Palmer PROPERTY SITUATION: The property is located at the southeast corner of South Carroll Avenue and East Southlake Boulevard. REQUEST: The applicant is requesting a Conditional Sign Permit for monument signs, attached signs, and banner signs on light poles for The Shops of Southlake development. The specific variances to Sign Ordinance No. 704 -B are outlined below. STAFF COMMENTS: The sign criteria, building elevations, site plan and applications are attached to this report. Although a revised conditional permit document and plans have not been received, the applicant has agreed to the following modifications to their signage request noted by the redline and strike outs below: Entry Feature Signs (3 2 signs): The applicant is proposing 3 entry feature signs that are 30 20 feet tall and -16 4 feet wide. Please see the attached sign exhibit for complete details. The proposed signs will not meet the following monument sign regulations of Sign Ordinance No. 704 -13: • Maximum Base Height: 18 inches • Maximum Structure Height: 5 feet • Maximum Sign Structure Area: 70 s.f. • Maximum Sign Face Height: 4 feet • Maximum Sign Face Area: 50 s.f per sign face and 100 s.f per sign Monument Signs (2 3 signs): The proposed monument signs with the following variance to Sign Ordinance No. 704 -B: • Proposed Maximum Structure Height: b 5 feet The proposed monument structures will be compliant with Sign Ordinance No. 704 -B. Attached Signs: The following regulations are proposed for attached signs. Tenants Under 10,000 s.f. < 301 feet from ROW: • Maximum Letter Height: 36 18 inches • Maximum Logo Height: 42 18 inches The maximum letter /logo height permitted under Sign Ordinance No. 704 -B for tenants less than 100 feet from ROW is 12 inches. The ordinance does not specify a maximum sign height. Tenants Under 10,000 s.f. > 301 feet from ROW: • Maximum Letter Height: 42 inches • Minimum Sign Area: 40 s.f. The maximum letter /logo height permitted under Sign Ordinance No. 704 -B for tenants 301 feet or more from ROW is 42 inches. The ordinance does not specify a minimum sign area. Tenants 10,000 — 15,000 s.f. < 301 feet from ROW: • Maximum Letter Height: 42 18 inches The maximum letter /logo height permitted under Sign Ordinance No. 704 -B for tenants less than 100 feet from ROW is 12 inches. Tenants 10,000 — 15,000 s.f. > 301 feet from ROW: • Maximum Letter Height: 42 inches • Maximum Sign Height (multiple lines of copy): 46 inches; 3 inches between rows • Minimum Sign Area: 60 s.f. The ordinance does not specify a maximum sign height or minimum sign area. Tenants over 15,000 s.f. < 301 feet from ROW: • Maximum Letter Height: 42 18 inches The maximum letter /logo height permitted under Sign Ordinance No. 704 -B for tenants less than 100 feet from ROW is 12 inches. Tenants over 15,000 s.f. > 301 feet from ROW: • Maximum Letter Height: 60 42 inches • Maximum Sign Height (multiple lines of copy): 66 inches; 3 inches between rows The maximum letter /logo height permitted under Sign Case No. Attachment A SP 05 -258 Page 2 Ordinance No. 704 -B for tenants 301 feet or more from ROW is 42 inches. The ordinance does not specify a maximum sign height. Central Market /Large Anchor ( >70,000 s.f.) Attached Signs: • Number of signs: 3 • Maximum sign area: 450 s.f. (3 signs combined) • Maximum Letter Height: 65.5 inches • Roof line limitations: Primary sign will be attached above roof line Only one sign is permitted per lease space per street frontage under Sign Ordinance No. 704 -8. The maximum sign area is .75 x width of the building or lease space, which equals 244.5 sf. for Central Market. The maximum letter /logo height permitted for tenants 301 feet or more from ROW is 42 inches. No signs are permitted to project above the roof line. Banner Signs on light poles (multiple signs): • Sign Dimensions: 2 feet 2 inches by 4 feet Sign Ordinance No. 704 -B does not permit this type of sign. Staff Recommendations: The following changes area needed: • Specify a maximum logo height for all tenants. Only letter height is addressed for all but the less than 10,000 SF tenants. • Provide an exhibit for tenants 10,000 s.f. to 15, 000 s.f and over 15,000 s.f that are less than 301 feet from ROW). • Provide a minimum sign area for both types of tenants less than 10,000 sf. The City Council may authorize a Conditional Sign Permit in accordance with the following provisions of the Sign Ordinance No. 704 -A, Section 6, Conditional Sign Permit: GENERAL: Notwithstanding anything in this ordinance to the contrary, the erection of a sign or signs may be approved pursuant to this section under a conditional sign permit approved by the City Council. The purpose of this section is to allow for a specialized review of signs which may not be appropriate generally without certain restrictions, but which, if controlled as to the number, size, height, color, location, lighting, or relation to adjacent properties, Case No. Attachment A SP 05 -258 Page 3 would promote the health, safety, and welfare of the community. Conditional permitting of signs shall not be based upon the content of the sign, but is intended to allow for the evaluation of the physical impact of the proposed sign on adjacent properties and to ensure adequate mitigation of potentially unfavorable factors, such as the number, size, height, color, location, lighting, and other potentially unfavorable impacts. That a literal enforcement of the sign regulation will create an unnecessary hardship of practical diff eulty on the applicant. The site is internally focused and buildings located on the north side of the property will not have any off site visible signage without additional allowances being made for visible signage on Southlake Blvd, The Central Market building and adjacent retail is set back 585 feet from Southlake Blvd_ causing a hardship for national tenants to gain visibility to the public.. 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. The city approved site plan limits visibility from the streets to the from of all the buildings. The south buildings on the property w 585 feet from the ROW. This setback is 94 %Q farther back than the largest dimension allowed for the set back in section 16. A.,2, The ordinance allows signs up to 42" high 301 feet from the ROW. We are requesting a 70% increase in size allowance to 60" signs along the south property line buildings for lease spaces over 15,000 SF. These proportions are in line with the building facades designed for the site, 3. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. The request will not injure the adjacent properties. Building signs ate not visible from residential properties. The signs will conform to the signage used for the Town Center addition located to the north of the property. 4. That the variance will he in harmony with the spirit and purpose- of the sign ordinance. The signage criteria is designed to create an old town atmosphere for unique individual signs in a variety of options to match the Town Center addition and have a harmony between the sites.
