PROJECT: The Offices at Byron Nelson
REQUEST: This is a request that further amends the previously approved variance (SPO4 -081)
for the Office at Byron Nelson, located at 630 E. Southlake Boulevard. Specifically,
this application seeks a variance to allow a front setback of 6.5 feet where the
requirement is 15 feet from the front property line (Sign Ordinance No. 704 -B). This
request also maintains the previously approved variances to the number and setback
of the proposed four (4) monument signs.

BACKGROUND INFORMATION
APPLICANT:

PROPERTY SITUATION: The Offices at Byron Nelson is located on the northwest corner of E.
Southlake Boulevard and Diamond Boulevard. The property address is 630
E. Southlake Boulevard.
REQUEST: The applicant is proposing a total of four (4) monument signs on the
property. The proposed number of monument signs exceeds the maximum
number allowed and the signs do not meet the minimum setback requirement
of 15 feet from the property line. Approval of a variance is required in order
to receive a building permit for the signs.
COUNCIL ACTION: May 4, 2004; Approved (6 -0 -1) SPO4 -081, variance to Sign Ordinance
No. 704 -B with respect to the number of signs and the set back on the
westernmost sign; accepting the applicant's offer to waive any signage on
the building.
Consider Sign Ordinance Variance SPO4 -185.
STAFF COMMENTS: The site plan, sign elevations and application are attached to this report. The
following variances are requested:
• Ord. 704 -13, Section 16.13.5 NUMBER OF SIGNS Only one (1)
monument sign shall be allowed along each street frontage per site.
The applicant is proposing four (4) monument signs along E. Southlake
Blvd.
• Ord. 704 -13, Section 16.13.6 MINIMUM SETBACK The minimum
setback for monument signs is fifteen (15) feet from any property line.
The western -most sign structure is to be located on the west property
line.
All the proposed signs will be located 6' -6 "from the frontproperty line
The City Council may authorize variances in accordance with the following
provision of the Sign Ordinance No. 704 -13, Section 14, Variances:
The City Council may authorize variances to any restriction set forth in this
ordinance, including but not limited to the number, type, area, height, or
setback of signs, or any other aspect involved in the sign permitting process.
In granting any variance, the City Council shall determine that a literal
enforcement of the sign regulations will create an unnecessary hardship or a
practical difficulty on the applicant, that the situation causing the
unnecessary hardship or practical difficulty is unique to the affected property
and is not self - imposed, that the variance will not injure and will be wholly

compatible with the use and permitted development of adjacent properties,
and that the granting of the variance will be in harmony with the spirit and
purpose of this sign ordinance. A person may request a variance from the
Sign Ordinance by filing the request with the Building Official. Any request
for variance shall be accompanied by a completed application and a non-
refundable filing fee in the amount specified in the current fee schedule
adopted by City Council.
