PROPERTY SITUATION: The property is located at 545 Nolen Drive, Ste 250 LEGAL DESCRIPTION: Lot 8, Block 5, Cornerstone Business Park LAND USE CATEGORY: Industrial CURRENT ZONING: "I -1" Light Industrial District HISTORY: -A Preliminary Plat was also approved in May of 1997. -The City Council approved a zoning change from "AG" to "I -1" Light Industrial District on May 6, 1997. -A Final Plat was approved by the City on September 4, 1997 P &Z ACTION: February 5, 2004; Approved (5 -0) limited to the term of the lease or five (5) years, whichever is shorter; also in accordance with the parking agreement. STAFF COMMENTS: The maximum seating in the main sanctuary will be for 150 persons. The site will meet the off - street parking (50 spaces) by using 100% of the parking allocated by the adjoining tenants on the site. The facility will be used for Sunday morning and evening services. All activities will be performed during off -hours of the adjacent tenants and will not conflict with the parking requirements for the adjacent users. A reciprocal parking agreement must be executed and filed in the County by the property owner allocating the use of all the parking spaces on the site by the church during their services. Gentlemen: GenCap is concerned about parking issues related to the proposed Cornerstone Bible Church. The number of on -site parking spaces required by zoning may meet with church membership today but this parking only enables the absolute minimum standard to be reached. There are no additional parking spaces on -site to meet future growth. We all know that church membership can increase without the need to physically expand the worship area. Multiple service and class times still require additional parking since there is an overlap between those who are leaving and those who are arriving. If the church has maximized parking on day one what will happen during a five or ten year lease period? It is absurd to believe that parking will remain a static situation. I am sure the argument will be made by the property owner that he has a three- building complex and thus can accommodate additional off -site parking at his adjacent buildings. This is true as long as property ownership of the three buildings remains tied or cross parking agreements are made that run with the land. There is however the fact that the building farthest to the north already has a church, health club and karate studio, all of which operate on Sunday. This church was granted a ten -year SUP. Again, parking may be adequate for everyone today but there is no assurance that this will be true over a five or ten year period. I understand that an SUP can be revoked if the City determines that minimum requirements are no longer being met. However having this right and actually enforcing it are two different things. I would suggest that P &Z grant a series of one -year SUP's for Cornerstone Bible Church that are renewable for up to five years. Let the property owner and tenant structure their lease so that the tenant can terminate if an SUP is denied in the future. In this manner the parties to the lease are put on notice that they are expected to uphold the terms of the SUP rather than placing the burden on surrounding property owners to force a complaint if SUP requirements are being violated. Wang Date: February 2, 2004 Subj: SUP / ZA 03 -101 I received a notification of the request of a Specific Use Permit for Cornerstone Bible Church located at 545 South Nolen Drive. I have no objection to the use but want to make sure the parking requirement is clear to the user. According to the concept plan that all 56 parking spaces have been used to meet church's parking requirement. Applicant also states that there will be other church activities during the weekdays while 39 spaces are required for tenants in #100, #200 & #300. PIease note that the St. John's Church is two lots to the east and Southlake Harbor Church is two lots to the north. All three churches are likely to have a similar operating schedule.
