PROJECT: Maverick Commercial Real Estate
REQUEST: Variance to the Sign Ordinance No. 704 -B requirements for sign height of a
temporary real estate sign. The applicant is representing a property owner whose
property is located at 1680 -1750 E. S.H 114, along the west bound access road,
between N. Kimball Ave and N. Carroll Ave. The proposed sign is to be a "V"
shaped sign with each sign face of 32 square feet for a total of 64 square feet of sign
area as permitted under Ordinance 704 -B. However, the applicant is requesting a
variance from the height requirement for real estate signs. The specific variance
requested is as follows:

BACKGROUND INFORMATION
OWNER/TENANT: Maverick Commercial Real Estate
APPLICANT: Mark Aston, Maverick Commercial Real Estate
PROPERTY SITUATION: The applicant is marketing vacant properties owned by Greenway -Berk
Partners, LP. located between 1680 and 1750 E. S.H. 114. The properties
total about 24 acres and front on the west -bound frontage road of S.H. 114.
Immediately west of the subject property is the Aventerra property.
REQUEST: The applicant, on behalf of Greenway -Berk Partners, LP., is requesting a
variance from the sign height standard for temporary real estate signs of Sign
Ordinance No. 704 -B.
STAFF COMMENTS: The sign details, site plan, and applications are attached to this report. The
following variances to the Sign Ordinance No. 704 -B are requested:
• Ord_ 704 -B, Section 22.C.2(b) MAXIMUM HEIGHT Five (5) feet
above grade for ground signs; below roof line for attached.
The maximum sign height as measured from the top of the sign to the
ground level is five (5) feet. The applicant is requesting a total sign
height of 7 feet and 9 inches (total of 93 inches).
The City Council may authorize variances in accordance with the following
provision of the Sign Ordinance No. 704 -13, Section 14, Variances:
The City Council may authorize variances to any restriction set forth in this
ordinance, including but not limited to the number, type, area, height, or
setback of signs, or any other aspect involved in the sign permitting process.
In granting any variance, the City Council shall determine that a literal
enforcement of the sign regulations will create an unnecessary hardship or a
practical difficulty on the applicant, that the situation causing the
unnecessary hardship or practical difficulty is unique to the affected property
and is not self - imposed, that the variance will not injure and will be wholly
compatible with the use and permitted development of adjacent properties,
and that the granting of the variance will be in harmony with the spirit and
purpose of this sign ordinance. A person may request a variance from the
Sign Ordinance by filing the request with the Building Official. Any request
for variance shall be accompanied by a completed application and a non-
refundable filing fee in the amount specified in the current fee schedule
adopted by City Council.
