APPLICANT: Zone Systems, Inc. PURPOSE: The purpose of this request is to receive approval of a specific use permit for the co- location of a telecommunications antenna on an existing tower. PROPERTY SITUATION: 3700 North White Chapel Boulevard LEGAL DESCRIPTION: Lot 1, Block A, Oien Addition LAND USE CATEGORY: Public / Semi - Public CURRENT ZONING: "CS" Community Service District HISTORY: -A preliminary plat for the Oien Addition was approved by City Council on September 6, 1988. -A final plat for Lot 1, Block A, Oien Addition was approved by City Council on October 4, 1988. -City Council approved a change of zoning to "CS" for Lot 1, Block A, Oien addition on May 16, 1989. -A site plan for a telecommunications tower was approved by City Council on February 20, 1996. TREE PRESERVATION: The Landscape Administrator has no comments for this item. P &Z ACTION: April 22, 2004; Approved (5 -0) subject to Site Plan Review Summary No. 3, dated April 16, 2004; allowing the requested variances and noting the red photinias are to be watered and maintained in perpetuity. STAFF COMMENTS: Attached is Site Plan Review Summary No. 3, dated April 16, 2004. The following variances are being requested: • Maximum building size — The maximum building size allowed is 180 square feet. The applicant is proposing a building size of 188 square feet. • Maximum building height —The maximum building height allowed is 10 feet. The applicant is proposing a building height of approximately 11 feet. • Masonry Buildings within 400 feet of single family residential properties are required to have a masonry facade. The applicant is proposing a pre- fabricated building with a facade of exposed aggregate. Case No. ZA03 -089 Attachment A Page 1 • Pitched roof — Buildings within 400 feet of single family residential properties are required to have a pitched roof. The applicant is proposing a pre- fabricated building with a flat roof. • Setback — No non - single family residential building may encroach in the area above a line having a slope of 4:1 from any single family residential property. However, a structure may be built up to within 40 feet of the residential property line, provided that the structure is no greaterthan one story or 20 feet in height. The applicant is proposing the generator cabinet to be within 20 feet from the northern property line. • Number of Buildings —No more than 3 separate equipment buildings are permitted on a single lot. The applicant is proposing to add a 5 t ' equipment shelter. • Bufferyards — Where abutting public land, public streets, or land designated as low or medium density residential shall provide screening as required in an "F2" bufferyard. The applicant is proposing bufferyards on the north and east property lines with a solid plant screening on all sides of the interior compound. April 15, 20014 Mr. Dennis Killough Senior Planner City of Southlake 1400 Main Street, Suite 310 Southlake, TX 75092 Re: Case No. ZA03 -089 Verizon Wireless Collocation American Tower Site 92148 Southlake Lot 1, Block A Oicn Addition Dear Mr. K.illough: Verizon Wireless, Inc. plans to mount cellular communication antennas on the existing freestanding communication tower referenced above. This proposed collocation requires a specific use permit and a modification to the site plan that was adopted by the City of Southlake on February 20, 1996 (Zoning Case No. ZA95 -129). In accordance with the revised site plan submitted today, we respectfully request variances for the following: I. Maximum building size: 8 square feet. Maximum building size allowed is 180 square feet; proposed building is 188 square feet (11' 8" x 16'). 2. Maximum building height: 1 foot. Maximum building height allowed is 10 feet; proposed building height is approximately 11 feet, including 10 feet 3 '/a inches for the building plus several additional inches for the concrete slab. The building is pre - fabricated and is built to a specified size. The equipment shelter will be screened from the adjacent residential - designated property by red -tip photinia, as well as a landscaped buffer yard in accordance with the Southlake Zoning Ordinance, and will not be visible once the solid screening is in place. 3. Masonry and Pitched Roof requirements: Section 43.13a requires a masonry fagade for buildings within 400 feet of single- family residential properties as set out in Ordinance No. 557; proposed building faqade is to be exposed aggregate. Section 43.13b requires a pitched roof for buildings within 400 feet of single- family residential properties. The building is pre - fabricated and is built to a specified size. Setback from property designated for residential use: The City's Land Use Plan designates the property to the north of the site as residential, and the proposed generator will be 20 feet from the northern property line. The solid screening to be provided around the interior fenced compound, as well as the 10 foot buffer yard along the northern property line, will conceal the proposed generator, as well as the existing generator and fuel tank which are also within 40 feet of the property line. The proposed generator will be enclosed in a cabinet, rather than a walk -in building structure. The generator cabinet will be 71.95 inches at its highest point, so it will not be visible through the solid screening and buffer yard. 5. Buffer yard requirements: The Zoning Ordinance requires that all four boundaries of the property comply with the buffer yard requirements specified by Ordinance No. 480, Section 42. The site plan, like the plan approved in 1996, provides buffer yards only on the northern property line abutting the residentially- designated property to the north, as well as along the cast property Iine fronting White Chapel Road. The solid screening which will be provided on all sides of the interior compound will effectively conceal the existing and proposed equipment on the ground, and the buffer yards on the north and east property lines will enhance the screening. However, to the west and to the south is heavily wooded flood plain that is property of the U.S. Army Corps of Engineers and in all likelihood will never be developed. 6. Maximum number of building structures: The maximum number of equipment buildings allowed on one site is three. There are currently four equipment structures on the property; Verizon is requesting a variance to add a fifth equipment shelter. American Tower's lease agreements with other carriers require Verizon to be placed in its own space apart from other carriers. The Verizon collocation will result in an improved communication tower site, with landscaping and paving that have not been provided to date.
