BACKGROUND INFORMATION
OWNERS: Cooper & Stebbins, L.P. and the City of Southlake
APPLICANT: City of Southlake
PURPOSE: This will allow a mass gathering event in association with the annual
Independence Day celebration. The recent approval of the
amendment 480 -UU to the Comprehensive Zoning Ordinance requires
approval of a Specific Use Permit for certain mass gathering events.
PROPERTY SITUATION: The Property is located at the northeast corner of E. Southlake
Boulevard and N. Carroll Avenue and encompasses all of Southlake
Town Square, Phase I.
LEGAL DESCRIPTION: Southlake Town Square, Phase I
LAND USE CATEGORY: Town Center
CURRENT ZONING: "DT" Downtown District
HISTORY: This is the fifth annual Independence Day celebration held in the
Town Square.
P &Z ACTION: April 22, 2004; Approved (5 -0) for five (5) years as long as it stays
within the scope of this application and the city's ordinances.
STAFF COMMENTS: A site exhibit and general description of the event is included as attachment
`C' of this report. The expected attendance of the event is
approximately 15,000. The applicant is requesting that the approval
of this Specific Use Permit allow the event to occur once annually in
conjunction with the Independence Day holiday during the first week
of July, so long as the event remains within the scope of this
application.

Dear Chairman Stansell and Members of the Planning and Zoning Commission:
Thank you in advance for your consideration of a Specific Use Permit for the City's annual
Stars and Stripes program in Town Square. The event is scheduled for Saturday, July 3r
from approximately 5:00 p.m. until 10:00 p.m. The City, in cooperation with Cooper and
Stebbins of Town Square, seek to provide an evening of music, fun, and fireworks for our
community to enjoy.
We anticipate no significant changes to the program logistics for this year's event as
compared to previous Stars and Stripes celebrations. As in the past, the program
necessitates the closing of a number of streets in the downtown area. The Department of
Pubic Safety continues their management of the street closings, in addition to traffic
control, crowd control, and first aid. The use of shuttle buses in conjunction with the
completion of State Highway 114 and the Carroll Avenue overpass should result in an
overall decrease in traffic congestion. The discharge of the fireworks occurs from the
same location as last year with the exception of the finale to include launches from the roof
tops of two buildings directly east and west of Town Hall. The City Fire Marshall works
closely with the pyrotechnic company to ensure that applicable regulations are followed and
all safety precautions taken. We anticipate using the same company as last year to provide
the fireworks for this upcoming celebration. Event plans call for three food vendor booths,
along with two glow stick vendors, and four beverage booths to serve the public. As a
convenience to visitors, adequate temporary restrooms and hand wash stations are provided
at three separate locations within the private parking areas of Town Square. Attached for
further clarification, please find a site map detailing all of the event activity locations.
We are asking the Commission to consider approval of the request for a Specific Use
Permit for the annual Stars and Stripes event as submitted, and would further request the
Commission to consider an approval period of five years exclusive of any future
substantive changes to the event.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, GRANTING SPECIFIC USE PERMIT FORA
MASS GATHERING EVENT ON PROPERTY WITHIN THE CITY OF
SOUTHLAKE, TEXAS, LOCATED AT THE NORTHEAST CORNER
OF E. SOUTHLAKE BLVD. AND N. CARROLL AVENUE, BEING
LEGALLY DESCRIBED AS SOUTHLAKE TOWN SQUARE PHASE I,
AN ADDITION TO THE CITY OF SOUTHLAKE, TARRANT COUNTY,
TEXAS, ACCORDING TO THE PLAT RECORDED IN CABINET A,
SLIDE 4892, PLAT RECORDS, TARRANT COUNTY, TEXAS, MORE
FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A ", AND AS
DEPICTED ON THE APPROVED SITE EXHIBIT ATTACHED
HERETO AND INCORPORATED HEREIN AS EXHIBIT `B" AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, a Specific Use Permit for a mass gathering event has been requested by a person or
corporation having a proprietary interest in the property zoned as "DT" downtown district; and,
WHEREAS, in accordance with the requirements of Sections 45.1 (37) and 45.14 of the City's
Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have giventhe
requisite notices by publication and otherwise, and have afforded the persons interested and situated in the
affected area and in the vicinity thereof, and,
WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use
Permit is in the best interest of the public health, safety, morals and general welfare of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION 1.
A Specific Use Permit is hereby granted for a mass gathering event on property located at the northeast
corner of. E. Southlake Blvd. and N. Carroll avenue, being legally described as Southlake Town Square Phase
I, an addition to the City of Southlake, Tarrant County, Texas, according to the plat recorded in Cabinet A,
Slide 4892, Plat Records, Tarrant County, Texas more fully and completely described in Exhibit "A ", and as

depicted on the approved site plan attached hereto and incorporated herein as Exhibit "B" and providing an
effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions
set forth herein. The following specific requirements and special conditions, if any, shall be applicable to the
granting of this Specific Use Permit:
