Mayor and City Council From: Ken Baker, AICP, Interim Planning Director Subject: Ordinance No. 877, 2nd reading - Changing the Street Name of Sam School Road to Sams School Road. Action Requested: Conduct public hearing. Consider approval of second reading for Ordinance 877, changing the street name of Sam School Road to Sams School Road. Back Ground Information: According to historical records, Sams Community School was established in 1877 by Calvin A. and Lucinda Sams with the donation of a school site located near the northwest intersection of W. Dove Street and Sam School Road. The road has been incorrectly identified as Sam School Road. The Southlake Historical Society has requested that the name be changed to correctly reflect the name of the site donors. The street extends in a north — south direction from Kirkwood Boulevard West in the Town of Westlake to W. Dove Street in the City of Southlake. Financial Considerations: The cost of two new signs is approximately $100.00. Citizen Input / Board Review: A notice of the public hearing to be held for the 2 nd reading on August 17, 2004 will be published in the official newspaper of the City and a notice letter regarding the public hearing will be sent to all owners of property addressed along this road, according to the official tax roll, and to the town of Westlake. Legal Review: The original street name change ordinance was drafted by the City Attorney. Alternatives: Approve it or deny it. City Council Action: August 3, 2004; Approved first reading on Consent(5 -0) CITY OF SOUTHLAKE ORDINANCE NO. 877 AN ORDINANCE CHANGING THE NAME OF ONE STREETS LOCATED WITHIN THE CITY PRESENTLY KNOWN AS "SAM SCHOOL ROAD ", LOCATED WEST OF STATE HIGHWAY 114 EXTENDING FROM WEST DOVE STREET TO A NORTHERN BOUNDARY OF THE CITY OF SOUTHLAKE CITY LIMITS AND A SOUTHERN BOUNDARY OF THE TOWN OF WESTLAKE TOWN LIMITS TO "SAMS SCHOOL ROAD ", FURTHER DESCRIBED IN EXHIBIT "A "; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR THE REPEAL OF INCONSISTENT ORDINANCES. WHEREAS, a change in the name of one street located within the City of Southlake, Texas (the "City "), presently known as "Sam School Road ", located west of State Highway 114 extending from W. Dove Street to a northern boundary of the City of Southlake city limits and a southern boundary of the Town of Westlake town limits to "Sams School Road" has been requested by the City of Southlake; and WHEREAS, it is the intention of the City Council to hereby officially change the name of such streets as requested. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE: Section 1. That all of the above premises are found to be true and correct and are incorporated into the body of this Ordinance as if copied in their entirety. Section 2. That the name of the portion of the streets located within the City presently known as "Sam School Road" located west of State Highway 114 extending from W. Dove Street to a northern boundary of the City of Southlake city limits and a southern boundary of the Town of Westlake town limits as described in Exhibit "A ", is hereby officially changed to "Sams School Road ". Section 3. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 4. All ordinances or parts of ordinances inconsistent or in conflict with the provisions of this ordinance are hereby expressly repealed to the extent of the inconsistency or conflict.
