sign area. The applicant is requesting to move the existing non - conforming sign to its
new storefront in the same shopping center (Carroll Oaks) located at the southwest
intersection of Carroll Avenue and eastbound access road of S.H.114. The specific

BACKGROUND INFORMATION

APPLICANT: Glenda Petkus
PROPERTY SITUATION: The applicant's business, State Farm Insurance, is located in the Carroll Oaks
shopping center at the southwest intersection of S.H 114 and Carroll Avenue.
The property address is 1101 E. S.H. 114, Suite 108.
REQUEST: This request stems from a reorganization of different tenant spaces in the
Carroll Oaks shopping center. The applicant's business is moving to an
adjacent tenant space, making way for the expansion of Nicole Day Spa (Sign
Permit Variance SPO4 -107). The applicant is requesting to move the existing
non - conforming sign to the new tenant space.
STAFF COMMENTS: The sign criteria, building elevations, site plan and applications are attached to
this report. The following variances to the Sign Ordinance No. 704 -B are
requested:
• Ord. 704 -B, Section 16.A.2 N[AXLMUM LETTER/L.OGO HEIGHT The
maximum permitted letter height is 12 inches for a sign less than 100 feet
from the right -of -way.
The store front is approximately 70 feet from the street right -of -way. The
maximum letter and logo size permitted is 12 inches. The applicant is
requesting a letter height of approximately 24 inches and a logo height of
36 inches.
• Ord. 704 -13, Section 16.A.3 MAXIMUM AREA: The maximum area
allowed shall be 0.75 square feet for every one (1) foot of width of
building or lease space not to exceed 400 square feet.
The new storefront width is 50 feet and the allowable sign area is 37.5
square feet. The square footage of the proposed sign is approximately 65
square feet.
The City Council may authorize variances in accordance with the following
provision of the Sign Ordinance No. 704 -13, Section 14, Variances:
The City Council may authorize variances to any restriction set forth in this
ordinance, including but not limited to the number, type, area, height, or
setback of signs, or any other aspect involved in the sign permitting process.
In granting any variance, the City Council shall determine that a literal
enforcement of the sign regulations will create an unnecessary hardship or a
practical difficulty on the applicant, that the situation causing the unnecessary

hardship or practical difficulty is unique to the affected property and is not
self- imposed, that the variance will not injure and will be wholly compatible
with the use and permitted development of adjacent properties, and that the
granting of the variance will be in harmony with the spirit and purpose of this
sign ordinance. A person may request a variance from the Sign Ordinance by
filing the request with the Building Official. Any request for variance shall be
accompanied by a completed application and a non - refundable filing fee in the
amount specified in the current fee schedule adopted by City Council.

retained their suite number, as they are moving to the adjacent space), and our request for
a permit to relocate their previously approved signage, it is my understanding that we
must apply for a sign variance. Accordingly, I am enclosing the following to request a
variance:

The following checklist is a summary of requirements for sign variance requests as required by
the City of Southlake. The applicant should further refer to the Sign Ordinance No. 704-A and
amendments, and other ordinances maps, and codes avallabte at the City ]-Fall that may pertain to
this sign variance request. In addition to paper submittals please submit electronic copies
attached to an email addressed to SkipVandergrifftf- ci.southlake.tx.us Graphics should be in
Jpeg or .bit format.
Completed sign variance request application.
Completed demonstration of conditions applicable to the requested variance (see
attached.)
Site plan showing the location of the sign variance request and any other sign
that conform to or are exempt from the sign ordinance. The site plan shall also
indicate the building, landscaped areas, parking & approaches and adjoining
street R. O. W.
Scaled and dimensioned elevations of the signs for which the variance is
requested. For attached signs, the elevations shall show the building in a full
panoramic view with a rendition of the sign for which the variance is requested,
and any other signs that conform to or are exempt from the sign ordinance.
Existing signs will require a before and after rendition.

Demonstration
Please demonstrate that the following conditons are applicable to the requested sign
variance:
1, That a literal enforcement of the sign regulation will crate an unnecessary hardship or
practical difficulty on the applicant.
The existing signage was approved and installed in 1991, for a space 26' wide.
The request to relocate this sign to the adjacent space of 31'+ in width will
be fairly inexpensive. To order new signage would be cost prohibitive.
Two tenants occupying space facing 'Carroll Avenue have just recently abandoned
their business. Their signs currently adhere to code and are 12' high. These
signs are unreadable from the street. Ms. Petkus has built a good business,
and current signage has been a positive factor.
2. That the situation causing the unnecessary hardship or practical difficulty is unique to the
affected property and is not self imposed.
Tenant is being moved to the adjacent space at Landlord's request to enable t
neighbor on the other side to expand. The existing signage is comparable to
other signage installed on'the building at the same time.
The intersection at which this property is located is partly a state highway
and traffic is heavy on the frontage road. Also, the overpass over SH114 now
a "safety" shield wall that blocks the shopping center from view until the
driver is sitting at the traffic signal,
3. That the variance will not injure and will be wholly compatible with the use and permitted
development of adjacent properties.
Frontage of the new space is approximately 160' from the street intersection
SH114 and Carroll Avenue, which has undergone construction directing Carroll
over SH114. Construction of Carroll Ave. is set to begin in the near future.
Additionally, a tree partially blocks signage on this space.
When construction of Carroll Avenue begins, 12' signage will be totally
unreadable by traffic.
4. That the variance will be in harmony with the spirit and purpose of the sign ordinance,
The existing signage is placed on a frontage of 26' and would be relocated to
frontage of 31' +...The total frontage of the new space is approximately 50' and
faces directly into the intersection center.
