BACKGROUND INFORMATION
OWNER/APPLICANT: Planet Beach Tanning Salon
PROPERTY SITUATION: Planet Beach Tanning Salon is located in the Southlake Marketplace
development on the southeast corner of W. Southlake Blvd and Davis Blvd.
The property address is 2125 W. Southlake Blvd, Suite 325.
REQUEST: The applicant is proposing an attached sign on the north side of the building
facing W. Southlake Blvd. The proposed sign will have an area greater than
permitted under the Sign Ordinance No. 407 -A. Approval of a variance is
required in order to receive a building permit for this sign.
STAFF COMMENTS: The sign criteria, building elevations, site plan and applications are attached to
this report. The following regulations for the Variance have been proposed
for Planet Beach Tanning Salon:
• Ord. 704 -A, Section 16.A.3 MAXIMUM AREA The maximum
permitted area for attached signs is 0.75 square feet for every one foot of
width of building or lease space not to exceed 400 square feet.
The store front width is approximately 24 feet in width. The maximum
area permitted is 18 square feet. The applicant is requesting an area of
approximately 42 square feet.
The City Council may authorize variances in accordance with the following
provision of the Sign Ordinance No. 704 -A, Section 14, Variances:
The City Council may authorize variances to any restriction set forth in this
ordinance, including but not limited to the number, type, area, height, or
setback of signs, or any other aspect involved in the sign permitting process.
In granting any variance, the City Council shall determine that a literal
enforcement of the sign regulations will create an unnecessary hardship or a
practical difficulty on the applicant, that the situation causing the unnecessary
hardship or practical difficulty is unique to the affected property and is not
self- imposed, that the variance will not injure and will be wholly compatible
with the use and permitted development of adjacent properties, and that the
granting of the variance will be in harmony with the spirit and purpose of this
sign ordinance. A person may request a variance from the Sign Ordinance by
filing the request with the Building Official. Any request for variance shall be
accompanied by a completed application and a non - refundable filing fee in the
amount specified in the current fee schedule adopted by City Council.

Demonstration
Please demonstrate that the following conditions are applicable to the requested sign
variance
1. That a literal enforcement of the sign regulation will create an unnecessary hardship or
practical difficulty on the applicant.
The current signage does not describe the business. This has been detrimental to our business;
many people don't know what type of business we are with the full name being used. The new
signage will include the full name of the business as well as describe the type of business in the
name. The business is located a far distance from the main R.O.W. (1709), therefore one would
not be able to read the signage from the road if the sign was small enough to fit the current
regulation size requirements.
The current sign reads "Planet Beach" in yellow letters. As evidenced by the attached
photographs it is very difficult to read from a distance. The new sign with the second line of copy
will read "Tanning Salon" in orange in addition to the colorful logo, which will make our business
name easier to read from a distance, in addition to describing the business.
2. That the situation causing the unnecessary hardship or practical difficulty is unique to
the affected property and is not self imposed.
The difficulty is that the business is located quite a distance from the R.O.W. (1709), as shown in
the enclosed photographs. Therefore it is not realistic to read the sign from the R.O.W. without
having two lines of copy for the full business name, which describes the type of business.
3. That the variance will not injure and will be wholly compatible with the use and
permitted development of adjacent properties.
As shown in the attached elevation photograph, the sign will fit nicely over the center of the
storefront and will be in line with the size of the signage of the other businesses in the shopping
center.
4. That the variance will be in harmony with the spirit and purpose of the sign ordinance.
The purpose of the sign is to include the full name of the business, as well as to describe the type
of business. This will attract more customers, which will assist in our success. The current
signage is just part of the name and many people do not know what type of business it is.
