RESOLUTION NO. 04 -020
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, AMENDING CITY OF SOUTHLAKE
PERSONNEL POLICIES TO ADOPT A POLICY REGULATING
PROTECTED HEALTH INFORMATION AS REQUIRED BY THE
HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT
( HIPAA) OF 1996.
WHEREAS, the Health Insurance Portability and Accountability Act ( HIPAA) was
enacted by Congress in 1996; and
WHEREAS, the HIPAA Privacy Rule published in August 2002, establishes standards
for the protection of certain individual health information, as well as the rights of individuals in
regards to understanding and controlling how their health information is used; and
WHEREAS, the City of Southlake (the "City ") seeks to protect the individually
identifiable health information of its employees and their dependents by limiting the use and
disclosure of protected health information to that permitted or required by the HIPAA Privacy
Rule, or as authorized by the individual; and
WHEREAS, the City desires to establish a policy to achieve this objective; NOW
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, THAT:
Section 1: The City of Southlake hereby adopts the Health Insurance Portability and
Accountability Act ( HIPAA) Privacy Policy, a copy of which is attached hereto as Exhibit "A"
and which is incorporated by reference herein.
Section 2: This resolution shall become effective April 14, 2004.
