ATTACHMENTS: (A) Background Information (B) Vicinity Map (C) Site Plan (D) Sign Detail & Building Elevation (E) Sign Variance Application STAFF CONTACT: Dennis Killough (481 -2073) Bruce Payne (481 -2036) Case No. SP 04 -124 BACKGROUND INFORMATION OWNER: Fitness In Motion APPLICANT: Gary Glanger PROPERTY SITUATION: Fitness In Motion is a tenant in the Shafer Plaza development located at the southeast corner of East Southlake Boulevard and South Nolen Drive. The property address is 2707 East Southlake Boulevard, Suite 110. REQUEST: The applicant wants to revise the existing attached sign on the east side of the building, facing the interior parking area, by increasing the letter size of the word "Fitness" and placing the words "In Motion" underneath with small letters. This revision will make the letter size greater than permitted based on the distance to E. Southlake Boulevard and will also make the area of the sign larger than permitted by the ordinance. Additionally, the applicant would like to use the existing sign on the front and place is on the rear of the building facing S. Nolen Drive. This will make the letter size greater than permitted based on the distance to S. Nolen Drive. Approval of variance is required in order to receive a building permit for these signs. STAFF COMMENTS: The sign plan, building elevation, site plan and variance applications are attached to this report. The following variances to the Sign Ordinance No. 704 -B are requested: Front (East) Facade: • Ord. 704 -13, Section 16.A.2 maximum letter/logo heir The maximum height allowed for letter or logos shall be 18 inches based on a distance of 101 -150 feet from the right -of -way. The proposed letter height is 27 inches. • Ord. 704 -B, Section 16.A.3 maximum area: The maximum area allowed shall be 0.75 square feet for every one (1) foot of width of building or lease space not to exceed 400 square feet. The maximum area permitted is 34 square feet. The proposed area is 45 square feet. Rear (West) Facade: • Ord. 704 -B, Section 16.A.2 maximum letter /logo heir The maximum height allowed for letter or logos shall be 12 inches based on a distance of less than 100 feet from the right -of -way. The proposed letter height is 18 inches. Case No. Attachment A SP 04 -124 Page 1 The City Council may authorize variances in accordance with the following provision of the Sign Ordinance No. 704 -13, Section 14, Variances: The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. In granting any variance, the City Council shall determine that a literal enforcement of the sign regulations will create an unnecessary hardship or a practical difficulty on the applicant, that the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self - imposed, that the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties, and that the granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. A person may request a variance from the Sign Ordinance by filing the request with the Building Official. Any request for variance shall be accompanied by a completed application and a non - refundable filing fee in the amount specified in the current fee schedule adopted by City Council.
