Item 9DRESOLUTION NO. 04 -036 A RESOLUTION OF THE CITY OF SOUTHLAKE, TEXAS, APPOINTING MEMBERS TO THE SOUTHLAKE PARKS DEVELOPMENT CORPORATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the authority granted by the Department Corporation Act of 1979, Article 5190.6, Texas Revised Statutes as amended (the "Act "), the City Council found it advisable to authorize the creation of a non - profit corporation to be named the Southlake Park Development Corporation to act on its behalf in financing, under the Act, eligible "projects" deemed to be for the benefit of the public; and, WHEREAS, the Board of Directors shall be appointed by the City Council and be composed of seven (7) persons; four (4) of the Board of Directors shall be members of the City Council and the three (3) remaining Directors must not be employees or officers of the City, or members of the City Council, and at least one (1) of the remaining Directors must be a member of the Southlake Park and Recreation Board; and, WHEREAS, terms of the Directors shall be for two (2) years, expiring on May 31 of odd numbered and even numbered years, respectively. Directors may be appointed to succeed themselves. Each director shall serve until a successor is appointed; and, WHEREAS, the terms for Carolyn Morris (City Council representative) and Rex Potter (City Council representative) expire in May 2004, and there is an unexpired term with one year remaining due to the end of Tom Stephen's term on City Council (City Council representative); now, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, THAT: Section 1. All of the findings in the preamble are found to be true and correct and the City Council hereby incorporates said findings into the body of this resolution as if copied in their entirety. Section 2. The City Council hereby appoints the following members to serve as part of the Board of Directors for the Southlake Parks Development Corporation: City Council representative term ends May 2006 City Council representative term ends May 2006 City Council representative term ends May 2005 Resolution No. 04 -036 Page 2 of 2 Section 3.
