sin #1 • Ord. 704 -13, Section 16.A.2 NIAXNIUM LETTER/LOGO HEIGHT The maximum permitted letter or logo height is 12 inches for a sign less than 100 feet from the right -of -way. The proposed sign will be approximately 60 feet from the street right -of- way. The maximum letter size permitted is 12 inches. The applicant is requesting a letter height of approximately 24 inches. Sin #2 • Ord. 704 -13, Section 16.A.2 N[AXPV1UM LETTER/LOGO HEIGHT The maximum permitted letter or logo height is 12 inches for a sign less than 100 feet from the right -of -way. The proposed sign will be approximately SS feet from the street right -of- way. The maximum letter or logo size permitted is 12 inches. The applicant is requesting a letter and logo height of approximately 24 inches. The City Council may authorize variances in accordance with the following provision of the Sign Ordinance No. 704 -13, Section 14, Variances: Case No. Attachment A SPO4 -209 Page 1 The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. In granting any variance, the City Council shall determine that a literal enforcement of the sign regulations will create an unnecessary hardship or a practical difficulty on the applicant, that the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self - imposed, that the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties, and that the granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. A person may request a variance from the Sign Ordinance by filing the request with the Building Official. Any request for variance shall be accompanied by a completed application and a non - refundable filing fee in the amount specified in the current fee schedule adopted by City Council. That a literal enforcement of the sign regulation will crate an unnecessary hardship or practical difficulty on the applicant. Due to the location and distance from the freeway, larger letters are required to be visible. Hwy 114 traffic is moving so quickly that a small sign would be impossible to read. our building has a 15' plat line and a 130' frontage. The sign will look totally out of proportion and quite ridiculous if it is that small as the sign ordinance dictates. 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. We have established a logo and a brand with our signs on our other two locations. If would berinconsistant not to follow the same with the new location. We have multiple businesses under one roof (braces/general dentistry, etc.) we must have at least two signs on the more than 130' frontage. 3. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. Quite the contrary, if the sign ordinance is followed as writtep, our sign would not fit in with the signs on the adjacent and immediate existing properties None of the immediate properties within sight of our location have signs that conform to this current ordinance. 4. That the variance will be in harmony with the spirit and purpose of the sign ordinance. Nothing we are proposing will violate the spirit or harmony of the sign ordinance. The city should be proud of our building, using it as an example of what they should want for future development. our proposed signs will compliment what we have built.
