Southlake Blvd in the Shafer Plaza development and is next to the Ultimate Electronics. The property address is 2717 E. Southlake Blvd, Suite 160. REQUEST: The applicant is proposing a second attached sign on the north side of the building facing East Southlake Boulevard in order to identify the services provided. The proposed sign will comply with letter /logo size requirements. Approval of a variance is required in order to receive a building permit for this sign. STAFF COMMENTS: The sign criteria, building elevations, site plan and applications are attached to this report. The following regulations for the Variance have been proposed for Re[essence]: • Ord. 704 -A, Section 16.A.4 NUMBER OF SIGNS Only one attached sign per lease space shall be allowed along each street frontage on any site, unless otherwise specifically provided in this ordinance. This will be the second attached sign for this fa(ade. The City Council may authorize variances in accordance with the following provision of the Sign Ordinance No. 704 -A, Section 14, Variances: The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. In granting any variance, the City Council shall determine that a literal enforcement of the sign regulations will create an unnecessary hardship or a practical difficulty on the applicant, that the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self - imposed, that the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties, and that the granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. A person may request a variance from the Sign Ordinance by filing the request with the Building Official. Any request for variance shall be accompanied by a completed application and a non - refundable filing fee in the amount specified in the current fee schedule adopted by City Council. That a literal enforcement of the sign regulation will create an unnecessary hardship or practical difficulty on the applicant. a. Customers complained and continue to point out that our current sign is hard to read. b. Customers do not know what Re[essence] has to offer and were not aware that we are a spa until they drove through the parking lot. c. As a new business to Southlake, we are not attracting new drive by customers because they cannot see us. d. We do not have a marquis to attract and advertise our business and have to rely on the building logo alone. e. The sign letter /logo height and area regulations do not permit Re[essence] from displaying the entire logo. f. The larger "R" creates unusable allotted area. Thus, there is not enough room to include "Spa & Tan" next to "Re[essence] g. The sign area regulation prevents Re[essence] from including "Spa & Tan " under the "Re [essence] " logo. 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. a. Re[essence] occupies the right hand corner of the building anchored by Ultimate Electronics. b. We are the set back farthest from the street andpositioned at an angle to both Nolan and Southlake Blvd. c. Most shopping centers off Southlake Blvd. are facing Southlake Blvd and are much closer to the street thus, easily seen by traffic. d. Most Shopping centers have a shared marquis. The only business in our two building center is the Ultimate Electronics marquis. We cannot rely on this to attract business. e. Unique to other shopping centers, our parking lot is shared by two separate shopping strips. The two anchors are Ultimate Electronics and Baja Grill. The Baja Grill anchored building is perpendicular to ours and faces the west bound traffic affording them a clear eye shot to westbound traffic. This building (Smoothie King, Fast Frame, Baja Grill etc)The Spa is situated in a way that blocks east bound view of our building. f. Most shopping centers have shared (lighthouse styled) marquis. We do not have a marquis despite our distance from Southlake Blvd. 3. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. As seen on the sign proposal, the sign is tasteful and does not negatively affect the aesthetic appeal of buildings in our center or others on the Southlake strip. 4. That the variance will be in harmony with the spirit and purpose of the sign ordinance. See Attached Case No. SP 04 -024 Attachment E Page 1
