Item 10DCity of Southlake, Texas MEMORANDUM August 17, 2004 To: Billy Campbell, City Manager From: Pedram Farahnak, P.E., Director of Public Works Subject: Award bid for North Carroll Avenue paving, drainage, water and sewer improvements from Federal Way to SH 114 to Mike Albert, Inc. Action Requested: Award bid for North Carroll Avenue paving, drainage, water and sewer improvements from Federal Way to SH 114 to Mike Albert, Inc. Background Information: Funds were included in the FY 02/03 CIP for the engineering design and right of way acquisition on North Carroll Avenue from Federal Way to SH 114. In the FY 03/04 CIP, funds were included for the reconstruction of North Carroll Avenue from Federal Way to SH 114 and construction of a 12" water line and an 8" sanitary sewer line along that section of roadway. On March 18, 2003, the City Council approved a professional services contract with Graham Associates for the design and preparation of construction plans and specifications. The design, right of way acquisition and utility relocation is complete. Construction time for completion of the work is 270 calendar days. Five Bids were received on July 2, 2004. The bids have been reviewed by Graham Associates and City Staff and are tabulated as follows: BIDDER JLB Contracting, LP Mike Albert, Inc. L. H. Lacy Tiseo Paving McClendon Construction Co. BID AMOUNT $2,019,541.89 $2,052,081.55 $2,076,568.15 $2,150,478.00 $2,219,540.20 It is recommended that Council decline award of contract to JLB Contracting, LP formerly known as J.L. Bertram Construction Company and award the contract to the second low qualified bidder, Mike Albert, Inc. The reason for the above recommendation as shown below is poor performance by JLB Contracting, LP on two previously completed projects: 1) Rehabilitation of W. Continental Boulevard from Peytonville Avenue to White Chapel Boulevard. 2) Dove Road pavement widening from SH 114 to the intersection with Kirkwood: • Exceeded contract time on one project by 244%. The required completion time was 150 days; project was completed in 367 calendar days. • Staff received many complaints about the conduct of contractor's staff, contractor's inability to provide needed access to the area residents and leaving project site in poor condition. • Contractor failed to provide adequate qualified supervision on the project. • Contractor left project site for extended period of time to complete other projects for other customers. • Finished product on both projects was very poor, required rework which left the finished work having the appearance of a patched pavement. • Contractor used any minor excuse to harass various city departments' staff if payment was declined for violation of contract document or unacceptable work. • The contract award is based on the base bid which includes a deductive alternative for construction of an 8-inch and 12-inch sanitary sewer main from the intersection of Carroll Avenue and SH 114 to the N-4 interceptor in the amount of $177,783.00. This alternative was obtained at the request of the developer of Greenway, but the developer has declined the alternative due to financial considerations. Financial Considerations: Therefore, the recommended award amount is the base bid, $2,052,081.55 less $177,783.00 for the deductive alternative or the total amount of $1,874,298.55. It is also recommended that the City Council allow a construction phase contingency of 10% or $187,000 in addition to the total award of $1,874,298.55.
