BACKGROUND INFORMATION
OWNER: 114 Kimball Square, Ltd.
APPLICANT: Consolidated Services of America, LLC
PROPERTY SITUATION: 114 Kimball Square is a multi - tenant development located at the northwest
corner of E. State Highway 114 and Shady Lane. The property address is
2360 E. State Highway 114.
REQUEST: The applicant has applied for a Conditional Sign Permit for specific approval
of the signs included with this application and to apply the same rules for these
signs to future signs in the 114 Kimball Square development.
STAFF COMMENTS: The sign criteria, building elevations, site plan and applications are attached to
this report. The following regulations for the Conditional Sign Permit have
been proposed for 114 Kimball Square:
Lease width less than 50 feet:
• Maximum letter/logo height 24 inches.
The height of the letter /logo permitted under the Sign Ordinance No.
704-A is 12 inches based on a distance of less than 100 feet from the
right -of -way.
• Maximum area 37.5 square feet.
The maximum area permitted under the Sign Ordinance No. 704A is
0.75 square feet for every one foot of width of building or lease space not
to exceed 400 square feet. A 25 foot lease space would allow a maximum
of 19 square feet.
Lease width 50 feet or reg ater:
• Maximum letter/logo height 42 inches.
The height of the letter /logo permitted under the Sign Ordinance No.
704A is 12 inches based on a distance of less than 100 feet from the
right -of -way.
• Maximum area 131.25 square feet.
The maximum area permitted under the Sign Ordinance No. 704A is
0.75 square feet for every one foot of width of building or lease space not
to exceed 400 square feet. A 50 foot lease space would allow a maximum
of 38 square feet.

The City Council may authorize a Conditional Sign Permit in accordance with
the following provisions of the Sign Ordinance No. 704 -A, Section 6,
Conditional Sign Permit:
GENERAL: Notwithstanding anything in this ordinance to the contrary, the
erection of a sign or signs may be approved pursuant to this section under a
conditional sign permit approved by the City Council. The purpose of this
section is to allow for a specialized review of signs which may not be
appropriate generally without certain restrictions, but which, if controlled as
to the number, size, height, color, location, lighting, or relation to adjacent
properties, would promote the health, safety, and welfare of the community.
Conditional permitting of signs shall not be based upon the content of the
sign, but is intended to allow for the evaluation of the physical impact of the
proposed sign on adjacent properties and to ensure adequate mitigation of
potentially unfavorable factors, such as the number, size, height, color,
location, lighting, and other potentially unfavorable impacts.

7. That a literal enjorcem+srd of the sign regulation will crate an unnecessary hardshlp or
practical difficulty on the applicant, Size: requirements are based on 60'
to 130' streets and not freeways covering over 300`. The sign
code restricts signs to sizes that actually impair visibility;
thereby, causing hardship can Detail and Service Merchants. These
requirements do not allow adequate letter sizes creating a
danger to motorists by being unreadable and impractical.

situated on SH Hwy. 114, which ultimately became a major freeway
carrying 71,000 cars per 24 hour period even during a 2 year
construction program. East Hwy 114 has S major lanes with 6

the height level east of the Center, then, ascending to almost
13' across the distance of the entire frontage.

the same signage as our request for theirs and /or their
Tenant's use in order to obtain required marketing visibility.
Signs attached to the building face of our Center should be
compatable with adjacent property uses and signages. I can not
conceive of any type of injury or incompatibility that would
occur.
4. That the variance will be In harmony with the spirit and purpose of the sign ordiname.
The spirirt and purpose of signage is to serve the needs of
building owners and their respective Tenants in a dignified
and highly visible impact manner conducive to good marketing
procedures. The letter and overall signage size should not
detract from the attractiveness and appeal of the buildings
and neighborhoods.
