BACKGROUND INFORMATION

PROPERTY SITUATION: Southlake Corners is a multi - tenant development occupying the site ofthe old
Wal -Mart building. The project will include three buildings that will have lease
spaces to accommodate larger retail anchors as well as smaller retail tenants.
The property address is 200 N. Kimball Avenue.
REQUEST: The applicant has applied for a Conditional Sign Permit for specific approval
of the Circuit City sign included with this application and to apply specific
rules for future signs in the Southlake Corners development.
STAFF COMMENTS: The sign criteria, building elevations, site plan and applications are attached to
this report. The following regulations for the Conditional Sign Permit have
been proposed for Southlake Corners:
ATTACHED SIGNS:
• Section 16.A.2 Maximum letter/logo height The maximum height allowed
for letters or logos shall be based on the following criteria:
Lease space 20,000 Sq. Ft. or greater (Anchor Retail): 60 inches
Lease space less than 20,000 Sq. Ft. (Retail Buildings): 36 inches
Circuit City: Refer to example attached as appendix `D'
Sign #1: 86 inches
Sign #2: 62 inches
The height of the letter /logo permitted under the Sign Ordinance No.
704-A is 42 inches based on a distance greater than 301 feet from the
right -of -way.
• Section 16.A.3 Maximum area The sign area is to be calculated to
enclose each sign structure component. Refer to examples attached as
appendix `A' below. The maximum area allowed shall be based on the
following criteria:
Lease space 20,000 Sq. Ft. or greater (Anchor Retail): 250 square feet
Lease space less than 20,000 Sq. Ft. (Retail Buildings): The sign area
will be a factor of 0.75 square feet for every one -foot of width of the

building or lease space, but not limited to less than 45 sf *
The maximum area permitted under the Sign Ordinance No. 704-A is
0.75 square feet for every one foot of width of the building or lease
space, not to exceed 400 square feet.
• Section 16.A.4 Number of signs Each tenant shall be allowed one
attached sign on each facade visible from a street or internal driveway.
The Sign Ordinance No. 704A allows only one attached sign per lease
space along each street frontage on any site with no more than two (2)
signs allowed per lease space.
MONUMENT SIGNS:
• Section 16.B.3 Maximum height The maximum height allowed shall be
based on the following criteria:
On State Highway 114: 30 feet
On E. Southlake Blvd & Kimball Ave: 20 feet
The maximum heightpermitted under the Sign Ordinance No. 704A is 5
feet for the sign structure.
• Section 16.B.4 Maximum area The maximum area allowed shall be based
on the following criteria:
On State Highway 114: 80 square feet + 20 square feet (area of
Circuit City logo)
On E. Southlake Blvd & Kimball Ave: 36 square feet + 14 square
feet (area of Circuit City
logo)
The Sign Ordinance No. 704A requires the area to be calculated to the
limits of the sign, or the smallest box to enclose all portions of the sign.
• Section 16.B.5 Number of signs 3 monument signs shall be permitted.
The Sign Ordinance No. 704A allows only one monument sign along
each street frontage on any site and monument signs may be no closer
than five hundred (500) feet on any one site.
• Section 16.B.6 Minimum setback & sign location Monument signs shall
be located as shown on the site exhibit in appendix B'.

The minimum setback required is fifteen (1 S) feet from any property line.
• Section 16.B.7 Material requirements Specific design is attached as
appendix `C'.
All sign text and graphic elements shall be limited to a minimum of six
(6) inches from the outer limits of the sign structure.
The City Council may authorize a Conditional Sign Permit in accordance with
the following provisions of the Sign Ordinance No. 704 -A, Section 6,
Conditional Sign Permit:
GENERAL: Notwithstanding anything in this ordinance to the contrary, the
erection of a sign or signs may be approved pursuant to this section under a
conditional sign permit approved by the City Council. The purpose of this
section is to allow for a specialized review of signs which may not be
appropriate generally without certain restrictions, but which, if controlled as
to the number, size, height, color, location, lighting, or relation to adjacent
properties, would promote the health, safety, and welfare of the community.
Conditional permitting of signs shall not be based upon the content of the
sign, but is intended to allow for the evaluation of the physical impact of the
proposed sign on adjacent properties and to ensure adequate mitigation of
potentially unfavorable factors, such as the number, size, height, color,
location, lighting, and other potentially unfavorable impacts.

Re: Redevelopment Plan for the Existing Wal -Mart
Southlake Corners
Corner E. Southlake Blvd. (FM 1709), SH 114 and N. Kimball Avenue
Overview: As shown on our Site Plan, this redevelopment proposes to reduce the size of the
Wal -Mart building and add additional retail shops closer to N. Kimball Avenue and Southlake
Boulevard. As this is a redevelopment of an existing retail operation, the ability to fully comply
with the ordinances and design guidelines set by the City of Southlake is Limited. It is on this
basis that we request the following variances:
That a literal enforcement of the sign regulation will create an unnecessary hardship or
practical difficulty on the applicant: Due to the proxiinity of the facades to Southlake Blvd.,
Kimball Avenue and Highway 114 the required letter height will limit the view of the individual
tenants to these different major streets. By increasing the letter height we hope to aid in the
visibility of the individual retail shop space. In addition, we are proposing to reduce the allowable
square footage to offset the proposed increased letter height, to incorporate the intent of the
signage ordinance.
That the situation causes the unnecessary hardship or practical difficulty is unique to the
affected property and is not self imposed: Creating a unique sign criteria for this specific site
will allow the signage to relate with the exterior scale and treatments of the facades and create a
uniform appearance between different sized tenants. Our intent is to create a balance between the
signage and the various facades to result in uniformity within the entire center.
That the variance will not injure and will be wholly compatible with the use and permitted
development of adjacent properties: We feel that the increased letter heights will in fact aid in
the overall visual appearance of the center and create cohesiveness among the adjacent retail
developments within the City of Southlake.
That the variance will be in harmony with the spirit and purpose of the sign ordinance: By
proposing the `conditional sign permit' we hope to create a condition in which the different
retailers will be satisfied, while not imposing any disadvantage to the adjacent retailers. IN
proposing this, we want to avoid individual applications for sign variances by each individual
future tenant in this development.
