APPLICANT: Exousia Restaurants, L.L.C., dba X's & O's, A Sporting Tavern PURPOSE: The purpose of this request is to receive approval of a Specific Use Permit for the sale of alcoholic beverages. PROPERTY SITUATION: 1239 Main Street in Southlake Town Square LEGAL DESCRIPTION: Lot 4, Block 1R, Southlake Town Square LAND USE CATEGORY: Town Center CURRENT ZONING: "DT" Downtown District P &Z ACTION: March 18, 2004; Approved (6 -0) subject to the term of the lease. STAFF COMMENTS: Although the business name references a "Tavern ", according to the applicant, the intended principal use of this property is a restaurant with an accessory full service bar. According to Section 45.6 of the Zoning Ordinance No. 480, as amended, for any business which derives more than seventy -five (75) percent of its gross revenues from the on- premises sale of alcoholic beverages, the City Council may require more stringent standards as it deems necessary to adequately protect adjacent properties. According to the applicant, the sale of alcohol will not exceed 75% of the gross revenues. Due to the limited scope of this request and the fact that no changes are to be made to the previously approved concept /site plan, no new review letter was generated. This site is subject to all conditions of the previously approved plans. It is anticipated to drive 40% revenue from food and 60% revenue from the sale of alcohol. The reason for the high percentage of alcohol sales is due to the price point of the wine and spirits sold at the establishment.
